was not a Knight, and then only Barons were Knights. 2, The
Reddendo and Service in the Charter for the Lands is Servitium
dimidii militis. Nota. Knights Service was of Old in the
next Degree of Honour to that of an Earl. Therefore by the
English Laws Knights Service includes Homage, Fealtie, and,
for the most Part, Escuage, that is the Service of the Shield.
But this Service was after enlarged in the Time of Sir Peter
& Christian Valence his Wife only Heir to this AVilliam
Valence, and Panmore was made a Barony circa Annum 1240,
and of Old was counted One of the Three Baronys of Angus
which then were Ardbroth, Panmore and Plattoun, which last
belonged to the Earls of Crawford, and sometime after it was
counted One of the Three great Barronys in Angus, which
were ranked thus (forte metri gratia) Dun, Duddop and Pan-
more. The Barons of Panmore have been stiled in the Old
[pa^e475.] Writs Domini de Panmore as Sir Thomas Maule, yea, and once
One of Sir Peter Maule (The First Knight of the House) his
Successors is designed Nobilis et Potens Dominus. And ever

since this Sir Peter they were Knights,
same with Lords, yet equal to it. There is an old Evident
that designs the Lord Gray thus. Sir Andrew Gray Knight
Lord of Fowlis.
This Barony of Panmore contains not only the Lands of
Benvy and Balrudrie by Union, as above is said (albeit lying
in another Shire) but many other Lands and Towns in Angus
lying near to Panmore itself and in the Parishes of Panbryde,
Moneikie, Carmylie, Arbirlit, and of Old was a Fourty Pound
Land, which was very low, because it was long ago erected
into a Barony, and now some Parts of the Barony were sold
off. But many more Lands are lately acquired and joined
thereto, as is notour being conquest by Patrick the First Earl
of Panmore, ut infra. Page 320.
Panmore is the Name of the Barony of Old, and of the
Earldom thereof of late. It may be from the Old Irish
Language it should be called Thane-more, i.e. the chief and
principal Thane. As it is, Panmore is of the same Language.
More is a Lord or Master, and Pan is chief and principal, that
is the Over Lord or chief Lord And it seems the Old House

;
Thane of Glames had the Intromission with all that lies alonsc

Law) and the Third had the Charge betwixt Sid Law &: the
Sea, and that his chief Dwelling has been Panmore. Which
Thanes had the same Jurisdiction within their own Bounds
that now Shirefs and Stewarts have, and he who of Old was
called Ochiern or Abthane was either the Great Treasurer of
the Kingdom, or had the Office of Great Stewart of Scotland,
which Title now belongs to the Prince ; And it appears that
the Justice of the Shire or else of the Baronv has been mini-
strate at a Place in thisBarony called Law-Bothen And it ;
[pa^e478.] both it and the Castle of Panbride had been taken by the
English, and were cast down by them or the Governour after
the Battle of Panmore, as were others also, to wit, Kinclaven,
Kinnert' and Dunotter, which Battle was fought be East the
House of Panmore And, howbeit the same was repaired and
;
rebuilt after, yet all is now cast down, and the Old Castle was
made a Quarrv for building of the New House by George the
Second Earl of P;inmore about 20 Years ago.
The Castle and Barony of Panmore is conjectured to have
First belonged to some Person who had assisted Donald Bane
to usurp the Crown after King Malcolm Canmore's Death who
was forfeited by King Edgar the righteous Heir when he came
to the Crown, and then was given oft' by him in Heritage to
some Person of Note a Stranger who came from Enorland with
him and assisted him or else had come thence before with his
Mother ]\Iargaret and Agatha and Christian and Edgar, or
else they were then Crown Lands being a King's Castle, a
Thane's Residence for collecting the King's Rents, repress
Robbers and minister Justice to the People thereabout.
The old and First Possessors of the Barony & Lands of
Panmore, so far as we know or can learn, and of whom the
present Earl of Panmore is lineally and lawfully descended (as
I shall prove in the Sequel in the speciall following Genealogy)
Sir Peter whose Predecessors had gotten the same from King
Edgar with whom they came to Scotland, and did him good
Service with the Crichtons and Borthwicks who all Five got

