“AN ORDINANCE REQUIRING ALL

PERSONS ENGAGED IN HOUSE RENTING


SERVICES (BOARDING HOUSE,
APARTMENTS, AND BED SPACES) TO
REGISTER THEIR RESPECTIVE TENANTS IN
THE OFFICE OF THE BARANGAY”

• Whereas, there is an increasing number of
boarding houses in the barangay which
respond to the temporary dwelling needs of
students, workers, laborers or professionals
while away from their homes and it has
been observed by the Barangay Council that
tenants in house renting services,
Apartments and bed space owners are not
registered or included in our Barangay
Census Profile;

• Whereas, gathering these data of
registration to all boarders or transient
occupants will help us to locate and verify
their personal background or information;
• Whereas, the main concern of the
Barangay Council is to safeguard and protect
its constituent from transients that may
cause threat to any kind of crime incident
within the community;

• Whereas, to prevent this predicament, it
has been decided by the Barangay Council
to require all persons engaged in the house
renting services to register their boarders or
tenants to observe peace and order in the
barangay which are essential to the
promotion of the general public safety;
• Whereas, the Sangguniang Barangay
deemed fit to enact the above-mentioned
Ordinance to effectively and efficiently
address these problems;

• Now therefore, on unanimous motion and
unanimously seconded by the august body,
be it;
• BE IT ORDAINED by the Sangguniang
Barangay in session assembled that;

ARTICLE I
Title of the Ordinance

• This Ordinance shall be known


as the “Ordinance for House
Renting Services (House,
Apartment and Bed Space)”.

ARTICLE II
Coverage

• This Ordinance shall be strictly


implemented to all House Renting
Services within the territorial
jurisdiction of Barangay Calaocan,
Bambang, Nueva Vizcaya.

ARTICLE III
D e fi n i ti o n o f Te r m s

• LANDLORD - the owner of property (as houses, boarding houses,


apartments, or land) that is leased or rented to another;
• TENANT - one who has the occupation or temporary possession
of lands or tenements of another, specifically one who rents or
leases a dwelling (as houses, boarding houses, apartments, or
land) from a landlord;
• BOARDING HOUSE - a house that accepts individuals who pay to
reside temporarily or in a contract basis;
• APARTMENT - a room or suite of two or more rooms, designed
and intended for, or occupied by one family for living, sleeping
and cooking purposes;
• BED SPACES – means ay floor space, bed, bunk or sleeping
facility used or intended to be used as sleeping accommodation
for an individual.

ARTICLE IV
D e c l a r a ti o n o f P o l i c y

• It is hereby declared the policy of the


Barangay Council to strongly support
the estate in securing and
safeguarding its citizenry and the
general public as a whole, the Peace
and Order Council and all the Purok
Leaders of the Barangay shall pursue
a more strict and effective
enforcement of this Ordinance.

ARTICLE V
O b j e c ti v e s

• This Ordinance aims to achieve the following objectives,


to wit:
• To register all tenant of in-House Renting Services,
apartments and bed spacers residing within the Barangay;
• To update our Barangay Census Profile;
To monitor incoming & outgoing inhabitants to our
barangay;
• To serve as gathering-information mechanism to
determine their personal background;
• To effectively implement the Peace and Order plan of our
Barangay;
• To monitor Peace and Order in the community;

ARTICLE VI
Regulated Acts
• Under this Ordinance the following acts are hereby regulated, to wit;
All person engaged in this case of business must secure a Business Clearance in the
office of the barangay;
• Any new occupant must be reported immediately to the Office of the Barangay.
• A clearance from the previous landlord/landlady must be presented;
• A barangay clearance from the previous residence of the occupants must be
presented; and
• A registration form will be issued by the barangay;
• Moreover, there must be provisions for safe, potable, adequate water supply, fire
escape, fire protection equipment and fire safety programs.
• All boarding houses must maintain proper cleanliness and sanitation in their area of
responsibility. First aid medicine and equipment and a register of boarders must also
be maintained.
• Tenants must strictly comply with proper waste segregation in accordance with RA
9003.
• All boarding houses are also required to provide own set rules and regulations for the
compliance of their tenants.
• Landlord and Tenant must also execute a written contract indicating the period of stay,
rate per month and nature of facilities.

and Peace and Order Council
are hereby mandated to
oversee the strict
implementation of this
Ordinance.

ARTICLE VIII
I n f o r m a ti o n C a m p a i g n

• The Sangguniang Barangay,


Purok Leaders, Barangay
Personnel’s are hereby
mandated to take charge for
the information dissemination
campaign to ensure Strict
Compliance of this Ordinance.

ARTICLE IX
Penal and Other Provision

• Section 1. Penalty- any person whether natural or judicial who violates


this Ordinance shall be meted the following fines and penalties to wit;

-First Offense- a fine of not more than Five Hundred Pesos (Php500.00);
-Second Offense- a fine of not more than Seven Hundred Fifty Pesos
(Php750.00);
-Third Offense or more- a revocation of business clearance and a fine of
not more than One Thousand Pesos (Php1,000.00)
• Section 2. Separability Clause- if any provision or part of this Ordinance is
held invalid or unconstitutional, the remainder or the provisions not
otherwise affected shall remain in full force and effect.
• Section 3. Effectivity Clause- This Ordinance shall take effect immediately
upon approval.
