Contract of Lease
IMELDA T. ALBERTO, of legal age, married, Filipino and residence and postal
address at 119 Saluysoy Road, Brgy. De Ocampo, Trece Martires City, Cavite, hereinafter
reffered to as the “LESSOR”;
-and-
APENG’S IHAWAN, a duly organized entity under the existing Philippine Laws, in this
act represented by JAMES SMITH T. COLORADO and ROMMEL M. TIBAYAN, of legal
ages, Filipinos and both resident of Brgy. Luciano, Trece Martires City, Cavite hereinafter
reffered to as the “LESSEE”;
WITNESSETH
That the LESSOR is the registered owner of a parcel of land together with the
improvement thereon, located at 330 Tanza-Trece Martires Road, Brgy. Paradahan I, Tanza,
Cavite containing an area of One Hundred Seventy-Seven (177) sq. mtrs;
That the LESSEE above-named is desirous of leasing the above- described commercial
property under the following terms and conditions hereinafter provided.
NOW THEREFORE, for and in consideration of the mutual covenants and stipulation
hereinafter forth.
1. PERIOD OF LEASE- this lease shall be continuously rent without period
starting February 14, 2023 to February 14, 2026.
2. Rentals- the LESSEE shall pay LESSOR a monthly rental for 1 unit of the
total amount of FIFTEEN THOUSAND PESOS (Php, 15,000.00) Philippine
Currency, not later than 10th of every month.
3. Upon the execution of this Contract LESSEE shall pay to the LESSOR ONE
MONTH ADVANCED AND TWO MONTHS DEPOSIT the total amount of
TWENTY THOUSAND PESOS (Php 45,000.00) Philippine Currency which
amount shall be refunded to the LESSEE by the LESSOR at the termination
of the LEASE, if no used as rental payments, Said deposit shall likewise
guarantee the LESSEE’S obligation under the lease contract for all physical
damages to the lease premises caused by the LESSEE members of her staff,
household members or guest LESSOR;
4. The LESSEE shall inform the LESSOR or her representative and discuss with
her and other obligation which the LESSEE may incur this Contract;
5. USE OF LEASE UNIT- the lease unit shall be exclusively as FOOD AND
BEVERAGES, of the LESSEE and she shall not sublease or assign to
anymore, the whole or part of the unit without the prior written consent of the
any damage and/or any ordinary or necessary repair that has to be made on the
leased property;
6. The LESSEE shall not introduce any improvement or alteration to the leased
property without the prior consent of the LESSOR. Any cabinet installed or
mounted on the wall shall not be removed but shall remain in the leased
premises upon termination of the leased contract. LESSEE is further strictly
prohibited from nail holing any portion of the wall;
7. The LESSEE is not allowed to sublease the leased premises or any portion
thereof, without the express consent of the LESSOR nor is LESSEE allowed
to keep in the premises additional occupants;
8. This Contract shall be binding upon the parties, their heirs and assigns;
NOW, THEREFORE, the parties do hereby bind themselves to faithfully abide and fulfill
the duties and obligations heretofore agreed upon.
IN WITNESS WHEREOF, the parties hereto have signed these presents on this
day of 2023 at Trece Martires City, Cavite

ACKNOWLEDGEMENT
Know to be the same persons who executed the foregoing instrument and they
acknowledged to me that the same is their true act and deed.
The foregoing instrument related to a Lease Agreement consisting of three (3) pages
including the page on which the acknowledgement is written, is assigned a the left-hand margin
on each every page thereof by the parties and their instrument witnesses.