Rollock had only Two Daughters, to wit, this Elizabeth

to Colles of Balnamoone, and therefore disponed
his Lands to the House of Duncrub. This Sir Thomas Maule
was dearly beloved of his Grand Father who infeft him in the
hail Barony of Panmore to be holden of the King. It is said
he was subject to Vermine. He took a Displeasure at John
Liddel of Panlathen, and burnt his hail Bigging, for which he
took a Remission under the Great Seal, and afterwards sore
repented the Deed and other Offences done in his Youth
against God and his Neighbours, and gave Gifts to Religious
Houses, and went in Pilgrimage to France to St. John of
Amiens in Picardie, and for that End got a Licence under the
Great Seal to go oft' the Kingdom. He obtained a Letter of

clear by a Service and Retour led before them in the Tolbooth

Strathachin of Balwissy was served Heir to Christian Gordon
his Mother in the Fourth Part Lands of Balmachie and Barn-

left him, and came Home. But Sir Alexander Guthrie, Pan-

We cannot learn the Name of this Gentleman (if he had

nor of his Successors after him for Three or Four Generations,
and herein even Tradition itself is faulty; For we hear no
more of the Family after King Malcolme and his Cup-Bearers
then till the Days of King William (the Fourth from him who
began to reign Anno 1165, and succeeded to King Malcolme
the Maiden his Brother.) In this King William's Reign

Buchannan & Drummond their Chronicles. As for our Valour
wee need no Catalogue of the Histories both at home and
abroad manifesting the Same So Clearly.
Because Mr. Mathew Lumsden hath given us no certantie
of the Originall of the Sirname of Forbes, But refers us to Mr.
Hector Boyes I will not take upon me positively to determin
the thing Only I will lay down before you Some old Tradi-
tion (how True I will not say) which we have from our An-
cestors time having worn out all Certantie And let the Reader
Judge and Choise which of them he thinks most Authentick.
Some do Report they came from France and that there is in
ane Shyre 80 Familys that Bears the Forbes's Arms Others
think those familys are Descended out of the House of Forbes.
Mr. Hector Boyis in his 14 Book Fol: 809 Says they were
changed from Boyis to Forbes for the Slaughter of ane Beast.

That his father was Justly Disherished And that David Earl

Earl of Crawfoord had Disherished his only Son for Crimes
that did Incapacitate him to Succeed It cannot be doubted he
Intended that Edzell Should Succeed to his Dignity As well
as to his Estate And it is a Mistake that the Earldom is not
Mentioned For in the Assignation to the Reversions In Anno
1541. which reversions were indeed the whole Estate, It bears
Expressly the Reversions of the Earldom And in the Contracts
and Bond Granted by David Master of Crawfoord it was All-
ways Acknowledged that the Earldom was disponed to Edzell.
But however this point is out of Doors for Edzell being heir
Male to the Earl of Crawfoord he Succeeds now to the Dignity
upon the failzure of the heirs Male of David Master of Craw-
foord. And it is a great Mistake that either Evelick or
Kilspindie are nearer in Blood And the Documents foresaid

Late Earl of Caithnes (To whom no Doubt he had some

Untenable And though all the Struglings imaginable was used
in the Matter And the Interest of the prerogative Alledged
for him and though he had the whole Estate and that the
true heir had no fortune Yet it was found that Such a
Resignation could not prejudge the Blood And therefore he
got the Title of Braid- Albion and the honours of the family

Andrew Lessly designed of Kilmanny his Estate and the

in the wrong in Asserting that George Lord Lessly Dominus

an Earl also. That what Shows plainly the Mistake and that
George Lord Lessly is not So Soon an Earl as the 1449 Is the
reduction of the Earldom of Marr from the Lord Erskine at

date the 5*^ November 1457. So that its plain that neither
Rothes nor Marishall are then Earls but in Quality of Lords
and Barons of Parliament. I apprehend that for the Merit
of that Service to the Croun in that Batle Marishall and
Rothes have upon that been Created Earls. It may be indeed
that Huntly Alexander Lord Gordon might have been Created

then in the 1451 There is in the Foedera a Safe Conduct to him as

time after his Brother And I find Earl George his Son getting
a Charter from the Croun in the 1517. Probably then come
up to be a man of whom there has been So much work about
his Marriage.
There is a Charter in the Earl of Rothes's hands by Alex-
ander Seaton of Meldrum to William his Son and heir Apparent
and Elizabeth Lessly his Spouse in 1490 I apprehend She has
:
George The first Earl of Rothes has lived long we See he is [p^ge383.]

whom I have not Seen married till the 1487 to William Sin-
clair of Newbrugh Eldest Son and heir Apparent to William
Earl of Orkney and Caithnes and mother to Henry the first
Lord Sinclair.
This George the 2^ Earl of Rothes is Alive in the 1511
August 17 when William Lessly brother to the Earl of Rothes
gets a Charter under the great Seal of Easter Futhess in the
Shyre of Forfar He has died Soon after & was Succeeded by
his Brother This
William Earl of Rothes the 3^ and youngest Son of Andrew
Master of Rothes was his brothers Successor in the Estate and
honour of the Earldom of Rothes but he has enjoyed it but a
very Short Whyle for in about two years thereafter he was
Slain at Flouden and had Issue that I have Seen.

