AFFIDAVIT OF UNDERTAKING
I, MICHAEL N. VARUA, Filipino, of legal age, single, with
residence and postal address at Arsenal Gate, Lamao, Limay, Bataan,
after having been duly sworn to in accordance with law, hereby depose
and say that:

I am the registered driver of a motor vehicle owned by my father


NEIL M. VARUA, which is more particularly described as follows:

MAKE/MODEL : RUSI 125


PLATE NO. : 4604

The aforesaid motorcycle was involved in a self-accident on


October 27, 2019 at National Road, Arsenal, Lamao, Limay, Bataan;

The aforesaid motorcycle was put on the custody by the PNP


Limay, Bataan, after the incident up to the present;

In view of the fact that during the hearing on the presentation of


the lone witness for the Prosecution, PO1 Richie G. Valdez, the
prosecution did not mark, present and offer in evidence the aforesaid
motorcycle. Hence, there is no longer a need to maintain custody over
the said motorcycle by the police officers since the cases are now
submitted for decision. The continued impounding of the said
motorcycle has deprived the undersigned and my family for our personal
use and enjoyment thereof. Moreover, the continued impounding of the
said motorcycle may cause its further deterioration beyond repair;

I hereby undertake that in case the aforesaid YAMAHA Mio Sporty


single motorcycle is needed by the Regional Trial Court, Branch 74,
Olongapo City for further investigation or any other legal undertaking
relevant to the above criminal cases, I will return the same for the
aforesaid purpose;

I am declaring herein that the above information given by me in


this affidavit are true and correct to the best of my personal knowledge
and belief, and I am fully aware that any false statement and information
given by me will make me liable under the provisions of applicable law;
and

As such, I am executing this affidavit to attest to the truth of the


foregoing and for whatever legal purpose or purposes that this may serve.
