CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This Contract of Lease executed and entered into this


_________________ at Iloilo City, Philippines by and between:

____________________________, of legal age, Filipino,


single, and a resident of Puerto Real Subdivision
Lapaz, Iloilo City, Philippines, hereinafter referred
to as LESSOR;

- and -

____________________________, of legal age, _________, a Filipino,


and with residence address at _________________________ ,
hereinafter referred to as LESSEE;

WITNESSETH:

That the LESSOR is the absolute owner of a parcel of land known as


Lot. No. ___ Blk. No. __ and covered by Transfer Certificate of Title No.
________, a residential house, consisting of (4) Four Bed Rooms, (1) One
Dinning Area, Kitchen Area with a Parking Area, situated at Lot. No. __, Blk.
No. __Phase II, Manduariao Housing, City of Iloilo, Philippines;

That the LESSOR is desirous of leasing to the LESSEE residential


house, as above mentioned. The Lessee is also desirous of leasing the same,
subject to the following terms and conditions:

1) SUBJECT MATTER. The subject matter of this lease is the lease of a


space in the building located at Lot. No. __, Blk. No. __Phase II,
Manduariao Housing, Iloilo City, Philippines. The LESSEE already
occupies the space that is subject matter of this lease.

2) TERM. The term of this lease is from _______________ to


________________.

3) RENEWAL. Contract of Lease is renewable only upon mutual


agreement by both parties within (30) Thirty days prior to the
expiration of the contract; both parties may negotiate and sign a
formal renewal of the lease, subject to another terms and condition
which shall be mutually agrees upon both parties. In case both parties
do not reach an agreement, then it is understood that the contract of
lease shall be renewed, and upon expiration of the lease, the LESSEE
shall return the premises and fixtures in a good condition as they
actually found at the beginning of the lease. The LESSOR shall have
the right took for a new LESSEE and no right of good will whatsoever
shall be charged by the LESSEE for the premises.

4) MONTHLY RENTAL - The LESSEE shall pay the LESSOR a monthly


rental of TWENTY THOUSAND PESOS ONLY (P 20,000.00),.

The net amount collectible is payable on the 8th day of April, 2019. The
Lessee shall pay ______________________________ (________), equivalent
to (3) Three months rental upon signing of this contract which
representing (2) Two months advance rental and (1) One month
Security Deposit.

5.) SECURITY DEPOSIT – upon execution of this lease contract,


the LESSEE shall pay to the LESSOR a deposit equivalent to One (1)
month rental, i.e. TWENTY THOUSAND PESOS ONLY (P
20,000.00), as security deposit during the entire duration of the
contract. This deposit cannot be used or be deducted for rental
payments.

It shall be kept by the LESSOR, and will be applied to whatever


damages, losses or payable incurred by the LESSEE upon termination
of the agreement. Whatever unpaid utilities of the LESSEE that may
due at the end of the contract term. LESSEE’S obligation to pay
deposit shall be independent and apart from her obligation to pay
rental. The same deposited amount shall be returned to the LESSEE
at the end of the contract term if neither damages nor expected
unpaid utilities bills.

This security deposit shall be forfeited in favor of the LESSOR by


reason of any or all of the following instances:

a. Non-payment of monthly rentals and penalties.


b. Non-payment of monthly Electricity and water bills.
c. Refusal to vacate upon expiration of the period of LEASE.
d. Violation of any of the conditions stipulated herein especially
the premature termination of the period of lease.

The forfeiture of the deposit shall not be deemed a waiver nor shall it
preclude the LESSOR from availing of other remedies available in this
contract of lease.

The security deposit herein shall be returned to the LESSEE without


interest upon expiration of the period of this lease, if the LESSEE shall
have faithfully complied with all his obligations and undertakings as
provided in this contract, subject to deduction of such amounts as may
be necessary for the repairs of the leased premises or non-payment of
any utility bills.

The remaining amount of deposit (Security Deposit less Compulsory


Deduction/Repair Cost) herein shall be returned with the LESSEE
after all his obligations are complied.

6.) USE OF PREMISES. LESSEE’S shall use the leased premises


solely for apartment premises. The LESSEE shall not allowed the
following activities below:

a. Loitering/standby in the lobby


b. Drinking liquors
c. performing disturbing noises or other nuisance
d. cooking using charcoal
e. performing illegal or immoral

7.) RULES ON ALTERATION, INSTALLATION OF


PERMANENT IMPROVEMENTS, ETC. The LESSEE shall not make
any alterations, additions, installation or Improvements on the leased
premises, without the prior written consent of the LESSOR, Provided,
however, that all such alterations, installations, additions, or the
LESSOR, become its property and shall remain upon, and be
surrendered with, the premises as part thereof at the termination of
the lease contract, without need of compensation of the LESSEE. If
the LESSOR does not elect to retain such alteration, installations,
additions or improvements, the premises shall be restored to its
original condition by, and at the expense of, the LESSEE.

8.) SANITATION. The LESSEE shall, at his expenses, maintain the


leased premises in clean and sanitary condition, free from obnoxious
odors, and upon the expiration of the lease, and return the premises
in as good condition as it was actually found at the beginning of the
lease, ordinary wear and tear excepted. The LESSEE shall provide
herself at her own expenses with receptacles which the City
Ordinance require to hold and contain waste matter and garbage, and
shall deposit them within the lease premises in a place designated by
the LESSOR.

10.) STIPULATION AS TO USE OF UTILITIES. The LESSEES shall


pay for
whatever utilities that they are installed and they are using in the
leased
premises. That is the LESSEE fails to pay One (1) month electric and
water bill, the service connections will be automatically disconnect
without necessity of prior and/or subsequent notice from the
LESSOR. Furthermore, the LESSEE will be the one to apply for other
utilities such as cable, telephone, etc.

11.)INSPECTION OF PREMISES. The LESSOR or its authorized agent


shall have
the right to enter the leased premises at any reasonable time of the
day and with at least 24-hours notice of such visit.

12.)SURRENDER OF PREMISES. The LESSEE agree to return and


surrender the
Leased premises at the expiration of the term of this lease or upon its
cancellation, in as good condition as reasonable wear and tear will
permit and without any delay whatsoever, devoid of any occupant. The
LESSOR is authorized by the LESSEE, and has the option, to take
over the premises and/or padlock the same in the event of LESSEE’D
unlawful detainer without need of any court order. If said premises be
not surrendered as stipulated above then the LESSEE shall be liable
to pay the LESSOR by way of liquidated damages reasonable
compensation for continued unlawful occupancy of the premises in the
amount twice the rental rate stipulated in paragraph 4 above, and the
LESSEE shall additionally be liable to, and indemnify the, LESSOR
for any and all claims made by succeeding tenant against the
LESSOR who may not be able to occupy the premises because of
LESSEE’S refusal to vacate.
