This Mutual Divorce Agreement (this “Agreement) is entered into as of 25 January 2021.

PREAMBLE:

Both the parties have been married on 15 April 2015 as per Hindu rites and rituals. After their
marriage, the parties have been residing at 4, Rishikesh Bldg, Evershine Nagar, Malad
(West), Mumbai, Maharashtra, 400064.

But after 3 years of marriage husband and wife develop some differences, different habits,
disagreeing on everything, don’t talk much, rude behavior with each other, so there is no
reason for them to live together any further. Family and friends have also tried to unite them,
but nothing is helping to get closer to each other. So, the parties have decided to end their
marriage mutually.

The agreement has been framed under section 13 B of the Hindu Marriage Act, 1955. The
main idea of this act is to separate the couple mutually without any fights. In this agreement,
there is a final and complete settlement of all rights and obligations between parties,
including the property rights, all rights concerning child custody, support, visit.

NOW THEREFORE in consideration of the mutual promises and covenants contained in this
Agreement, the parties agree as follows:

1. DIFFERENCES BETWEEN PARTIES:


1.1 The parties have been in a situation in which it is impossible to reunite them to
live together happily. They don’t trust each other.
1.2 They have been living separately in their home, they don’t talk much to each other
and many times they behave very strange with their family and friends.
1.3 They don’t have any physical relations for almost 2 years, and nothing of that sort
happened.
1.4 The Husband has started searching for a new home and he is almost ready to leave
the place.
1.5 The parties have agreed with themselves to go for the mutual divorce agreement.
And, not to file an FIR against themselves or their families.
2. CHILD CUSTODY & SUPPORT:
2.1 The parties have a 5-year-old daughter and son, named Ruhi Malhotra and Zain
Malhotra on the date of this agreement.
2.2 The custody of the daughter and son should remain with the mother, as per the
party’s decision, as they are minors.
2.3 The parties have decided that the father can visit the daughter and son
occasionally, he can keep his daughter and son on weekends.
2.4 As per the agreement the parties have decided that they are going to split the
expense of their daughter and son. The father will take care of the expenses of the
daughter and the mother will take care of the expense of the son.
2.5 The parties have decided that they are not going to change their address without
giving 10 days’ notice.
3. JOINT ACCOUNT & PROPERTY:
3.1 The parties have agreed that the joint accounts and properties should be divided
equally among themselves.
3.2 The parties also have FD for their daughter and son, which should only be used
for their children only if they don’t have enough money at that time.
3.3 The husband and wife jointly purchased land in Versova, Mumbai, which should
be divided equally.
3.4 They also had two cars, the husband would get Honda City, and the wife gets
XUV 700.
4. ACKNOWLEDGMENT:
4.1 The parties have solemnly decided to get separated from themselves without any
quarrel or fight.
4.2 The marriage between the parties, solemnized on 15 April 2015, by the decree of
divorce by mutual consent under section 13B of the Hindu Marriage Act, 1955.
