Attorneys Engagement Contract

This engagement contract establishes an agreement between a first and second party for legal representation. ENGAGEMENT CONTRACT

KNOW ALL MEN BY THESE PRESENTS:

This contract is executed and entered into this ___________________________, Cebu City,
Philippines, by and between:

________________________________________________, of legal age, Filipino, residing in


________________________________, hereinafter referred to as the “FIRST PARTY”.

Philippines, hereinafter referred to as the “SECOND PARTY”.

WITNESSETH:

That the First Party has a pending labor case docketed as

That the Second Party is hereby engaged by the First Party to represent him/her in the aforesaid
case and that it is hereby understood that upon the plea of the First Party for reasons of financial hardship,
the Second party agrees to accept the case on contingent basis and shoulder the expenses in the
prosecution of the aforesaid cases in view of the First Party’s financial constraints;

That for and in consideration of the foregoing services the Second Party shall perform in favor of
the First Party, the latter hereby agrees to give to the Second Party contingent attorney’s fees at the rate of:

30% if in the arbitral stage of the proceeding (NLRC – RAB VII);

40% if in the appellate stage of the proceeding (NLRC – Seventh Divison);

50% if case reaches the Court of Appeals and up to the execution stage of the case,

of his/her monetary award that maybe recovered in a settlement or execution proceedings by way of
contingent attorney’s fees and litigation expenses.

That the First Party cannot withdraw or settle their complaints without the express consent of the
Second Party pursuant to the Special Power of Attorney executed by herein parties.
