Criminal Case No. 3000 for Adultery

Dear Madam:

We are writing to you in behalf of our client, NAME, the private complainant in the
above-entitled case, and filed before the Municipal Trial Court of Miag-ao, Iloilo.

Inasmuch as Section 51 of Rule 110 of the 2000 Rules on Criminal Procedure2


mandates that all criminal actions commenced by a complaint or information shall be
prosecuted under the direction and control of the prosecutor, the same rule authorizes
the private prosecutor to prosecute the case, subject to the approval of the court.

In this regard, we humbly request your Honorable Office, if you deem it fit and proper, to
authorize in writing the undersigned counsel to prosecute the case up to its end, even in
the absence of the public prosecutor pursuant to Section 5, Rule 110 of the 2000 Rules
on Criminal Procedure.
