Prior to non-consensual or forced entry, and within the limits allowed by the particular
emergency, the officer shall reasonably attempt to obtain consent to enter the premises or
vehicle. Following entry, the officer may search the premises or vehicle only to the extent
necessary to carry out the purposes of the entry. The officer shall secure the building or vehicle
prior to leaving either by release to a responsible person, or by making all reasonable effort to
physically secure the property.
Hot Pursuit Arrest/Search
An officer in fresh (hot) pursuit of a fleeing suspect may pursue them into a vehicle or premises
in order to arrest them only under the following circumstances:

Following entry, the officer may search the premises only to the extent necessary to locate the
suspect, protect himself or others and recover the evidence. Once the suspect is arrested, any
further search must comply with the other rules of this chapter.
Abandoned Property
An officer may, without a warrant, search for and seize any seizable property found in any open
field or determined to be abandoned property.
Consent to Search
When an officer has reason to make a warrantless search, they may request consent to search
from any person who has authority over the thing or place to be searched. Consent may be
given verbally or by use of the authorized departmental consent form.
A. In all cases, the officer shall advise the person giving consent that they have the right
not to consent and, if they consent, anything found might be seized and used as
evidence.
S. An invitation to enter the premises does not give the officer consent to search.
C. If the consent to search is later revoked, the officer must immediately stop the search.
If the consent to search is later limited, the officer must restrict it to the new limit.
However, the officer may still seize all seizable property discovered prior to the
withdrawal or limitation of consent and then apply for a search warrant if necessary.
D. A consent to search can be withdrawn by any person with authority over the thing or
place being searched regardless of anothers consent with equal standing.

Use of Force Training (TBP 3.02)
All officers shall attend annual training regarding the use of deadly force. This training will be
conducted by a TCOLE certified instructor, and the training should consist of policy, Texas law,
use of force scenario simulator, classroom training, practical exercises or any combination
thereof. The training must include the proper use of any firearm used by the officer in the
performance of their law enforcement duties.
Use of Force Training and Proficiency for Less Lethal Weapons (TBP 3.04)
It is the policy of the Department that all officers who are authorized to carry less lethal
weapons receive training at least biennially and demonstrate proficiency at least biennially in
the use of the less lethal weapon(s) for which they carry. The training must be conducted by a
TCOLE certified instructor who is certified for each weapon used. The instructor must insure
that the training is properly documented and that the documentation is submitted in accordance
with departmental policy.
Use of Force Response against Persons
An officer may only use force to achieve lawful objectives. The lawful objectives are:

In order to achieve any of the above objectives, an officer must:
A. Have reasonable suspicion to temporarily detain or probable cause to arrest that suspect
and
B. When feasible, identify themselves as a peace officer, state their purpose to detain or
arrest the suspect, give the reason for the detention or arrest and warn the suspect that
force will be used.
The amount and degree of force, which an officer may use to achieve an objective, must reflect
the surrounding circumstances. The circumstances may include:

Use of Restraints
Officers should use handcuffs or other restraining devices on an arrestee, unless the situation
warrants less restraint based on the arresting officers discretion. An officer should reasonably
protect an arrestee from injury caused by handcuffs or other restraining devices.
Use of OC Spray
U.. . .
A. An officer who sprays a suspect with OC Spray shall observe the suspect continuously
while he is in the officers custody. Any officer who sprays a suspect shall make
reasonable effort to conduct the necessary decontamination.
B. An arrestee who has been sprayed with OC Spray shall be transported to the Taylor
County Detention Facility as soon as practical after the arrest. The necessary
decontamination should be conducted prior to the booking process. The booking officer
shall be notified that the prisoner has been exposed to OC.
C. Any person who has been sprayed with OC spray who displays reactions that are
unusual shall be provided medical assistance and examination. Unusual reactions
include extended or abnormal breathing difficulties; excessive complaint of eye, skin or
throat irritation or other characteristics as provided in the training process.

E. An ECD may be discharged in accordance with departmental policies when
circumstances known to the individual officer at the time indicate that the application of
the ECD is reasonable to subdue and/or control a subject who poses an immediate
threat to anyone, and the subject is:

ECD Post Care
A. Immediately after a subject is exposed to and ECDJ officers shall be alert to any
indications that the individual needs medical care. This includes, but is not limited to:
breathing difficulties, profuse sweating and loss of consciousness. If any of these
symptoms are present or if the subject requests medical assistance, the officer shall
immediately summon medical aid. The officer also needs to be aware of injuries that
may occur as result of falling during an ECD discharge and the need for medical
attention to treat these potential injuries.
B. Once the subject has been secured, the following steps should be taken:
1. If probes are lodged in the skin, they should be removed by the officer. If they are
in sensitive areas (such as the vascular structure, neck, throat, face, groin or female
breast) they will be removed by medical personnel.
2. Puncture wounds should be treated with alcohol or iodine wipes and bandaged, if
necessary.
3. Any visible injuries caused by the ECD discharge should be photographed including
the probe penetration sites.

