Is this image copyrightable in the United Kingdom? The "THE" looks slighted. I recently changed the image's status to US-ineligible. George Ho (talk) 06:18, 28 September 2016 (UTC)
I don't understand. What do you mean when you wrote that "The The looks slighted"? The definition for slighted means insult, or treating someone or speaking of them without proper respect or attention. - I apologize, Becki. Maybe I should have said "italicized", not "slighted". I couldn't find the right word to say it. The "THE" looked something that's not easy to describe to me. Also, the Edge (magazine) logo was in Commons and subject to UK jurisdiction, but the UK court decided that the drawing of the "E" looks original enough to one judge, resulting in the deletion of the logo in Commons. The result of the discussion was: While the English Wikipedia does not require its images to be in the public domain in the source country (and thus, whether Mozambique has a FoP for architecture is not relevant to us), it does require the photography itself to be freely licensed. This one isn't, and as an existing building it could be recreated as a freely licensed image. Thus it violates WP:NFCC#1. Given the FoP situation, such an image is likely going to be PD-USonly. - Comment: I want to say delete per WP:NFCC#1 and that file could have also been tagged with Template:Replaceable fair use), but this stadium is in Mozambique and according to c:COM:FOP#Mozambique there is no FOP in the country (or only a limited version not acceptable for Commons) and that "FOP cases in Mozambique should be treated with increased care". It's not 100% clear then (at least to me) whether a freely licensed equivalent to serve the same purpose can be created. It's possible that something in c:COM:FOP#Choice of law may apply to this particular case, but I think determining that might require more discussion to determine. Regardless, the file is currently being used in 2017 Lusophony Games, Athletics at the 2011 All-Africa Games, Estádio do Zimpeto, Football at the 2011 All-Africa Games, but only has a non-free use rationale for the satdium article. If this file is kept as "non-free", then its use in the event articles is highly unlikely to satisfy WP:NFCCP even if corresponding rationales weree added, so it should only be used in the stadium article. -- Marchjuly (talk) 21:55, 28 September 2016 (UTC)
- Hmm. This image infringes two copyrights -- the copyright for the image itself which appears to be a computer generated drawing and the copyright for the stadium as a work of architecture. It is possible, even likely, that the drawing was created by the architect, so there is possibly only one copyright holder.
- I'm not completely familiar with WP:EN fair use (Marchjuly asked me to comment here because I have very considerable experience with copyright and FOP), but if there is any desire to reduce the number of copyrights infringed, I would think you might want a freely licensed aerial photograph of the stadium rather than this drawing of it. From a purely encyclopedic point of view that might be better as well -- to show how it actually is, particularly its surroundings -- rather than an idealized drawing of how it might be. However even if you replace the drawing with a photograph, the photograph will still infringe on the architect's copyright and require either a license from the architect or a fair use rationale.
- That brings me to a second unfamiliarity with WP:EN implementation of policy. NFCCP says
- "1) No free equivalent. Non-free content is used only where no free equivalent is available, or could be created, that would serve the same encyclopedic purpose. [emphasis added]
- This is not a dead person or razed structure. As long as the stadium exists, a free work could be created, but only with the cooperation of the architect. I don't know which side of NFCCP#1 that falls on. . . Jim - Jameslwoodward (talk to me • contribs) 11:44, 29 September 2016 (UTC)
