I. DESCRIPTION OF THE PETITIONER NO. 1:

The description of the petitioner No. 1 and the address for the
purpose of service of all process, notices etc., is the same as above mentioned in
the cause title.

II. DESCRIPTION OF THE PETITIONER NO. 2:

The description of the petitioner No. 2 and the address for the
purpose of service of all process, notices etc., is the same as above mentioned in
the cause title.

III. THE PETITIONERS HEREIN HUMBLY BEGS TO SUBMIT AS UNDER:


1. That the Petitioner No.2 is the legally wedded wife of Petitioner No.1 and their

marriage was performed on 14-08-2005 as per Hindu rites and customs at Medak

Town. That after the marriage the petitioners led happy marital life at Nizamabad

and out of their wedlock they were blessed male child on 12-07-2006 and he was

named as Budde Anurag who is under the care and custody of Petitioner No.2 .

That after the birth child the disputes arose between the Petitioners and since

then the petitioner no.2 is staying with her parents at Medak Town along with the

child. The Petitioner no.1 filed O.P. No 308 of 2010 before the Honble District

Judge Nizamabad for the custody of minor son Anurag against the Petitioner No.2

and subsequently the Petitioner No.1 withdrawn the said case.

2. It is submitted that the Petitioner No.2 filed Criminal Complaint before the Medak

police against the Petitioner No.1 and his parents family members and Police

Medak Town registered a case in Crime No. 87 of 2010 under section 498-A of IPC

and 3, 4 of DP Act. That after enquiry the police filed charge sheet against

Petitioner No.1 and others. The said charge sheet was numbered as CC No. 106 of

2010 on the file of Judicial First Class Magistrate, Medak Town and in which the

Petitioner No.1 was convicted and sentenced to undergo simple imprisonment for

a period of six months and to pay fine Rs.1000/- for the offence under section

498-A of IPC and the remaining family members of the Petitioner No.1 were

acquitted. The Petitioner No.1 preferred tha appeal against the conviction and

sentence paased Judicail First Class Magistrate Medak the same is numbered

before the VII Addl. Dist.Judge Medak vide Criminal Appeal No. 97 of 2014 which

is still pending.

3. The Petitioner No.2 filed MC 11 of 2010 before Judicial First Class Magistrate

Medak against the Petitioner No.1 claimimg maintenance for herself and her

minor son in which the Honble Judicial First Class Magistrate directed the

Petitioner no.1 and pay Rs.3000/- to the second Petitioner and another Rs.3000/-

per month to the minor son. The 2 nd Petitioner also filed DVC No.13 of 2010 on

the file of Judicial First Class Magistrate claiming maintenance herself and her

minor son in which the Judicial First Class Magistrate directed to pay the monthly

maintenance of Rs.10,000/- towards petitioner No.2 and her minor son and also
awarded a sum of Rs.5,00,000/- as compensation against which the Petitioner

No.1 preferred the appeal before the Honble VIII Addl. Dist. Judge vide DVC

appeal No.102 of 2014 which is also pending.

4. It is submitted that the Petitioner No.2 is residing in Medak Town along with her

parents since October, 2009, since then the petitioner No.1 and Petitioner No.2

are staying separately and there is no cohabitation in between them, but number

of times the elders of the family members of both sides tried to reunion them but

they could not succeed in reunion of the Petitioners. That at last the instance of

family members and well wishers decided to settle the issues in between the

petitioners. And the petitioners 1 and 2 agreed to entered into the compromise to

settle the matters under court of law including in obtaining divorce in between

them. The Petitioners hereby agrees to take mutual divorce under section 13-B of

Hindu Marriage Act. The Petitioners also entered into Memorandum of

Understanding. As per the MOU the Petitioner No.1 agreed to pay a lumpsum

amount of Rs.25,00,000/- to the second petitioner towards all her claims of

maintaining permanent alimony for herself and her minor son Budde Anurag.

5. It is submitted that the first petitioner obtained a Demand Draft from the bank for

a sum of Rs.5,00,000/- vide DD no dated drawn on

Bank, Hyderabad in the name of the 2 nd Petitioner and the same is handed over

to the 2nd Petitioner today as agreed by the first petitioner in Memorandum of

Understanding and the remaining Rs.20,00,000/- is agreed to be paid on the date

of dissolution of marriage by this Honourable Court by dissolving the marriage in

between the Petitioner No.1 and Petitioner No.2. The Second petitioner also

agreed to deposit a sum of Rs. 15,00,000/- out of Rs.25,00,000/- in the name of

her minor son Anurag till he attains majority. The Petitioner No.1 agreed to

withdraw the MC 11 of 2010 and DVC 97 of 2014 on the file of Judicial First Class

Magistrate, Medak in view of entering into MOU in between the petitioners.

