SUBJECT: REQUEST FOR ESTABLISHING OF BUSINESS PERMIT AND LICENSING


OFFICE (BPLO) AND PERMANENT STAFF

DATE: JULY 12, 2021

For effectively and efficiently implement or carry out the intent of


Government mandate, it is imperative to institutionalize the Business Permit and
Licensing Officer by providing for a new organizational structure and staffing patter
of the Local Government Unit of Kabasalan, Province of Zamboanga Sibugay.

The fundamental law of the land mandates that government shall promote
the quality of life of the people, likewise, the Local Government Code of 1991
provides that the local government units shall undertake to enhance economic
prosperity, among other concerns;

National laws provide requirements, conditions and standards for the


establishment, registration and operation of businesses as well as safety and labor
standards;

CREATION OF THE BUSINESS PERMIT AND LICENSING OFFICE

1. There is a need to create the Business Permit and Licensing Office (BPLO)
for the effective and efficient delivery of services to the public;

2. There is hereby created a Business Permits and Licensing Office, to handle


the issuance of business permits and licenses as well as formulate and
implement policies and proactive measure to increase local employment,
draw local and foreign investments, and increase local revenues.
POWER, DUTIES AND FUNCTIONS
The Business Permits and Licensing Office (BPLO) shall be responsible for the
following:

a. Processing of business permits and licenses as well as occupational permits,


including the assessment of business taxes, fees and charges of the various
businesses in the municipality. Provided, however, that all assessments are
subjects to the authority of the local treasurer to conduct examination of
book of accounts as well as all other authorities as provided in the Local
Government Code.
b. Monitoring and enforcement of the applicable tax ordinances and other
pertinent laws, ordinances, rules and regulations in the operations of
business and occupations within the jurisdiction of the LGU;
c. Formulation of policies as a proactive measure to draw local and foreign
investments especially in priority areas/industries and as a tool to define the
development thrust of the LGU.
d. Initiate, review and recommend to the Mayor revenue-generating measures
to increase local revenues;
e. Enforcement of the LGU’s Tax Ordinances and other pertinent laws,
ordinances, and rules and regulations;
f. Sit as a member of the Local Finance Committee, Local investment Board and
such other bodies as the Mayor shall identify;
g. Perform such other function as may be provided by Law.

APPOINTMENT OF THE CHIEF, BPLO

The Business Permits and Licensing Office (BPLO) shall be head by a Chief, with the
rank and salary of a Department Head.

COMPOSITIONS AND OFFICE STRUCTURE

The Business Permits and Licensing Office (BPLO) shall be composed of four
(4) principal divisions, namely;

a. Administrative Division – Take charge of administrative functions


including professionalization of personnel, supply management, budget
preparation, and systematic records management of all office documents,
provision of general services and such other administrative concerns.
b. Examination Division – Examine business permit applications
(new/renewal) pursuant to the Municipal Revenue Code, as amended;
conduct research for the continual effectiveness of office procedures,
efficiency of service delivery, and maximization of business tax
collections; examines documents for the appropriate action on appeals
for re-assessment or tax credit.
c. Billing and Information Division – Supervises the Business Permit and
Licensing System (BPLS) pertaining to the issuance of billing statements;
report generation; and maintains payment records of all business
establishments in the Municipality.
d. Inspection and Consumer Welfare Division – Carries out inspection all
kind of business in the city to determine compliance with existing
directives, laws, city ordinances, policies, rules and regulations; and
protects the interest of the consumers as mandated by Republic Act
7394, also known as Consumer Act of the Philippines.

In view of the above organizational set-up or staffing pattern shown, the


funds for the operation of Business Permit and Licensing Office (BPLO) shall be
appropriated from the Annual Executive Budget under the General Fund of the
Municipality and other available funds.

The Positions and Salaries of the staff of Business Permit and Licensing Office
(BPLO) shall be subject to the usual existing accounting and auditing rules and
regulations, the Civil Service Commission (CSC) guidelines and Qualification Standard
(QS), and the approval of the Department of Budget and Management (DBM).
