The Undersigned is directed to circulate the General Operational Guidelines for implementation
of Central Capital Investment Subsidy Scheme, 2012, Central Interest Subsidy Scheme, 2012 and Central
Comprehensive Insurance Scheme, 2012 for the State of J&K under J&K Package-II.
2. These guidelines should be followed scrupulously while considering the claims and other
procedural aspects of implementation of the J&K Package-II. State Government is requested to give
wide publicity to these guidelines in the State of Jammu & Kashmir to avoid any procedural
difficulties to the entrepreneur in filing the claim.

SPECIAL PACKAGE OF INDUSTRIAL INCENTIVES FOR THE STATES OF JAMMU
& KASHMIR
(i) Industrial unit which wishes to claim subsidy under this Scheme should get
registered (IEM Part-I/Registration under the scheme – Form 1A & 1B) with
the District Industries Centre (DIC) concerned, prior to the date of
commencement of its commercial production (IEM Part-II) for new units or
undertaking substantial expansion for existing unit.
(iii) It may be ensured that no industrial unit should be registered for benefits
under Special Package of Industrial Incentives Scheme if it is covered under
Negative List of Industries provided in the Notification of the respective
Schemes.
(iv) The claims for subsidy under the special package of incentives Scheme of
J&K have to be submitted to the concerned DIC in the prescribed Application
Forms {Form-1C along with documents as per check-list Form-1C(i)} within
one year from the date of commencement of commercial production. This will
include appraisal report of Bank/Financial Institution (in case of bank financed
units) or appraisal report of the JKDFC (in case of self-financed units). A
’Deviation Statement’ in Form 1C(A)(i) or IC(A)(ii) respectively shall also have
to be submitted along with the claim application.
(v) The DIC must ensure that the claim Application Form for subsidy is complete
in all respect and accompanied by all the requisite documents as per the
‘Check List’ appended herewith as Form-1C(i). Incomplete applications,
without the requisite documents should not be considered under any
circumstances.
(vi) The subsidy under schemes should not be considered if the claim is sub-
judice.
(vii) All transaction in respect of the cost of plant and machinery/project, as the
case may be, must be through “A/c payee cheque” or “demand draft” only.
No payment in cash would be considered eligible for computation of subsidy.

(viii) The DIC should invariably record a certificate to the effect that no cash
payment has been included while recommending the subsidy amount of each
eligible unit.
(x) The cost of land shall not be taken into account for the purpose of
determining the eligibility and quantum of subsidy under the scheme.
(xi) Subsidy under schemes shall not be provided on imported second hand
capital goods.
(xii) The DIC must date-stamp each claim under signature of Official concerned
on each page of all the documents required as per the respective Check List
appended therewith.
(xiii) The authorized official of the DIC must visit the location of each and every
unit and physically verify the existence and operation of the industrial
unit/substantial expansion undertaken by the unit and submit a report in the
prescribed Form-1C(E) and comments on the deviation report submitted by
the unit.
(xiv) The Director of Industries would designate an officer by post to certify the
completeness of the documents forwarded by the DIC.
(xv) The Directorate of Industries (DI) should ensure that all claims are placed
before the State Level Committee (SLC) within 180 (One Hundred Eighty)
days from the date of receipt of the claims. In exceptional circumstances, if
there is delay, then the reason for the same must be provided in writing by the
concerned authorities of DI.
(xvi) In case of Bank financed units, the bank shall certify the value of plant and
machinery for the project. In case of self-financed units, both for service and
manufacturing sector, the project would be appraised by JKDFC after
registration by the unit. JKDFC would also certify the value of plant and
machinery eligible for subsidy.
(xvii) Meeting of SLC must be held at least once in a quarter to avoid accumulation
of cases pertaining to claims under the schemes.
(xix) Where the amount of subsidy calculated is above Rs.1.00 crore, the Financial
Institution concerned (if the industrial unit is being assisted by a financial
institution) should also be invited in the SLC meeting.

(xx) The notice of the SLC meeting along with the detailed agenda note should be
delivered to all concerned (including GoI nominee) at least fifteen working
days before date of the meeting, failing which the meeting shall be adjourned.
(xxi) Multiple Subsidy claims of more than Rs.1.50 crore of new unit or subsequent
expansions where the total subsidy under the Capital Investment Subsidy
Scheme is more than Rs.1.50 crore shall be placed before the Empowered
Committee.
(xxii) Claim file of cases of subsidy claim between Rs. 1.5 crore to Rs. 3.00 crore
shall be forwarded to DIPP with duly filled in check-list for scrutiny of CCISS
claims above Rs.1.50 crore as per Form No.1C(H) along with the
recommendations of the SLC for consideration of the Empowered Committee.
(xxiii) In respect of claims below Rs. 1.5 crore (for service sector only), JKDFC shall
scrutinize the details of cost of the project before the SLC meeting. If
necessary, JKDFC can call additional documents/evidence in support of
details of expenses incurred by the claimant unit. Findings of such scrutiny
shall be placed before the SLC.
(xxiv) Usually, the SLC organizes a field visit to the unit before considering its claim.
In case of claims of above Rs. 1 crore under Central Capital Investment
Subsidy Schemes, the State Government must organize field visit of the unit,
by a team consisting of one representative each from (a) State Government
concerned (b) each of the Financial Institutions which assisted the unit, (c)
Department/ Ministry of the State Government administering the sector in
which the claimant industrial unit falls and (d) JKDFC. DPR approved by the
bank would be the basis of deciding project cost.
(xxv) The functions of the Field Visit Team shall be broadly as follows:-
(xxvi) The field visit will take place before the SLC meeting. The report of the field
visit team shall be a part of agenda of the SLC meeting.

