HEALTH AND SAFETY CONTRACT BETWEEN EMPLOYER


AND MANDATORY (CONTRACTOR)

SECTION 37(2) OF THE OHS ACT, ACT 85 OF 1993

The employer and mandatory have agreed in writing to the


arrangements and procedures between them to ensure
compliance by the mandatory with the provisions of this
act.

1. PURPOSE

1.1 This contract is an addition to any other works contract between Sun City
and the Contractor and is compulsory for all contract companies who

intend working at Sun City, for Sun City or any other organisation at
Sun City

This includes work such as:

- Building and construction work


- Electrical repair or installation work
- Plumbing
- Painting
- Installations
- Servicing of machinery
- All repair and maintenance work
- All types of venue/event and exhibition setups

1.2 All required documentation must be completed before any work or


projects will be permitted to start

1.3 Companies that are used on a regular basis or that have ongoing contracts
with Sun City can have a safety agreement validated for a period of 12
months, renewable on an annual basis. This agreement could be
terminated should the company not comply with the minimum safety
standards or the provisions of the Occupational Health and Safety Act,
Act 85 of 1993

1.4 Any person or company found working without the required


documentation would be removed from the site until all requirements
are adhered to. Should any person be found working with equipment
that does not comply with the required standard, this equipment will
be confiscated and handed in at the Complex Maintenance department.

1.5 Any department or person who allows a person or contractor to do


unauthorised work will face disciplinary action.

1.6 It is of utmost importance that all parties involved comply with this
procedure to ensure a safe and hazard free working environment for all
guests, contract agencies and staff.

1.7 Every employer and mandatory (contractors, subcontractors, service


providers, exhibitors and self employed persons) will take steps to
eliminate or mitigate any hazard or potential hazard which may affect
the Health & Safety of any employee in connection with the production,
processing, use, handle, storage or transportation of articles of any
substances

2. DEFINITIONS

2.1 MANDATORY

Includes any agent, contractor, subcontractor or service provider for work

2.2 EMPLOYER

Any person who employs or provides work for any person and remunerates
that person

2.3 HAZARD

A source of or exposure to danger

2.4 DANGER

Anything which may cause injury or damage to persons or property

2.5 RISK ASSESSMENT

A program to determine any risk associated with any hazard at a work site, in
order to identify the steps needed to be taken to remove, reduce or control
such hazard

2.6 SCOPE OF WORK

Type of work/activity to be performed as per contract or tender

3. DOCUMENTS TO BE INCLUDED IN THE REQUIRED SAFETY FILE


BY THE MANDATORY

3.1 Scope of Work

3.2 OCCUPATIONAL HEALTH & SAFETY POLICY AND PLAN


A written policy concerning the protection of the health and safety of
his/her employees at work. It includes a brief description of the
organisation and the arrangement for carrying out and reviewing that
policy

3.3 SUPERVISOR APPOINTMENT (SECTION 8.2 OHS Act)


A written appointment of a supervisor to oversee all work done on site (see
attached)

3.4 GENERAL SAFETY REGULATION 3.4


Written appointment for providing First Aid on site, during build-up or
breakdown (see attached)

3.5 GENERAL SAFETY REGULATION 13.A


Written appointment for a ladder inspector, inclusive of a register listing all
ladders in use on site (see attached)

3.6 CONSTRUCTION REGULATION 7


Proof that on site Risk Assessment was conducted by a competent person
for the specific task performed according to their scope of work

3.7 GENERAL MACHINERY REGULATION 2.1


Written appointment of a competent person to supervise and inspect the
machinery being used (Full time employee) (See attached)

3.8 ACTS OR OMISSION BY EMPLOYEES (SECTION 37.2)

Mandatory agreement between (in this case) the organiser and contractor
to ensure compliance of the Occupational Health & Safety Act in terms of
Section 37.2

3.9 DRIVEN MACHINERY REGULATIONS


Written appointment of competent and suitable person/s operating high
powered machinery (sanding machines, grinders, circular saws, etc.) (See
attached)

3.10 ALL TECHNICAL DRAWINGS AND FLOOR PLANS

3.11 FALL PROTECTION PLAN


Required when contractors working on heights or using scaffolding
measuring 1.5meters or more (i.e. Risk Assessment for working within
high rise areas)

3.12 SAFETY REPRESENTATIVE APPOINTMENT (SECTION 17 OHS ACT)


For more than 20 employees (see attached)

3.13 ELECTRICAL INSTALLATION PLAN/CERTIFICATES (COC’S)


Submission of such plans must take place after the job is complete

3.14 ALL STRUCTURAL ENGINEER’S CERTIFICATES


(Only required for stand over 3 meters) Submission of such plans must
take place after the stand building is complete

3.15 LETTER OF GOOD STANDING WITH THE COMPENSATION


COMMISSIONER (COID REGISTRATION NUMBER)

3.16 RIGGING AND LOAD TEST CERTIFICATES


(Should the service not be done by the venue itself) Proof of all
certification must be included with the safety file before any rigging
work may commence.

4. GENERAL HEALTH & SAFETY HOUSE RULES

4.1 All personnel are required to wear hard hats when working in areas
deemed as “construction sites” during build-up and breakdown of an
event
4.2 Safety shoes are to be worn by all persons working with or lifting heavy
materials. No open, canvas or trainer shoes or persons working
barefoot will be permitted onto the work site
4.3 Eye protection must be worn by all personnel cutting timber, grinding
metals or welding
4.4 All saws, grinding wheels and other portable equipment are to be guarded
as required by the Act and no open, unguarded, inverted saw blades
will be allowed
4.5 A “Hot Works” permit will be required where any welding or grinding is
carried out. This may be obtained from the Sun City Safety Department
4.6 Any person/s working in an elevated position will required a safety
harness which must be secured to a safe structure
4.7 A permit is required for all scaffolding utilised on site. This permit must be
displayed on the scaffold framework during use
4.8 No scaffold structure above 3 meters from the platform may be erected
4.9 When moving the scaffold, no persons will be permitted to be station on
scaffold (wheel scaffold)

4.10 All designer/custom-built stands will require a Certificate of


compliance (COC) for temporary electrical installations
4.11 The use of 2-core ripcord on any wiring on stands is strictly forbidden
4.12 All wiring to be carried out to standard good wiring practices:
a. Single core or open wiring may not be run through stand supports
b. Joints will be done with a connecting strip and will be bound with
electrical insulation tape
c. All electrical equipment and appliances must be protected against
earth leakage faults by ensuring that it is connected to earth
leakage protection unless utilizing clearly marked double insulated
equipment
4.13 All emergency exits and walkways must be kept clear of obstructions at
all times
4.14 Fire fighting equipment such as fire extinguishers/hose reels and all
emergency signage should be clear of obstruction and be visible at all
times

5. PERSONAL PROTECTIVE EQUIPMENT

Depending on the nature of the situation or condition encountered, the


following should be contemplated:

5.1 An employer will instruct his employees in the proper use, maintenance
and limitations on the safety equipment provided and the employer will
not permit any employee to work unless such an employee uses the
required safety equipment provided to him
