would it be too much to ask to test for the existence of the validator where this is done? Like so:


staticRules: function(element) {
        var rules = {};
        var validator = $.data(element.form, 'validator');
        if (!!validator&&validator.settings.rules) {
            rules = $.validator.normalizeRule(validator.settings.rules[element.name]) || {};
        }
        return rules;
    }

This might breakdown at some point but it would help with file upload controls nested in IE; I think. Or would you want to manually add child forms to the ignore list?
