CONTRACT OF LEASE

This Contract of Lease made and entered into this ____ day
of 2022 at City of Manila by and between:

EUGENIO DEOCAREZA Filipino, of legal age and a resident of


THE SILK RESIDENCES TOWER 2 unit 2417 represented by Enemelita A.
Bernardo also of legal age hereinafter referred to as the LESSOR;

-AND-

_____________________________, Filipino, of legal age and a


resident of _____________________, hereinafter referred to as the
LESSEE:

WITNESSETH

That the LESSOR hereby agrees to lease and let, and the LESSEE
hereby accepts in lease one (1) condominium unit with postal
address at ______________________________________________ subject
to the following terms and conditions:

1. TERM - The term of this lease shall be one (1)year


commencing on ____________ and expiring on _____________.

2. RENT – The LESSEE shall pay the LESSOR a fixed monthly


rental of FIFTEEN THOUSAND PESOS only (PhP15,000.00)Philippine
currency, exclusive of monthly association dues

3. ADVANCE AND DEPOSIT – The LESSEE agrees to pay one (1)


month advance in the amount of FIFTEEN THOUSAND PESOS only
(PhP15,000.00) and two (2) months deposit in the amount of THIRTY
THOUSAND PESOS only (PhP30,000.00). Deposit will serve as cash
bond to guarantee the faithful compliance of the terms and
conditions of this Contract. Said deposit shall be refunded to the
LESSEE by the LESSOR upon termination of this contract and after
the belongings of the LESSEE have been moved out of the premises,
provided that the LESSEE does not have back rentals or other
obligations with utility companies and to repair damage which is
not a result of normal wear and tear and could otherwise be
attributed to the negligence of the LESSEE.

4. ISSUANCE OF POST DATED CHECKS - The LESSEE is required to


submit eleven (11) post dated checks to the LESSOR for the monthly
payment before moving in.

5. EARLY TERMINATION OF LEASE CONTRACT – It was agreed by both


parties that if the LESSEE wishes to move or vacate the premises
before the expiry of the lease agreement, a deposit of two months
shall be forfeited in favor of the LESSOR.

6. OCCUPANTS – The LESSEE hereby agrees that not more


than ________ (_______) persons shall reside inside the
condominium unless there is a written consent of the LESSOR
authorizing the increase in number of occupants.

7. SUB-LEASE – The LESSEE shall not sub-lease the unit hereby


leased in whole or in part to any other person without the previous
consent in writing of the LESSOR.

8. USE – The LESSEE shall use the unit herein leased for
residential purposes; and shall not use or allow the use of the
unit for immoral or illicit purposes. The LESSEE shall not allow
access to the unit of unauthorized persons who may cause or make
unnecessary noise detrimental to the LESSOR and to
Other tenants of other unit/s.

9. IMPROVEMENTS – The LESSEE shall not make any alteration


or improvements of the leased unit without the previous written
consent of the LESSOR and any and all improvements shall pertain
in ownership to the LESSOR upon expiration of the lease without
reimbursement of the cost thereof to the LESSEE.

10. INSPECTION – The LESSOR or her duly authorized


representatives upon previous notice to the LESSEE shall have the
right to enter and inspect the leased unit at reasonable hours.

11. MAINTENANCE OF THE UNIT – The LESSEE shall maintain the


whole unit in good repair. Any major repairs not due to the
negligence of the LESSEE shall be for the account of the LESSOR.
Failure of the LESSEE to maintain the unit in good repair shall
give the LESSOR the right to have said repairs made with the cost
of such repairs chargeable to the account of the LESSEE.

12. VIOLATION OF THE PROVISIONS – The LESSEE hereby agrees


that violation of any of the foregoing provisions will cause the
immediate cancellation of this contract, forfeiture of the LESSEE’S
deposit to the LESSOR, and shall vacate said unit within
seven(7)days after receipt of notice from the lessor. The LESSEE
further agrees that in the event of the failure to vacate said
unit within the period aforementioned, the LESSOR shall be
authorized to have the right to bring out the belongings of the
Lessee and to retain said belongings equivalent to the value of
the unpaid rent and other obligations.

13. LIQUIDATED DAMAGES AND ATTORNEY’S FEE – In the event the


LESSEE commits a breach of any of the foregoing provisions of this
Lease Contract and the LESSOR is compelled to seek judicial relief
against the LESSEE, the latter shall be liable unto the LESSOR in
the amount of THIRTY THOUSAND PESOS (P30,000.00) as liquidated
damages and THIRTY THOUSAND PESOS (P30,000.00) as attorney’s fees
and other legal expenses whether actually incurred or not.

14. CHARGES FOR WATER, ELECTRICITY, TELEPHONE, ETC. – The


LESSEE shall pay or defray starting ________________ at his
exclusive expense, the consumption of water, electric, association
dues, or other utility services in the leased premises; and the
cost of installation and repair in the utility service system
therein shall be for the exclusive account of the LESSEE. The
LESSEE shall be responsible for the proper disposal of his own
garbage.

15. COMPLIANCE WITH LAWS AND REGULATIONS – The LESSEE shall


comply with any and all laws, ordinances, regulations or orders
promulgated by proper government authorities arising from
or regarding the use, occupation and sanitation of the leased unit,
and non-compliance therewith shall be at the exclusive risk and
expense of the LESSEE;

16. FIRE HAZARDS – The LESSEE shall not bring or store in the
leased premises any inflammable or explosive goods or articles
which may expose the leased unit to fire or increase the fire
hazards;

17. INSOLVENCY OF LESSEE – If the rentals herein stipulated


be in arrears or delayed rental payment for 7 days, or if the
LESSEE shall at anytime fail or neglect to perform or comply with
any of the covenants, conditions, agreement, or restrictions
stipulated herein, or the LESSEE shall become insolvent, then in
any such cases this lease contract shall become automatically
terminated and cancelled and the said unit shall be vacated
peacefully by the LESSEE for the LESSOR to take over the possession
thereof, and two (2) months deposit shall be forfeited, in which
event it shall be lawful for the latter or of his duly authorized
representative, Enemelita Bernardo, to enter into and upon the
leased unit as though the term of the lease has expired, without
prejudice on the part of said LESSOR to exercise any or all the
rights arising from this contract of lease and those granted by
law;

18. NON-WAIVER OF LESSOR’S RIGHT – That failure of the LESSOR


to insist upon a strict performance of any of the terms, conditions
and covenants hereof shall not be deemed a waiver of any rights or
remedy that said LESSOR may have, nor shall it be construed as a
waiver of any subsequent breach or default of the terms, conditions
and covenants herein contained; and

19. PREVIOUS AGREEMENT SUPERSEDED – This Contract of Lease


supersedes and renders void any or all agreements and
understanding, oral and/or previously entered into by the parties
covering the leased property, and this Contract may not hereafter
be modified or altered except by another instrument in writing
duly signed by the parties hereto.

IN WITNESS WHEREOF, the parties hereto have signed these


presents on the date and in the place first above stated.