it is the policy of the Department that any officer involved in a use of force incident that results
in serious bodily injury or death will be relieved from field operations or placed on
administrative leave while the matter is investigated. This also applies to traffic collisions when
a person is seriously injured or killed. The on-duty supervisor shall immediately notify the
appropriate Assistant Chief of Police who in turn will notify the Chief of Police.
The Employee Assistance Program (EAP) shall be available to the employee. The Department
may also offer post-incident debriefing or counseling to any employee invoived.
No Duty to Retreat
Officers have no obligation to retreat or back down before resorting to the approved response
to resistance/aggression, including deadly force. However, if it would not increase the risk to
themselves or others, officers should consider retreat or withdrawal where delay (e.g. to secure
assistance) could make a more peaceable arrest more likely.

The Use of Force may be reviewed by the Event Review Board to:
A. Ensure the officers particular use of force complied with state law and departmental
policy;
B. Determine if the officers particular use of force indicates a need for special counseling
or training and
C. Determine if the situation requires further action.
Arrest and Transport of Violent Prisoners
Hand and leg restraints are acceptable methods of restraining violent prisoners. However, at
no time will a prisoner be restrained in a manner likely to cause injury. Subjects will not be
hog-tied or placed in any position which obstructs the airway or any mechanical functions of
respiration except during the initial control and restraint phase of the arrest and for only as long
as immediately necessary to gain control of the subject. Once the subject is restrained, the
officer(s) shall immediately set the person upright and relieve the subject of any heavy weight
used to gain control.
Care of Restrained Prisoners
Prisoners will not be left in a prone position with their arms restrained behind their back except
as necessary while preparing them for movement or transport. Under no circumstances will
subjects be left unattended in a prone position with their hands restrained behind their back.

Emergency Driving 12/04/2013 D-8
The Departments primary objective in all emergency driving situations is the protection of lives
and the safety of all persons. During emergency driving situations, officers will operate their
vehicles with extreme caution and in accordance with Chapter 546 of the Transportation Code.
Driving under emergency conditions does not relieve the officer from the duty to drive with due
regard for the safety of all persons nor will these provisions protect the officers from the
consequences of their reckless disregard for the safety of others.
Negligent or reckless action committed by police officers while in pursuit or when responding to
emergencies is prohibited by law and expressly forbidden by this policy. The duty to avoid
damage or injury to innocent third parties is superior to that of the pursuit or emergency
response.
Emergency Driving (Non-Pursuit) (TBP 7.15)
Definitions:
A. Non-pursuit emergency driving is the operation of an authorized emergency police
vehicle (with emergency lights and siren activated) by a police officer in response to a
life threatening situation or violent crime in progress, using due regard for the safety of
all persons.
B. Emergency response should be limited to situations where there is a substantial risk of
injury or danger to life.
The decision by an officer or a supervisor to drive, or continue to drive, under emergency
conditions will be in accordance with the provisions of this procedure and will be based on the
following considerations:
A. Officers will consider such factors as time of day, traffic conditions, location, weather
and other factors, which may be a potential hazard or liability to themselves or other
persons.
B. Officers will have sufficient information to justify the decision to drive under emergency
conditions.
C. When responding to an emergency situation, including officer needs assistance,
officers will keep in mind that though a rapid response may be important, safe arrival is
necessary in order for them to be of assistance.
D. Dash-cam video systems that activate during emergency driving should not be
deactivated until after arrival at the stop/call necessitating the response or after the
officers has ceased their response.
E. Officers engaged in non-pursuit, emergency driving will continually evaluate the need to
engage in emergency driving and the manner in which it is conducted against the risk of
injury to any innocent person or damage to property.

Code 1 Unless otherwise authorized by this chapter, all officers of the Department will operate
their vehicles in a Code 1 mode. code i is driving in compliance with all traffic laws.
Funeral escorts are considered emergency driving with the following exceptions. The initial
officer in the escort shall use all emergency warning devices to clear intersections. Follow-on
officers may use lights only. However, the speed and driving of follow-on officers shall not
exceed their ability to maintain due regard for all other traffic present.
Officers conducting traffic enforcement shall follow all emergency driving policies. If it is
necessary to exceed speeds pursuant to Code 2 driving to catch a violator, officers will use all
emergency warning devices.
Emergency equipment while conducting traffic enforcement is not mandated if the officer
pursuing a suspected violator of the law has probable cause to believe that knowledge of the
presence of the officer will cause the suspect to:
A. Destroy or lose evidence of a suspected felony;
B. End a suspected continuing felony before the officer has obtained sufficient evidence
to establish grounds for and arrest; or
C. Evade apprehension or identification of the suspects vehicle.
Emergency Driving (Pursuit) (TBP 7.13, 7.14, 7.15, 7.18)
Definition: A motor vehicle pursuit is an attempt by a law enforcement officer operating an
authorized emergency vehicle, utilizing emergency equipment, emergency lights and siren, to
apprehend occupant(s) of another motor vehicle, when the driver of the fleeing vehicle is aware
or should reasonably be aware of that attempt, and is resisting apprehension by maintaining or
increasing the speed of his/her vehicle, disobeying traffic laws, ignoring the officer or
attempting to elude the officer.
An officer may only engage in pursuit to affect an arrest when:

