Lykins advised me that she first heard about the incident from Adrian Neptune, Lieutenant, Security & Emergency Management (see Attachment 2). Capt, Lykins further advised me that she did not interview Michael Rodriguez, Security Officer, about the incident and that it was handled by her staff. Capt. Lykins confirmed that Officer Rodriguez violated policy by using his district assigned vehicle to pursue individuals off campus and removing his weapon from the holster to draw down on non. threatening juveniles. Page tof Capt. Lykins further advised me that Officer Rodriguez not only violated policy, he also failed to notify his supervisors regarding the details of the incident. It came to light froma phone call from the Hillsborough County Sherif's Office, Capt. Lykins advised that she notified her supervisor Zamir Ode, Major, Security & Emergency Management, ofthe incident on March 30, 2020, (see Attachment 1). Capt. Lykins had io frrthe. information. Adrian Neptune, Lieutenant: interviewed Lt. Neptune on April 17, 2020, via telephone. Lt Neptune advised me that he spoke with Officer Rodriguez and at frst, he described only that the incident was with an unknown black male. Officer Rodriguez advised that he observed the Subject place his hand in his waistband after the subject left school grounds (see Attachment 2) Lt Neptune stated it wasnt until further in the interview when Officer Rocriguez admitted he had Grawn his weapon on three females who were on the property of a nearby recreation center Lt. Neptune advised me that Orficer Rodriguez violated policy when he used the district assigned vehicle to pursue the trespassers after they left school grounds. Lt. Neptune advised that Oflecr Rodriguez violated the “use of force directives” when he unholstered his weapon off campus on three females who posed no threat to him, Lt. Neptune further stated that he had in his possession a video that he procured from the Paiks and Recreation Center adjacent to King High School (see Attachment 3). Lt. Neptune stated he recommended that Officer Rodriguez be relieved of his duties. Lt Neptune advised me that Officer Rodriguez tumed in his equipment and submitted his letter of resignation. Lt. Neptune had no further information Kevin Johnally, Corporal, School Security, Hillsborough County Schools: | interviewed Cpl Johnally on April 17, 2020, via telephone, — ——CplJohrally advised me thathe-and Officer Rodriguez were responding to-arralarmy-call-at King ———— High School. Cpl. Johnally advised that he went to the west side of the school and Office Rodriguez responded to the east side of the school (see Attachment 5) Cpl. Johnally stated building. He told me that Cpl. Johnally advised he heard Officer Rodriguez on the radio advising there was an unknown Black male who had just reached into his waistband, and there were other individuals running Pastbound by the football field. When Cpl, Johnally arrived on the eastside of the school grounds he was unable to see Officer Rodriguez. Cpl, Johnally advised that he got on the radio ard ached Officer Rodriguez for his location. He advised that Orficer Rodriguez responded that he was exct of the school on the nearby recreation center property where he lost sight of the unknown blase male, however, he was in contact with three female juveniles (who were later released) Page 20f3 Cal aChnally stated that Officer Rodriguez realized he violated policy by using his assigned vehicle and told Cpl. Johnally that he hadn't given it any thought at the time. Offcer Rodriguez Gi net mention to Cpl. Johnally that he unholstered his weapon on the three juvenile forcles Sherif's Office (HCSO), who advised that a parent of one of the juveniles had contested their office. The parent advised that Officer Rodriguez had drawn his weapon on his daughter, who ‘was one of the three juveniles stopped off campus by Officer Rodriguez. Pl Johnally advised me that he addressed the allegation with Oficer Rodriguez, and he admitted etre unholstered his weapon and drew down on the juveniles. When asked why he falled to potiy anyone of that information, he said that he, “simply forgot” Cpl. Johnally stated that Orsece Rodriguez was aware that he violated policy when he drove his vehicle off eampus to pursue the trespassers, in addition to unholstering and drawing his weapon, Officer Rodriguez was advised by Cpl, Johnally that he would be reporting the violation to Kendall Glenn, Sergeant, School Security & Emergency Management, and to the Offs of Professional Standards. This Use of Force was not reported to the supervisor on duty. DISPOSITION Officer Rodriguez failed to notify his supervisor on duty of a Use of Force. This stated Use of Force was off a school campus, which is a violation of Policy Number 11. Officer Rodriguez used his Department vehicle in a pursuit which is direct violation to Standard Operation Procedure Number 8. As a result, force was used to bring the student under control. ‘The Hillsborough County Sheri?’s Office (HCSO) closed its case as “unfounded” for abuse. The Hillsborough County Sherif's Office Child Protective Investigations Division (CPI) concluded there were “no indicators” of abuse, neglect, or abandonment. ‘The HCSO report concluded the School Security Oficers were justified In using force asthe victim was moving towards them. it was also determined the victims injuries did not meet the level of child abuse. The CPI report stated the “child sustained the injuries from being restrained and the officers used appropriate force deemed per the FOLE force matrix that they were trained on.” In the investigation conducted by the office of Professional