Cause of Action

The Marriage of the Petitioners took place on 14 th August 2005 at Medak Town,

Mandal & District and since October, 2009 the Petitioners are staying separately

till today as such cause of action arose for filing the petition.
Jurisdiction

The Petitioner No.2 is residing at Medak Town & Mandal & Dist., and the marriage

of the petitioners took place at Medak town which is within the Jurisdiction of this

Honourable Court Hence this Court has got jurisdiction to try the case.

Court Fee

That a fixed court fee of Rs.10/- is paid which is proper and sufficient.

Therefore, it is prayed that the Honourable Court may be pleased to decree by

dissolving the marriage of the Petitioner 1 and 2 dated 14-08-2005 in the interest

of justice and equity.

I, Budde Pramod, S/o Sri Budde Ashok, Aged about 37 years, Occ: Business, R/o Flat
No.404, KCP Apartment,Khaleelvadi, Nizamabad Town& District., do hereby solemnly
affirm and state as follows:

That I am the deponent herein and Petitioner No.1 in the Above OP as such I am well
acquainted with the facts of the case.

Therefore I may be permitted to assist by my legal counsel G.Hanmantha


Reddy, Advocate to conduct the above-mentioned Original Petition before this
Honble Court. That myself and Petitioner no.2 have filed the above case seeking to
dissolve the marriage in between me and Petitioner No.2 dated 14-08-2005. The
averments of the above OP may be read as part and parcel of the affidavit.

1. That the Petitioner no.2 is my legally wedded wife and our marriage was
performed on 14-08-200 ae per Hindu rites and customs at Medak town. That after
the marriage myself ans Petitioner No.2 led happy marital life at Nizamabad and
out of the wedlock we were blessed male child on 12-07-2006 named as Budde
Anurag who is under the care and custody of Petitioner No.2. That after the birth
of the child the disputes arose between me and Petitioner No.2 and since then the
Petitioner No.2 is staying with her parents at Medak Town along with child. That I
filed Op.No.308 of 2010 before the Honourable District Judge Nizamabad for the
custody of minor son Anurag. And subsequently I have withdrawn the said case.

2. It is submitted that the Petitioner No.2 filed Criminal Complaint before the Medak
police against the me and my parents and family members. The Police Medak
Town registered a case in Crime No. 87 of 2010 under section 498-A of IPC and 3,
4 of DP Act. That after enquiry the police filed charge sheet against me and
others. The said charge sheet was numbered as CC No. 106 of 2010 on the file of
Judicial First Class Magistrate, Medak Town and in which the I was convicted and
sentenced to undergo simple imprisonment for a period of six months and to pay
fine Rs.1000/- for the offence under section 498-A of IPC and the remaining family
members of the mine were acquitted. I preferred the appeal against the conviction
and sentence paased Judicail First Class Magistrate Medak the same is numbered
before the VII Addl. Dist.Judge Medak vide Criminal Appeal No. 97 of 2014 which is
still pending.

3. It is submitted that The Petitioner No.2 filed MC 11 of 2010 before Judicial First
Class Magistrate Medak against the me claiming maintenance for herself and her
minor son in which the Honble Judicial First Class Magistrate directed the me to
pay Rs.3000/- to the second Petitioner and another Rs.3000/- per month to the
minor son. The 2nd Petitioner also filed DVC No.13 of 2010 on the file of Judicial
First Class Magistrate claiming maintenance herself and her minor son in which
the Judicial First Class Magistrate directed to pay the monthly maintenance of
Rs.10,000/- towards petitioner No.2 and her minor son and also awarded a sum of
Rs.5,00,000/- as compensation against which the I preferred the appeal before the
Honble VIII Addl. Dist. Judge vide DVC appeal No.102 of 2014 which is also
pending.

claims of maintaining permanent alimony for herself and her minor son Budde
Anurag.

5. It is submitted that I obtained a Demand Draft from the bank for a sum of
Rs.5,00,000/- vide DD no dated drawn on Bank,
Hyderabad in the name of the 2nd Petitioner and the same is handed over to the
2nd Petitioner today as agreed by me in Memorandum of Understanding and the
remaining Rs.20,00,000/- is agreed to be paid on the date of dissolution of
marriage by this Honourable Court by dissolving the marriage in between me and
Petitioner No.2. The Second petitioner also agreed to deposit a sum of Rs.
15,00,000/- out of Rs.25,00,000/- in the name of her minor son Anurag till he
attains majority. That I agreed to withdraw the MC 11 of 2010 and DVC 97 of 2014
on the file of Judicial First Class Magistrate, Medak in view of entering into MOU in
between myself and Petitioner No.2.
