Who May Avail of Service

• Owners (natural or juridical person) of private agricultural lands or other persons duly
authorized by the landowner.
• Beneficiaries of the agrarian reform program after the lapse of five (5) years from
award, reckoned from the date of the issuance of the Certificate of Land Ownership
Award (CLOA), and who have fully paid their obligations and are qualified under the
rules, or persons duly authorized by them.
• Government agencies, including government - owned and controlled corporation, and
LGUs, which own agricultural lands as their patrimonial property.

List of Documentary Requirements for Land Use Conversion

• Official receipt showing proof of payment of filing fee and inspection cost.

• Official receipt showing proof of posting of bond or an original copy of the GSIS surety.

• Sworn Application for Land Use Conversion. (Form No. 1)

• True copy of the Original Certificate of Title (OCT) or Transfer Certificate of Title (TCT) of the
subject land
• True copy of the current Tax Declaration covering the subject property.

• Project feasibility study.

• Joint venture agreement or any other business arrangement on the use of the land.

• Narrative description of the development plan

• Proof of financial and organizational capability of the developer to develop land.

Process of Land Conversion

• Official receipt showing proof of payment of filing fee and inspection cost.

• Official receipt showing proof of posting of bond or an original copy of the GSIS surety.

• Sworn Application for Land Use Conversion. (Form No. 1)

• True copy of the Original Certificate of Title (OCT) or Transfer Certificate of Title (TCT) of the
subject land. In case of untitled land, the following shall be required in lieu of a title:

– Certification from the Department of Environment and Natural Resources-Community


Environment and Natural Resources Officer ((DENR-CENRO) that the landholding has
been classified as alienable and disposable; and

– Certification from the DENR-CENRO (for administrative confirmation of imperfect title)


or the Clerk of Court (for judicial confirmation of imperfect title) that the titling
process/proceeding has commenced and there are no adverse claimants.

• True copy of the Certificate of Title of the subject land as of 15 June 1988, i. and all successor
Titles until the present Title referred to in No. 4 hereof, ii. if applicable.

• True copy of the current Tax Declaration covering the subject property.

• Project feasibility study.

• Joint venture agreement or any other business arrangement on the use of the land.

• Narrative description of the development plan describing in detail the activities, program
components, phasing, schedule, work and financial plan, all duly certified by a licensed engineer,
architect, or land use planner.

• Proof of financial and organizational capability of the developer to develop land.

• Socio-Economic Benefit-Cost Study of the proposed project.

• Photographs, size 5R (five [5] inches by seven [7] inches), using color film, and taken on the
landholding under sunlight.

• Affidavit of Undertaking of the applicant.(LUC Form No. 2).


• MARO Certification (LUC Form No. 3) and Notice of Land Use Conversion in English language
(LUC Form No. 4) and in local dialect (LUC Form No. 4A).

• Certification from the Housing and Land Use Regulatory Board (HLURB) Regional Officer.

• Certification from the authorized Department of Agriculture (DA) official.

• Certification from the authorized DENR official.

• Environmental Compliance Certificate (ECC) when the subject land is within an ECA or will
involve the establishment of an ECP.

• If applicable, Special Power of Attorney (SPA), when the applicant is not the registered owner.

• If applicable, notarized secretary's certificate of a corporate/cooperative board resolution


authorizing the representative, when the applicant is a corporation or cooperative.

• If applicable, concurrence letter of the mortgagee or of the individual or entity in whose favor
the encumbrance was constituted, when the property is encumbered.

• If applicable, endorsement from the concerned government agency, when the application
involves a priority development area or project, such as: a. NEDA-NLUC endorsement if under
EO 124-1993; or b. HLURB endorsement if socialized housing (LUC Form No. 7); or c. PEZA Board
Resolution approving the project for ecozone project

• If applicable, Land Bank of the Philippines (LBP) Certification.

• If applicable, Provincial Agrarian Reform Officer (PARO) Certification. 25. Vicinity map and a lot
plan.

• Directional sketch map.

• Map of the development plan.

• Topographic Map.

