Rest & Meal Break Requirements
• WIS complies with all applicable federal, state and local laws regarding Rest and Meal Breaks.
Employees will be notified during each event of the time and length of their break.
• All hourly and salaried non-exempt employees are provided with a Rest Break and/or Meal Break
dependent upon the length of the Work Period in which they are working, including work time
spent on non-counting tasks.
• During inventory events with employees from multiple States, the State policy with the most
employee-friendly Rest Break and/or Meal Break policy must be followed.

Rest & Meal Break Compliance
• All employees must be provided with Rest and/or Meal Breaks dependent upon the length of the
event or work period
• Rest and Meal Breaks should be incorporated as part of the overall flow plan for the inventory or
work period
• Rest Break – A 10 minute non-working period of paid time
• Meal Break – 30-60 minute period of non-working unpaid time
• Employees must be relieved of all duties during Rest and Meal Breaks

California Rest & Meal Break State Requirement
Upon employee request and supervisor approval,
California law allows an employee to waive only
one Meal Break per Work Period.
The 1st Meal Break may be waived if the
employee does not exceed 6.0 hours worked
in one Work Period.
Employees may request to waive the 2nd
Meal Break if they did not waive the first
Meal Break and the Work Period can be
completed in 12 hours or less.