Standards, there was no evidence of written procedures or substantiated ‘ralnings that clearly established that security officers are required to notify administrators prior to entering 2 classroom to deal with students who are misbehaving. Included in the conflicting information collected was a statement from the Assistant Principal who stated he had met with security offices at the beginning of the year and had approved their moving around the campus and entering classrooms without administrator approval ‘The evidence collected in this investigation does not substantiate the allegations. The office of Professional Standards will make @ Fecommendation to the Division of Administration and the Department of School Security that they consider developing clear guidelines for Security Officers to follow with regards tothe entering of classrooms to deal with disruptive students. The complaint alleges that three security officers identified as Obed Gerena, Jr. . Adam Chavez, and Elias Santos violated policy/procedure when they entered a classroom to confront a student without an administrator present. Upon reviewing the Hillsborough County Sheriffs Office report, writer noted the following: a) The report is listed as Aggravated Child Abuse 5) The subjects listed on the report are Officers’ Obed Gerana, Jr., and Elias Santos, ©) The report is listed as “Unfounded” stating that the reason for the finding is conflicting statements to the events, schoo! security was justified in their use of force due to the fact that the student was moving towards them, and the student's injuries did not meet the level of child abuse. Policy Statement #01 Subject ‘Philosophy of Enforcement’. Upon reviewing this document, writer noted that it did not appear to address the policy as to when a security officer enters a classroom. Page 2 of 7 On November 1, 2013 at approximately 1400 hours, writer responded to Brandon Alternative School located at 1009 N. Parsons Road in Seffner, Florida, and interviewed Alternative Education Aide Sylvia Royal. Ms. Royal ‘provided the following information. Writer asked Ms. Royal how long she has worked for the district and she advised twenty years. Ms. Royal advised that she has been at Brandon Alternative for the last thirteen years. Writer asked Ms. Royal to describe what occurred on the day of the incident prior to the officers physically engaging the student. Ms. Royal advised that she was watching the classroom for Lynda Barr, Assistant Teacher, who had stepped cut of the class. Ms. Royal advised that she could see two students through the glass in the door standing outside the classroom. Ms. Royal advised that she identified the students as 20 SHEED. Ms. Royal advised that she approached the door and at first thought the door was locked but realized it wasn’t when she opened the door. Ms. Royal advised that she instructed Sam and @INNBNEPto come into the classroom. Ms. Royal advised that it immediately became clear to her that Slime was having a verbal exchange with Officer Gerena. Ms. Royal advised that she repeatedly {old NBBeto come into the classroom stating, ‘It's not worth it.” Ms. Royal advised that after about a minute of coaxing lifinally came into the Portable. Ms. Royal advised that even though the classroom door was shut, Sllagecontinued to verbally engage Officer Gerena and her and another student attempted to move li back towards his seat. Writer asked Ms. Royal if @N9@ was yelling or screaming and she replied, "No.” Writer asked Ms, Royal if Nl was physically fighting anyone in the classroom and she replied, “No.” Writer asked Ms. Royal if there was any reason for the officers to enter the class and she replied, ‘No.” Ms. Royal then stated that unless there is an emergency, the officers are not supposed to enter the classroom without an administrator. Ms. Royal then changed her statement and stated that it is okay for the officers to enter without an administrator if they want to talk to a student or a teacher, Ms. Royal stated that she was in fact having trouble gettinggggpto his seat when the officers entered the classroom. Ms. Royal advised that when te officers entered the classroom, several of the other students became unruly and she attempted to address them, Ms. Royal advised that while she was addressing the other students, she heard a noise and then observed that the officer and, wete-physically engaged. Ms. Royal stated that she did not see the first point of contact and cannot say for sure that did not charge at the officers. Ms. Royal also stated that she cannot say for su'e tet eB vous have gone to his seat even if an administrator was present. Ms. Royal had no further information. On November 1, 2013 at approximately 1420 hours, writer interviewed Nancy Lind, Principal, Brandon Alternative School. Writer asked Ms. Lind if she was a witness to the incident that took place in the classroom regarding @_gggaas and the officers, and she advised she did not witness the incident, Writer asked Ms. Lind who informed her of what had occurred in the classroom and she replied, ” Writer then asked Ms. Lind if her statement to CPI was based on wet Quiles and she replied, Pretty much, yeah.” Writer stated to Ms. Lind, "From what you know regarding this incident, were the officers wrong in entering the classroom,” and Ms. Lind replied, “Yes.” iirter asked Ms. Lind to explain why the officers were wrong. Ms. Lind then stated, "We have a procedure that they are supposed to call for an administrator before they go into a classroom, and nobody called at all.” Writer asked Ms. Lind if the procedure is in writing and she replied, “! don't know if it is in writing.
