2.2 CHECKPOINTS

2.1. Authority to Establish Checkpoint

 The CP may establish with the authorized Head of Office of the PNP and
manned by PNP Uniformed, other units may establish checkpoint in
coordination with the PNP head unit in the area.
 Head of office in the territorial units:
a. Regional Director (RD)
b. District Director (DD)
c. Provincial director (PD)
d. City Director
e. Chief of City/Municipal Police Station
f. Sub-station Commander and;
g. Police Community Precinct Commander

2.2 COMPOSITION:

 The checkpoint team shall be composed of but limited to the


following;
1. Team Leader
2. Spotter/Profiler
3. Verifiers
4. Search/Arresting Personnel
5. Forward/Rear Security

TEAM LEADER- Lead and take responsibility preferably PCO. In the absence
of a PCO, most senior PNCO will act as TL.

SPOTTER/PROFILER- point/profile suspected vehicle subject for checkpoint

VERIFIERS- conduct document verification, search, seizure and arrest, if


necessary, initial custody of seized evidence

SEARCH/ARRESTING OFFICER- search, seize illegal items and arrest of


offenders

FORWARD/REAR SECURITY- shall provide security in the checkpoint area


and block/pursue fleeing suspects/vehicle.
GUIDELINES:

1. Cp are established to enforce laws, rules and regulations and when there
is a need to arrest a criminal or fugitive from justice
2. Mobile checkpoints are authorized only when established in conjunction
with ongoing police operations. Only marked vehicles with blinkers
turned shall be used in mobile checkpoints.
3. Designation of the personnel manning the checkpoint shall be left to the
sound discretion of the Team Leader (TL), preferably with female
personnel specially when there is anticipated involvement of a female
suspect.
4. The PNP Checkpoint Team shall be composed of minimum of 8 with TL,
verifiers (2), spotter(1), forward security (2) and rear security (2)
5. The team manning the CP must have immediate contact with any elected
public official and representative from National Prosecution Service or
the media in case illegal drugs are seized or recovered
6. The team should encourage the participation of the LGU, PNP accredited
Civil Society Group, NGOs, business organizations, media and other
stake holders during the conduct of the police checkpoint. However their
participation be limited only as observers except LGU personnel
mandated to enforce the laws and ordinances such as but not limited to
traffic enforcers meat inspectors and Brgy Public Safety Officers.
7. PNP must have a presentable appearance while wearing the prescribed
uniform. Likewise the civilian members must also be in their
organizations uniform with their name conspicuously displayed for
identification. In no case shall the civilian be allowed to bear firearms.
8. The area must be well lighted with visible signage bearing the name and
contact number of the PNP and TL.
9. Due courtesy must be accorded to all road users during the conduct of
CP.
10. Team member must greet all persons for inspection. Extend
apology for inconvenience, appeal for understanding, state the reasons
and thank them for the cooperation.
11. Must signal the motorist to slow down and courteously request to
turn-off the headlights and turn on the cabin lights
12. The conduct of inspection to vehicle is limited to visual search,
with due respect to all road users.
13. A valid search must authorized by search warrant duly issued by
appropriate authority. However, a warrantless search can be done;
a) When there is genuine reason to believe that the occupants of the
vehicle have just committed, actually committing or about to
commit a crime;
b) On the basis of prior information which are reasonably
corroborated by other attendant matters

14. Violations/ infractions shall be immediately acted upon the legal


procedures. Arrested persons must be apprised of their constitutional rights

15. The security of PNP personnel most especially civilian must be given due
consideration in planning

16. As much as possible, only forward/rear security members are allowed t


display their rifles and should positioned where they can best provide for
security

17. CP personnel may also provide police assistance in vicinity, giving


directions to passersby

18. Designated TL shall be responsible of the actuations and behavior of the


members and shall be accountable under the Doctrine of Command
Responsibility.

19. TL must submit an after-CP report immediately upon termination of the


operation.