How To Avail Service

• Get Application Form from PARO/RCLUPPI Secretariat

• Erect billboard, take photos of billboard, land and structures of the land

• Submit two (2) Land Use Conversion folders to MARO containing Forms # 1, 3 and 4, titles,
sketch map and billboard photos

• . Check CARP Coverage, status of land, inspect billboard, check presence of farmers, post notices
in conspicuous places, prepare MARO Certification to applicant. If MARO refuses to act, PARO
shall take over and transmit 1 folder to PARO
• File 4 sets of LUCFs plus MARO certification at RCLUPPI. RCLUPPI checks Application folders’
completeness using LUC Form A, if complete, issues assessment of fees and advises applicant to
pay fees, if not complete, return the application folder to the applicant and require to submit
the lacking requirement

• Pay filing fee, inspection fee and posts bond

• Issue official receipt

• Indicate in the billboard the schedule of the ocular inspection date and inform the RCLUPPI
team that such requirement is complied

• Officially submit the documents with the official receipt for document tracking to Records Unit

• Assign record number and forward to the office of the Regional Director

• Route documents to the RCLUPPI Chairperson

• Schedule Ocular Inspection (OCI) with the Secretariat and send notices to RCLUPPI members,
PARO, MARO, other concerned parties and conduct OCI

• Deliberate resolution from filing date and submit recommendation to the approving authority.

• Prepare draft Order

• Sign Draft Order

• Forward draft Order to the Office of RD for Approval/ Denial

• Review, evaluate and sign Order

• Assign ORD Document control number and affix official dry seal

• Send to all concerned Copies of Order together with the Clientele Feedback Form.

• Send back Clientele Feedback Form to the Regional Office.

Land Reclassification

• The Issuance of Certificate for Land Use Reclassification is a pre-requisite in the processing and
issuance   of Land Use Conversion Certificate by the Department of Agrarian Reform.

• The following landholdings are covered by the land use reclassification:

• agricultural areas to be converted to residential, commercial, industrial, institutional and other


non-agricultural purposes;

• areas devoted to agricultural activities such as livestock, poultry, and fishpond, the effect of
which is to exempt the land from CARP coverage;

• areas converted to non-agricultural uses other than that previously authorized; and
• those reclassified to residential, commercial, industrial, or other non-agricultural uses on or
after the effectivity of RA 6657 on June 15, 1988. For those reclassified prior to June 15, 1988,
the guidelines of securing exemption clearance shall apply.

• Owners of private agricultural lands or other persons duly authorized by the landowner;

• Government agencies, including government-owned or controlled corporations, and local


government units, which own agricultural land as their patrimonial property.

Who May Avail of Service

Requirements

• Letter of application for land use reclassification to DA Regional Executive Director (RED);

• Sworn declaration for land use reclassification (DA LUR Form 1, available at the RTeCLUM
Secretariat c/o Planning Division);

• Proof of ownership - Photocopy of Original Certificate of Title (OCT) or Transfer of Certificate of


Title (TCT) certified by the Register of Deeds not later than 30 days prior to filing;

• Special Power of Attorney, if the petitioner is other than the landowner or Board Resolution
signed by members if the owner is a corporation;

• Sketch map, Vicinity map and Lot plan showing TCT No., Lot No., Area per TCT, and area applied
for conversion, duly prepared by a licensed geodetic engineer and showing reference points for
the identification of the property applied for conversion;

• Certification from the Local Government Unit whether or not the locality where the land is
located has become highly urbanized and will have greater economic value for commercial,
industrial or residential purposes;

• Recent 5R panoramic photograph of the area with captions (to be certified by a member of the
RTeCLUM upon ocular inspection);

• Certification from National irrigation Administration (NIA) Provincial Office using LUC Form No. 4
whether or not the land is within the service of an irrigation system that is existing; scheduled
for rehabilitation; or with firm funding commitment (signed by Regional Irrigation Manager if
area is more than 5 hectares);
• Certification from the Sugar Regulatory Administration (SRA);

• Certification from the Philippine Coconut Authority (PCA) signed by Regional Manager;

• Certification from Fiber Industry Development Authority (FIDA);

• Certification from the Bureau of Fisheries and Aquatic Resources (BFAR); and

• Zoning certification from Housing and Land Use Regulatory Board (HLURB) Regional
Officer/Deputized Zoning Administrator identifying the specific land use of the subject land.