4. The nature of the offense for which the fleeing vehicle is being pursued.
D. The back-up unit upon becoming actively involved in the pursuit will:
1. Activate the emergency lights and siren;
2. Immediately notify communications;
3. Follow the primary unit and maintain sufficient distance between their unit and the
primary unit to ensure safe operation of both vehicles and
4. Take over radio communications being allowed to turn their siren off when necessary
to successfully communicate over the radio.
B Other units will be support units and may:

When Communications receives notification of a pursuit is in progress, the operator will:
A. Immediately ensure a Patrol supervisor is aware of the pursuit;
B. Clear the primary channel of all traffic not specifically related to the pursuit;
C. Begin all available intelligence checks using the information supplied by the primary unit;
0. Report the results of the intelligence checks as soon as possible to the involved units
when radio traffic and a consideration for the safety of the involved units make it
feasible to do so; and
E. Record all incoming information concerning suspect and suspect vehicle descriptions,
direction of travel of the pursuit and all times when information is received. It is not
necessary or recommended to broadcast all times. Times of major events of the pursuit
and other occasional time references are all that are necessary to be broadcast.

If the pursuit leaves the jurisdiction of the Department:

C. If the agency with jurisdiction joins the pursuit, the Department will remain as the

Stop Stick Deployment (TBP 7.19)
Deployment of Stop Sticks may be utilized to attempt to safely terminate pursuits authorized
under this policy.
The goal of deployment is to quickly and safely end pursuits with minimal property damage
and/or injury to any party. The safety of citizens and officers is of the utmost concern.

After successful deployment of the Stop Sticks and the termination of the pursuit, the officer will
take the utilized sections of the Stop Sucks out of their black sleeves and replace with new
section. The used section(s) will be forwarded to the Pursuit Review Board chairman so he may
complete the necessary report to the Stop Stick company for replacement of the used sections.
Used sections, after removing the information sticker, may be sent to the Training Division for
use in future training. Spare Stop Suck sections will be available through a Patrol supervisor.
A Use of Force form will be filled out and forwarded to the Pursuit Review Board chairman.
Officer(s) deploying stop sticks, whether successful or not, may appear before the Pursuit
Review Board for that pursuit.

Definition
An officer involved shooting is defined as a discharge of a weapon by an officer that results in
injury to any person. A shooting that does not result in injury to any person or damage to
property shall still be thoroughly investigated.
It is the policy of this department that officer-involved shootings, whether on or off-duty, be
investigated so as to determine whether officer actions conform to law and this Depar&nents
policies, procedures, rules, and training.
Notifications
Fire and EMS should be notified and requested to provide life-saving measures as appropriate.
Additionally, the ranking supervisor or non-involved officer will notify the Departments chain of
command to include the Chief of Police or his/her designee of any officer involved shooting.
Officer(s) Responsibilities
A. Scene security should be a priority. All officers should ensure the scene is secure;
including handcuffing the suspect responsible for the officer involved shooting (OIS).
Responding officers should clearly establish from the involved officer(s) whether
additional suspects are involved, and thereafter communicate any suspect descriptions
and locations.
B. Once scene security is established, officers should provide medical attention to all
injured persons until Fire/EMS arrives.
C. If one is not present, officers should request a supervisor respond to the scene.
D. If suspects are located, they should be secured and separated.
E. The involved officer should be removed from the immediacy of the incident scene, but
not removed to a separate location.
F. Officers should secure the incident scene by marking it in accordance with evidence
procedures. Officers shall protect evidence from loss, destruction or damage.
6. Unless safety issues warrant, officers shall not remove or alter any weapons used by
either involved officer(s) or suspects. Do not open, reload, unload, or remove shell
casings.
H. Officers shall not relay information to media.

