II. MATTERS INVESTIGATED:

3. To establish the facts and circumstances regarding the fire incident at a wood-
framed, single-story, one-family residence at Purok 3, Magaganda Street,
Mahal Subdivision, Barangay Labangal, General Santos City, on November
21, 2022.

III. FACTS OF THE CASE

4. Ryan Jay Hidalgo, 36 years old, married, a resident at Unit 402, Purok 3,
Magaganda Street, Mahal Subdivision, Barangay Labangal, General Santos
City, and a business owner of Ryan's barber shop, stated among others in his
sworn statement that on November 21, 2022, at around 11:30 o'clock in the
morning, he was having a conversation with his wife when he saw the suspect
having an eye towards the targeted house owned by his neighbour, Chloe John
Bacho. He added that the suspect was holding a (1) one-litre plastic bottle of
nature spring water, which contained the flammable accelerant.
5. Aeron Christian Ramos, 40 years old, married, a resident at Unit 410, Purok 3,
Magaganda Street, Mahal Subdivision, Barangay Labangal, General Santos
City, and owner of a sari-sari store in the corner of their street, stated in his
sworn statement that he was about to leave the store when the bell rang, which
indicates that someone is going to buy something. He recognized the suspect,
Carlajel Gumboc, after she purchased 100 pesos' worth of gasoline. He went
on to say that the suspect put the gasoline in a (1) one-litre plastic bottle of
nature spring water. Ramos asked the suspect for what purpose the gasoline
would be used, and the suspect responded that it was to fuel up her
motorcycle.
6. Chloee John Bacho, 38 years old, married, and a resident at Unit 406, Purok 3,
Magaganda Street, Mahal Subdivision, Barangay Labangal, General Santos
City, and the owner of the burnt wood-framed, single-story, one-family
residence, stated in his sworn statement that after he retrieved the CCTV
camera footage, it was able to record the whole scenario on how the suspect
did its action to burn the house.
7. In addition, the CCTV analysis expert stated that the suspect, Carlajel
Gumboc, entered the gate in a swift move, causing no sound to attract the
attention of the members of the house. He then added that the flammable
accelerant (gasoline) was sprayed at the front door, backyard, entrance of the
back kitchen, and area where trash bags are placed. According to the video,
the suspect started the fire in the backyard with the yellow lighter before
slowly burning down the house. The suspect immediately ran through the open
gate, and the footage ended the moment fire reached the camera. This also
clearly shows evident premeditation on the part of the suspect to kill the
members of the household. Under Section 1 of P.D. No. 1613, it is essentially
the destruction of property by fire that is not under the circumstances
enumerated under Article 320 of the Revised Penal Code, as amended by R.A.
No. 7659. In prosecuting arson, whether destructive or simple, the corpus
delicti rule is generally satisfied by proof that a fire occurred and that it was
intentionally caused.
8. The lead investigator, Jefferson Largo, claimed that the fact that Carlajel
Gumboc left the subdivision empty-handed meant that she was aware of her
crime and that she should avoid being arrested when the PNP, BFP, and
ambulance sirens scream. Carlajel Gumboc was unable to deny that she was
the owner of the crime scene evidence as a result of the laboratory tests. She
left behind fingerprints, which were found on the gate, and saliva, which was
found on the terrace floor.

IV. DISCUSSION

9. As gleaned from the sworn statements of the eyewitnesses, they have properly
established the identity of Carlajel Gumboc as the one who set the house of
Chloee John Bacho on fire on November 21, 2022, at Purok 3, Magaganda
Street, Mahal Subdivision, Barangay Labangal, General Santos City. Being
best friends for so long has made them very sure that it was Carlajel who did
the crime. Collectively, their sworn statements have also proved that Carlajel
Gumboc planned to take the lives of Chloee John Bacho and his family by
setting the house on fire. Carlajel's plan was revealed when their common
friends learned about their verbal altercation after Chloee John Bacho rejected
Carlajel's request to borrow ₱100,000. Before the incident happened, Carlajel
poisoned Chloee's pet, a brown poodle dog, but the victim made an exemption
and decided not to sue Carlajel. It was all revenge for the suspect. All these
clearly show that there was evident premeditation on the part of Carlajel to
take the lives of Chloee and his family by setting the house on fire.

V. CONCLUSION

10. The undersigned therefore concludes that Carlajel Gumboc set the house of
Chloee John Bacho on fire with arson and evident premeditation.

VI. RECOMMENDATION
11. The undersigned strongly recommends that a case of Arson, defined and
penalised under Article 320 of the Revised Penal Code, as amended by R.A.
No. 7659 be filed against Carlajel Gumboc