(xxvii) While recommending/approving a claim under the scheme, the SLC shall
consider the following:-
Physical Verification Report of the DIC
Assessment Report of Field Visit Team (must for claims above Rs.1.00
crore)
The documents pertaining to the proof of existence of the industrial unit
Production figures of the unit
Detailed Project Report (DPR)/Techno-Economic Feasibility Report
(TEFR) of the industrial unit
Whether payment for procuring/acquiring these Plant & Machinery has
been made through A/c Payee Cheque/Drafts/NEFT/RTGS.
Appraisal Report of the Financial Institution(s) which had assisted the
project of the Industrial unit.
‘Deviation Report’ submitted by the unit with their claim application.
Clarifications on the eligible components of P&M provided by DIPP
from time to time.
Representatives of Financial Institutions must be invited to the SLC
meeting in respect of units funded by them.
In addition to the above, SLC can also stipulate the requirement of any
other documents/reports which in its opinion are essential for
ascertaining the genuinity of the claims made by the industrial units.
(xxix) The SLC in its recommendation should certify that the claim is in accordance /
compliance to the scheme guidelines which includes eligible component of
plant and machinery.
(xxx) At least 10% of the claims shall be subject to post audit by JKDFC within one
month from the date of issue of sanction letter by the Directorate of Industries.
(xxxi) The unit shall be required to furnish Annual Progress Report (APR) as per the
prescribed format to the Directorate of Industries for five years after receiving
subsidy.

Where as
1. The unit has made an application to the State Government to avail benefit under the
Central Capital Investment Subsidy Scheme, 2012 for J&K.
2. After verification and scrutiny of claim, the Member Secretary of the State Level
Committee is satisfied and placed the claim of the UNIT before the SLC/DLC in its
meeting held on ------------- ------ SLC approved the claim of Central Capital
Investment Subsidy Scheme (CCISS)/ Central Interest Subsidy Scheme/Central
Comprehensive Insurance Scheme and recommended for disbursement from the
Jammu & Kashmir Development Finance Corporation (JKDFC), Jammu, the
designated disbursing agency nominated by Government of India for an amount of

3. The UNIT is required under Section 124 of the Indian Contract Act, 1872, Chapter-
VIII of the Indemnity and Guarantee and u/s 126 of the Act to enter into an

(a) That the UNIT, its successor and assigns are bound to abide by the
conditions of the scheme.

UNIT has been obtained by misrepresentation as to an essential fact/s,
furnishing of false information or if the UNIT goes out of production within
5 (five) years after commencement of commercial production, the Central
Government/State Government/JKDFC shall ask the UNIT to refund the
amount, for safety of the public fund, after giving a reasonable opportunity
to the UNIT of being heard.
(c) That the UNIT , without taking prior approval of the Union Ministry of
Commerce & Industry ( Department of Industrial Policy & promotion) /
State Government /Financial Institution / Bank concerned , shall not
change the location of the whole or any part of the UNIT or effect any
substantial contraction or dispose of a substantial part of its total fixed
capital investment on which subsidy has been granted, within a period of
5 (five) years after its going into commercial production.
(d) The UNIT shall furnish Annual Progress Report (APR) to the Union
Ministry of Commerce & Industry (Department of Industrial Policy and
Promotion)/State Government concerned, every year, about its working
for a period of continuous 5 (five) years after going into production.
(e) That if the UNIT commits a breach of any of the covenants herein
contained, it shall be lawful for the State Government/Central
Government to ask for refund of the subsidy amount so disbursed and
thereupon, the grant or subsidy amount so approved and disbursed shall
become null and void and of no effect and all right of the UNIT on the
subsidy amount shall at once cease and determine.
(f) In case of any dispute or claim arising as a result of the subsidy amount
of Rs.………………… ( Rs…………………………..) disbursed by JKDFC
and approved by SLC in its meeting held on ……………. and the

Time-line for implementation of the J&K Package-II
Unit should submit claim within one year from the date of commencement of commercial production at the concerned
District Industry Centre (DIC) with complete documents as per norms.
The claim shall be examined at the DIC level as per the scheme guidelines. The physical verification of the unit in respect of plant
& machinery installed shall be conducted by the authorized officer of DIC. GM, DIC shall ensure that all these formalities should
be completed within 60 days from the date of submission of the claim by the unit and forward the claim to Directorate of
Industries with its recommendations.
Directorate of Industries will go through the each case and verify whether the claim has been examined by the DIC concerned as
per the norms and prepare agenda note for organizing the SLC meeting. After meeting of SLC, issue the sanction letter of the
claims approved the SLC and forward the claim files to nodal agency (JKDFC) for release of funds. Total time to be taken by
Directorate of Industries should not be more than 90 days after receipt of the claim from DIC concerned. Therefore, the total
time should not be more than 150 days from the date of submission of claim by the unit. All documentation should be
completed when the claim is submitted to SLC.
Nodal Agency will make as request to the DIPP for funds as per the list of sanction issued by the Directorate of Industries along-
with the utilization certificate of the earlier release of funds by DIPP within 15 days from the date of issue of sanction letter by
Directorate of Industries. Simultaneously, conduct pre-audit of 10% claims.
On the request of the nodal agency, DIPP will examine the requisition and process the same for release of funds. If the request is
in order, release funds within 45 days.
The nodal agency shall disburse the funds to the bank account of the unit through electronic transfer as per norms within 30 days
from the date of release of funds by PAO to the account of nodal agency.
