TERMS & CONDITION

• Rental rates are based on 8 hours per day rental with operator and without diesel. Operation
in excess of minimum hours will be charged accordingly to its hourly rate.

• REGULAR OPERATION TIME: 8 hours/day.

• IDLE TIME: Six (6) hours per day, use or no use. Due to natural disaster, accidents, labor strikes,
work stoppage, unsafe and non-workable site conditions or practices, etc.

• DOWN TIME: No rental charges for equipment repairs down time.

• Same Terms shall also apply to contract extension/s or renewal/s

• Hire of equipment/s starts on arrival of unit and finishes after leaving the jobsite.

• PAYMENTS TERMS:

• Required Purchase Order and /or Conformity to this Proposal.

• Cash payment of rental is required before mobilization of equipment.

• Same Terms shall also apply to contract extension/s or renewal/s.

KNOWN ALL MEN BY THESE PRESENTTS:

This is a lease agreement made in Cagayan de Oro City Philippines, this day of between
FJQ CONSTRUCTION represented by , of legal age,

the lessor.

WITHNESSETH

I. WHEREAS the Lessor is the supplier of BACKHOE (YANMAR) VIO55 with BREAKER more
particular described as follows:

II. WHEREAS the lessor leases to the lessee above- described equipment under the terms and condition
hereinafter
provided:
1. That this lease contract shall commence on , until Activity is finished.
2. That the lease shall pay the lessor amount of eighty thousand pesos(PHP 80,000.00)
serve as Down payment for 50 hours use for the rental equipment.
3. That the Lessee shall pay the lessor the amount of N/A for mobilization and demobilization of the
equipment.
4. That the lessor shall provide the fuel,
5. That the lessor shall provide all the necessary PPEs for the operation.
6. That the lessee shall provide the operator(s) and service men of the above-mentioned unit,
adequate lodging.
7. That the lessee shall be liable for whatever damages may arise/incurred while equipment is on
operation, at the site, used or unused.
8. That the lessor has the right to stop the operation and pull out the equipment at Lessee's cost if
the unit is subjected or used for a task inappropriate for its intended design and capacity.
9. That the lessee must supervise for the safety of the unit while on a period covered by this
contract. Lessee shall be held accountable for Terrorism, Theft, and any loss, wreckage, of the
equipment caused by nature of the work and utilization beyond the equipment's capacity caused
by acts of nature or force majeure.
10. That only the designated operator of the Lessor shall operate the unit.
11. In the event that the Lessee pre-terminate the lease without the fault of the Lessor, any rentals
paid shall be non-refundable
12. For extensions and renewal, payment must be settled prior to the start of operation.
13. Strictly payment is non-refundable once the equipment has arrived to the jobsite/Area