he gets a Charter of Lands from the Croun in the Barony of

See plainly that upon the death of John Earl of Huntington
the Bruces have got the Superiority of the Lands of Lessly
and that this Alfornus is the Son of Norman the Son of
Malcom the Son of Bartholph and had not as yet Assumed
the Sirname of Lessly from their Estate but are all of them
Successively designed Patronimically by the Name of their
father and that in the Reign of King Robert the first the Sir-

oppinion it was no Sooner than the Son of this Alfornus that
first took the Name of Lessly from his oun Lands and Estate

Bisset his wife married the Eraser for her Second husband and
that her Son Sir Patrick Grahame dvino^ the Children of her
Second husband the Erasers Succeeded to the Estate of the
house of Lovat. But it is much more Likely that Sir Davids
daughter or his Grandchild Sir Patricks Daughter married Sir
Simon Eraser of Kinell who was a Branch of the family of
Eraser Tho by the most exact Rules of Cronologie She has
- been Sir Davids Daughter and Sister to Sir Patrick Since the
heir of the Marriage.
Hugh Ekaser of Lovat does homage to the Bishop of
Murrav in the 1369 and is then Portionarius de Ard. That
which Confirms this Succession much Is that the Davoch Land
of Colcovie pertained to Hugh Ross and Mary de Bosco his
wife which they had in Tack and Assidation of Sir David
Grahame as appears by the Contract yet Extant in Kilravocks
Charter-chest dated die ^'eneris in festo Annunciationis Beatae
Virginis Mariae Apud Lovat in Anno 1294.
But I See no Inconsistency but that it may be Sir Patrick
Grahams daughter that might have married Eraser.

had no heirs Male but Daughters Elizabeth who was ^larried
to Alexander de Strevelyn. There is in the Charter Chist of

Lands of Kilravock in favours of William Ross of Kilravock of
the Lands of Kih'avock dated Die Dominico post festum Sancti

made in favours of the Said William Ross of Kilravock by
Nicolas de Carrick and Johanna his Spouse another of the
Daughters and heirs of Sir John De Bosco. This is likewavs
the predecessor of Nicolas de Carrick progenitor to the Earl

to the Cronology it Suits much better with the time to be the

Dificulty is that the time will not allow Thomas Dunbar Earl

James Dunbar of Frendraught who came to be Earl of Murray
might marry a Daughter of Alexander Seaton of Gordon who
is married to his wife the time he gets the ward in 1408 But
that can never hit with Thomas Earl of Murrays wife for a
woman who cannot be born till the 1409 the year after her
father and mothers Marriage cannot be called well his Espoused
wife in the 1422 She may be then Indeed thirteen years of Age
and may be Espoused wife to him and he might have after that
the two Daughters But I Say be they Children of Thomas or
James Earl of Murray its plain they are brother and Sisters
Westfeild and the Countes of Murray as She calls her Self in
Westfeilds Charter but really I think they have been most
probably the Children of Thomas. And Mr. Tait who Saw
the Writes told me it was Alex'^ Dunbar of Westfeild that was
Son to Thomas and not James Earl of Murray by Isobell of
Innes and really the time and the Cronology agrees much
better with their being the Children of Thomas Earl of Murray
than of James of whom I never Saw the least V^estige but the
Retour of Lovat in the 1430 of Lands held of James Earl of
Murray who died that year Circa Festum Sancti Laurentii 1430.
Its really So by concurring Circumstances of Cronology That
Alexander Dunbar of Westfeild was the Son of Thomas Earl
of Murray by Isobell Innes and not of James. He afterward
Married a Lady who is in the 1422 Called his Espoused wife
by whom he had two Daughters Janet called Countes of

Ceres, and Decreet following thereon against Isabel Lady of
Craighall, and Andrew Kinninmond is bound to pay William

George Clapane of Carslogie is one of two Cautioners bound

Notwithstanding this Agreement the Chaplainry seems still
subsisted, for one Thomas Baldy was infeft in it 14*^^ May

Jonet Clepane and had Children by her, but the Marriage
had been dissolved because they were found to be related in
the fourth degree of Consanguinity and Affinity by Sentence
of the Church, from which Sentence William Archbishop of
St. Andrews as the Pope's Legate absolves them and dispenses
with any defects in the Marriage, and declares the Children
lawful whether born or to be born. The Seal at this is fair
and clean and neat and 'tis signed by the Archbishop and his
Clerk of Court.