E. A supervisor shall secure all officer-involved weapons and magazines. A supervisor
shall maintain custody of the officers weapon until it is turned over to investigative
personnel. These weapons should remain in the condition that they were discovered
by the supervisor

responding officer(s). Weapon attachments should remain
attached, pursuant to how the weapon was discovered. Weapons used by assailants
should remain in place and handled by follow-up investigators in accordance with
evidentiary best practices.
F. A supervisor/Range Master shall issue the involved officer another duty firearm and
magazines to replace any seized weapon.
C. All seized weapons will be processed as evidence and will not be taken to the Range
and fired to ensure functionality.
H. A supervisor will ensure the companion officer(s) accompanies the involved officer(s) to
the law enforcement center.
I. A supervisor will remain on scene until investigative personnel arrive.
Administration Responsibilities
A. Administration shall respond to an 015.
B. Administration shall make contact with the involved officer(s), either at the scene or the
Law Enforcement Center.
C. Administration will interview on-scene officers and supervisors (those not involved in
the actual officer involved shooting) to ensure Administration has firm knowledge of the
incident.
D. Administration will manage all media inquiries. Involved officers names will not be
released pending investigation.
E. Administration will place the involved officer(s) on paid administrative leave pending
investigation.
F. Administration will ensure a criminal investigation is conducted.
C. Administration will ensure an internal investigation is conducted, either concurrent to
the criminal investigation or following the criminal investigation.
H. Administration will ensure the involved officer(s) does not provide a written statement
to investigators for a minimum of 48 hours post-incident.

Major Crimes
A supervisor will be notified of any calls which are not of a routine nature and any other
reported occurrences or situations which by their nature are unique or unusual.
Responding Officers Responsibilities
I
Duties (TBP &01)
During a hostage or barricaded situation, officers shall respond promptly and locate, isolate and
contain the suspect. Officers should secure the area to prevent the escape of a suspect or
entry/exit of any other persons.
Officers should obtain all available information pertaining to the situation. Officers should
determine the nature of the incident and notify an on-duty supervisor of the situation.
Notifications
The ranking on duty supervisor or their subordinate supervisor will notify the Assistant Chief of
Police or, in their absence, the Chief of Police of any critical situations or unusual events
involving the Department. Examples of unusual or critical situations are:
A. Officer involved shootings;
B. Serious employee injuries or accidents;
C. Hostage situations;
D. Snipers or

When a sniper, barricaded subject or hostage situation is confirmed, the Patrol shift commander

Outside Agency Support
The Taylor County Sheriffs Office and the local Department of Public Safety shall be notified, by
Dispatch, of a tactical situation in progress.
Tactical Debrief
After a situation has been resolved, the Tactical Unit commander will be responsible for
conducting a debriefing session as soon as practical. The Tactical commander will determine
who will attend the debriefing.
Active Shooter
An active shooter is defined as one or more subjects who participate in a random or systematic
homicidal spree by demonstrating their intent to continuously harm others. The subjects
overriding objective appears to be mass murder rather than other criminal conduct such as
robbery or kidnapping.
It is the policy of the Department to respond, contain, and neutralize the threats and administer
aid to the victims.
Notifications
The ranking supervisor or officer will notify the chain of command to include the Chief of Police
or his designee of any active shooter event. Fire and EMS should be notified and requested to
standby in accordance with their protocols.
Mutual Aid
Upon arriving to the scene of an active shooter event and assessing the crime scene, the
agency should implement their mutual aid agreements with other police agencies, and firef
rescue agencies. Additionally, it may be necessary after the incident to collaborate with
recovery agencies to assist with the scene and any victims.

action. The first officers entering the structure should recognize that their primary objective is
to stop further violence. Officers should identify and communicate locations of victims needing
medical attention. If practical, and absent continued shooting, officers should treat any

Uniform Citations (7.28)
The issuance of traffic citations is a valid and necessary part of law enforcement. In order to
gain voluntary compliance with traffic laws and present a consistent method of violator contact,
officers are encouraged to use the following steps in issuing traffic citations:
A. Greet the violator and identify yourself;
5. Provide the driver with the reason for the traffic stop and explanation of the offense;
C. Identify the driver and evaluate the conditions of both the driver and the vehicle;
D. If a citation is to be issued, advise the violator that one will be issued;
E. Issue the citation;
F. Explain exactly what the violator is required to do regarding the citation and appearance
dates for Municipal Court and
c. close the contact with the violator.
Violators should be given the opportunity to sign a citation if:
A. The violator has valid acceptable identification.
B. A valid local address is given.
A violator should not generally be arrested just because he refuses to sign a citation. A
supervisor should first approve such an arrest.
When any citation is issued while Municipal Court is in session and the officer chooses to require
the offender to post bond, the offender should be escorted to Municipal court first.
Citation Security and Accountability (7.22)
The court administrator shall serve as the manager of the citation tracking system. The court
administrator is responsible for issuing, accounting and storing of citation books. The court
administrator is responsible for the maintenance of the program which will be used to track the
status of every citation.
Patrol officers are responsible for the care, control and proper legal completion of all citations.
Supervisors are responsible for ensuring compliance with departmental policy by inspecting
citations for legibility, completeness and legality. Citations shall be issued from Municipal Court.