2.3 PROCEDURES IN THE CONDUCT OF PNP CHECKPOINT

1. TL shall inform COP/Station Commander and TOC of the location of the


CP established.
2. Unit commander/official representative of NSUs and Mobile forces must
coordinate with the concerned LPU through its TOC or by other means
before commencing with the CP
3. Station TOC shall then coordinate with the Higher HQ TOC, adjacent PNP
units and other friendly forces established CP
4. TL shall brief the personnel as well as civilian regarding the proper
conduct of the CP and their assigned task prior to the deployment
5. TL shall account personnel and check if they are in prescribed uniform.
Has name and wearing ballistic vest, rain coat reflectorized vest and
other accessories worn over uniform
6. TL also check the ff;
a. Marked police vehicle
b. signage’s
1. warning signs (slow down, CP ahead, CP 20 meters ahead)
2. Information signs: name and contact number of the unit and TL
c. F/A with basic load of ammos
d. Ballistic Vest
e. Handgun and vehicle base radio
f. Flash lights
g. Megaphone
H. BWC or ARD

7. Spotter/profiler will be pre-positioned in place where he/she can best point


suspected vehicle prior to the approach to the CP

8. Search/arresting personnel shall flag down suspected vehicles conduct


search, seizures and arrest. The search must be in plain view except when
there is genuine reason to believe based on experience and particular
circumstances of each case that criminal activity may be afoot

9.In the event of seized drugs, the seizing team having initial custody and
control of the drugs shall immediately conduct physical inventory and
photograph the same on site in the presence of the accused , his
representative or counsel, elected official and media

10. in case the team has no invest as team member, the arrested person/s and
seized items shall be turned over to the station duty invest for proper
disposition.

11. In the event of the CP is ignored the occupants of the vehicle opened fire
on the personnel manning the CP the response of the team shall be
accordance with the use of Force Continuum

12. TL shall inform the TOC before terminating the CP. Conduct debriefing and
submit AAR.

2.4 PROCEDURES IN THE CONDUCT OF ON THE SPOT (HASTY)


CHECKPOINTS

1. Hasty CP shall be immediately established upon the receipt of the


order/clearance from the unit commander
2. PNP conducting mobile patrol will initially man the CP, to be
complemented with the arrival of reinforcement. A collapsible sinage
with markings “Stop, Police Checkpoint” if available with the name of
unit and tl
3. In case of Internal Security Operation (ISO) or foot patrol where there is
no signage available , hasty improvised barriers/barricade or early
warning signs needed
4. Team shall immediately inform the TOC of the nearest police unit of the
exact location of th hasty CP, TL name and contact number and
equipment used
5. Where there is possibility of high risk stop and/arrest and public safety
might be at rsik no civilian or media shall be allowed
6. Unit Commander shall immediately send additional personnel,
equipment and signage in order to convert hasty to standard CP
7. As soon as Hasty CP is converted TL shall follow the procedures stated
in Rule 2.2

2.5 procedures in the conduct of joint checkpoints

1. COMELEC CP

a. Must be in accordance with Omnibus Code Election Code,


election laws and prevailing resolutions. The Rule 2.2 of POP is
supplemental
b. As much as possible there shall be at least one COMELEC CP
for each City/municipality. Additional may established in
coordination with the election officer
c. Additional CP coming from the PNP other than LPUs
d. In establishing on the spot hasty CP , TL shall give prior notice
in coordination with the EO.

2. Inter Agency CP(DENR, DA, BFAR)

a. There shall be existing agreement and written request from the agency
prior to the establishment
b. In case of apprehension, nominal complainant will be the concerned
agency, charge in the conduct of invest, filing case and custody.
Arrested shall be in custody of the PNP.
c. The signed board be placed on the Cp shall bear the names and contact
number of the TL

3. JOINT PNP-AFP CHECKPOINTS

a. PNP shall take the lead role in the PNP –AFP CP


b. Signboard shall bear the names and contact numbers of PNP and AFP
TL
c. In case of arrest and seizure, the PNp shall take cognizance of the case
3. GENERAL PROCEDURES TO BE FOLLOWED WHEN THE CP IS
IGNORED

a. If ignored, the team shall pursue the fleeing motorist and inform the
adjacent vehicle and passenger/s to established hasty defensive
roadblock and dragnet operation
b. The team shall use megaphones or built in public address system
in the police car with blinkers
c. If motorist stops use the Rule 2.3 of the POP
d. If opens fires at the pursuing team, reasonable force of continuum
in Chapter 2 Section2-4.
