ORDER:

In the references read above Government have introduced e-


procurement as a part of ongoing reforms to achieve simplification,
efficiency and transparency in tender process.

2. Government from time to time have been initiating several reforms


in tendering process for public works with a view to bring simplification of
procedure, greater transparency and healthy competition to procurement
methods.

3. It has come to the notice of the Government that the reforms


proposed in G.O. reference 5th read above, with regards to submission of
hard copies to the tender inviting authority before the price bid opening
has not addressed the problem in totality. Since the bidder when
obstructed by other bidders in submitting hard copies of uploaded
documents EMD/DD/BG before opening of Price bid, he is not only
disqualified for the tender but also his user ID is blocked for 12 months.

4. The IT&C Department have suggested that since the tender is


submitted with Digital Certificate authentication, Department may do away
with submission of Hard Copies of Uploaded documents by participating
bidders before opening the price bid.

5. The Sub-Committee for standardization of work procurement


Constituted in G.O.4th read above in its meeting held on 1.10.2007 has
recommended the following modifications:-
i) Submission of original Hard Copies of the uploaded scan
copies of DD/BG towards EMD by participating bidders to the
tender Inviting authority before opening of the price bid be
dispensed forthwith.
ii) All the bidders shall invariably upload the scanned copies of
DD/BG in e- Procurement system and this will be the primary
requirement to consider the bid as responsive.
iii) The Department shall carry out the technical bid evaluation
solely based on the uploaded certificates/documents, DD/BG
towards EMD in the e-procurement system and open the price
bids of the responsive bidders.

iv) The Department will notify the successful bidder for


submission of original hard copies of all uploaded documents,
DD/BG towards EMD prior to entering into agreement.
v) The successful bidder shall invariably furnish the original
DD/BG towards EMD, certificates/documents of the uploaded
scanned copies to the Tender Inviting Authority before
entering into agreement either personally or through courier or
post and the receipt of the same with in the stipulated

date shall be the responsibility of the successful bidder. The


Department will
not take any responsibility for any delay in receipt/non-receipt
of original DD/BG towards EMD, certificates/documents, from
the successful bidder before the stipulated time. On receipt of
documents, the Department shall ensure the genuinity of the
DD/BG towards EMD and all other certificates / documents
uploaded by the bidder in e-Procurement system in support of
the qualification criteria before concluding the agreement.

vi) If any successful bidder fails to submit the original Hard


Copies of uploaded certificates/Documents, DD/BG towards
EMD with in the stipulated time or if any variation is noticed
between the uploaded documents and the hard copies
submitted by the bidder, the successful bidder will be
suspended from participating in the tenders on e-Procurement
platform for a period of 3 years. The e-Procurement system
would deactivate the user ID of such defaulting successful
bidder based on the trigger/recommendation by the Tender
Inviting Authority in the system. Besides this, the Department
shall invoke all Processes of law including criminal prosecution
of such defaulting bidder as an act of extreme deterrence to
avoid delays in the tender process for execution of the
development schemes taken up by the Government. The
information to this extent may be displayed in the e-
procurement platform website.

vii) Electronic payment of EMD in e- Procurement system as


Proposed by the IT&C Dept and Commissionerate of Tenders
shall be made mandatory in due course. Separate orders will
be issued in this regard.

6. The Government after careful consideration hereby order for


implementation of the modifications indicated at paras-5(i) to (vi) above
with immediate effect.

7. This order issues with the concurrence of Finance (W&P) Dept. vide
their U.O. No. 622/F8(A1)/08, dt. 19.2.2008.
