The Revised Forestry Code of the
Philippines
Introduction
• Presidential Decree No. 705, also known
as the Revised Forestry Code of the
Philippines, was enacted in 1975.
• Aims to regulate the use, management,
and conservation of forest resources.
• Strengthens policies on forest land
classification, sustainable use, and
penalties for illegal activities.
Forest Land
Classification

• Public forests are considered inalienable and


cannot be privately owned.
• Forest lands can only be reclassified for
agricultural or commercial use through legal
processes.
• Unauthorized occupation or use of forest
lands results in penalties and eviction.
Sustainable Forest
Management
• Encourages sustainable harvesting practices,
such as selective logging.
• Requires reforestation efforts from logging
permit holders.
• Regulates forest-based industries to
minimize environmental damage.
Timber Licensing and
Utilization
• Timber License Agreements (TLA) are required for
commercial logging.

• Kaingin (slash-and-burn farming) penalties:
Fine equal to 8x the forest products' value
and 2 to 4 years imprisonment.
• Individuals occupying forest lands before
December 31, 1981, may not be prosecuted
but can be relocated.
Amendments Under EO 277 (1987)
• Strengthened penalties for illegal
possession of forest products.
• Allows confiscation of illegally cut,
gathered, and transported forest
products.
• Grants rewards to informers who
provide details leading to violations.
Offenses and Penalties (Section 77)
• Unauthorized cutting, gathering, or
collecting of timber is punishable under
the Revised Penal Code.
• Corporate officers responsible for
illegal logging face deportation (if they
are foreign nationals).
• Illegal possession of timber without
permits results in confiscation and
imprisonment.
Transport & Utilization of Forest
Products
• DAO No. 79, s. 1990 & DMC 99-20
outline transport requirements.
• Required documents include
Certificate of Timber Origin (CTO),
Transport Agreement, and Sales
Invoice.
• Confiscation and legal action apply
for non-compliance.
Prohibited Acts Under RA 9175
(Chainsaw Act)
• Illegal ownership, possession, or sale
of chainsaws without permits.
• Imprisonment: 4 to 6 years and fines
between PHP 15,000 - PHP 30,000.
• Unlawful importation or
manufacturing of chainsaws also
penalized.
