CITIZENS’ CHARTER – 2023

1.0. Introduction

Public Works Department functioning as the parent department for

all the engineering departments since 1858. This department with its
unparalleled engineering construction expertise rendering services to the
people by the way of developing State infrastructure for the period of
165 years. The Public Works Department adopts latest scientific and
modern technologies and follows the specifications of the Bureau of
Indian Standards and National Building Code to ensure that the buildings
are structurally sound and safe.

More than thousands of Government buildings for Hospitals, Medical

Colleges, Education Institutions, State-District level Offices including
Collectorates are being constructed by Public Works Department.
Construction of Monuments and Memorials for freedom fighters, eminent
scholars, etc., stands as testimony for engineering expertise of Public
Works Department.

Being a part of growth of the State’s economy, Public Works

Department is constantly striving to make innovations in building
material technology and construction activities for creating sound capital
assets and paving way for sustainable development.

2.0. Mission

• Creation of capital assets in the shape of building infrastructure and its

maintenance which is the prime objective of the Department.

• Heading towards e-Governance initiatives such as end to end

computerization for better administration and transparency.

• Research in the Material Technology and Construction Methodologies

by using alternate materials for optimum utilization of resources,
safety and to prevent environmental degradation.

• Preserving the historical and cultural values by restoration, renovation

and conservation of heritage buildings and monuments.

 • Making a secure civil and electrical arrangement in connection with the
VVIP visits and important Government events.

3.0. Vision

• To make Tamil Nadu self-reliant by improving building infrastructure of

the State to cater to the needs of people of the State.

• The entire department activities for an entrusted construction work

from commencement to completion are being computerized with the
assistance of Tamil Nadu e-Governance Agency. The phases of
workflow will be updated from the site and verified by the competent
authority for improving the administrative efficiency.

• Ensuring transparency and better governance through complete

digitalization and providing seamless information about the activities of
Government to the people.

4.0 Activities of the Department

The prime activity of the Public Works Department is construction and

maintenance of the various Government buildings such as Hospitals &
Medical Colleges, Court Buildings, Collectorates, School buildings, Hostel
buildings and other Department Office buildings. In addition, the
following activities are being carried out by this department: -

▪ Maintenance of Secretariat building in Chennai.

▪ Maintenance of Raj Bhavan buildings in Chennai and

Udhagamandalam.

▪ Maintenance of Hon’ble Judges Bungalows, Hon’ble Ministers and

VVIP’s Bungalows, Inspection Bungalows, Circuit Houses, and other
Government buildings.

▪ Execution of Externally Aided Government Medical College Hospitals

Projects.

▪ Execution of Deposit Works for Quasi-Governmental, Societies, Private

Sector, Industries, etc.,

▪ Execution of works under Constituency Development Fund of Member

of Parliament and Member of Legislative Assembly as deposit works on
request of the District Collector.

▪ Stage Erection, barricading works, providing Public Address System
and security lighting arrangements in the event of VIP and VVIP’s
visits and also issue of stability certificate for the above arrangements
made for the public meetings.

▪ Valuation of buildings referred by the Judicial and Vigilance and Anti-

Corruption Departments.

▪ Issue of the structural stability certificate for Cinema theatres,

Schools, College buildings and other buildings referred by the
Government, Judicial and Police Departments.

▪ Issue of reasonableness of the Rent certificate for the private buildings

occupied by the Government offices.

▪ Annual revision of Standard Schedule of Rates, Plinth Area Rates for

buildings and Plinth Area Rates for rental valuation.

▪ Issue of Valuation Certificate to the Buildings requested by the

Government / Police authorities.

▪ Approval of New Products (both civil and electrical) used in building

construction through the Assessment Committee.

▪ Issue of the “Product Quality Approval Certificate” to the Crushed

Stone Sand (M-Sand) Manufacturing Units for their M-Sand products
throughout Tamil Nadu.

▪ Providing Quality Testing of Building Construction Materials in the

Laboratory.

▪ Providing consultancy services such as preparation of structural design

& drawings, detailed estimates received from departments or agencies
such as Hindu Religious & Charitable Endowments, Tourism
Department and Archaeology Department, etc.,

▪ Providing Technical Guidance / Training to the Engineering students

from various Engineering Colleges for the technical enrichment of their
knowledge.

6.0 Services to the Government Departments :

7.0 Procedures for commencement of building works

Based on the request of the above departments for their new buildings,
detailed plans and estimates are prepared based on the Standard
Schedule of Rates of the prevailing year and sent to the Government for
obtaining necessary Administrative and Financial Sanction. After
obtaining the sanction from the Government and settling agency by
calling for tenders, works are executed by this department.

8.0 Services regarding Tenders for execution of works by Public

Works Department

This department follows Tamil Nadu Transparency in Tenders Act, 1998

and Tamil Nadu Transparency in Tenders Rules, 2000 in publication,
evaluation, finalization and award of contracts to the registered eligible
contractors of Public Works Department for execution of the construction
works.

8.1 Registration of Contractors in Public Works Department

The rules for the Registration of contractors for undertaking Government

works are available in Appendix XXIII of Tamil Nadu Public Works
Department Code. As per G.O. (Ms) No.195, Public Works (G2)
Department, dated 14.12.2021, registration of contractors for all classes
shall be done by the Chief Engineers of Public Works Department.

Classification of Contractors:

In G.O.(Ms)No.37, Public Works (G2) Department, dated 17.06.2022,

sanction has been accorded for inclusion of a new Category of contractor
viz., Class-IA, for revision of monetary limit for categories of Registration
of contractors and for fixation of percentage value for Solvency
Certificate for Registration of contractors as detailed below: -

* In respect of Class-IV contractors, the amount of

Solvency Certificate shall be fixed at Rs.10.00 lakh
instead of Rs 7.50 lakh.

** In respect of Class-V contractors, i.e, Upto Rs.50.00

lakh, the Solvency percentage proposed to be fixed at
15% of the value for which the contractor submits
application for registration. For example, if a contractor
submits application for registration for a value of
Rs.20.00 lakh under Class-V, the solvency percentage at
15% of that value works out to Rs.3.00 lakh.

Registration Fees to be paid in E-Challan.

Essential qualifications for Registration as Contractors:

▪ Income Tax Return Filed with Income Tax Department with

Permanent Account Number (PAN).

▪ Goods and Services Tax Identification Number “GSTIN”.

▪ Financial capacity to execute works, for which Certificate on cash

transaction with the Bank for the past one year.

▪ Experience in the building construction activities as per class

specified.

▪ Tools and Plants available with them.

▪ Technical Staff available with them for works supervision

▪ The promotion to the next class shall be based on solvency

certificate produced with the experience and past performance.

Documents to be enclosed with application

For availing the services, Public can submit filled in application along with
the copies of documents viz. attested copy of solvency certificate for the
required value, Encumbrance Certificate, experience certificate,
evidences of Income Tax Return filed, GST Registration Certificate,
Details in support of financial capacity, Details of Manpower and
Machineries available with them, etc., and originals of such document
shall be produced for verification by the Superintending Engineers /
Executive Engineers as the case may be.

 Rejection of application

The registering authority is delegated with the powers to reject any

application received for registration. But, while doing so, he shall issue a
show-cause notice to the applicant, stating briefly the reasons for
rejection, i.e., if required solvency, Experience, Balance Sheet not
produced by the new contractor.

Demotion of Class

The registering authority may demote a contractor, to a lower class. The

registering authority may also consider application for reinstatement duly
obtaining explanation on merits.

Non-discrimination and accessibility

The Superintending Engineers and the Executive Engineers shall act in a

non-discriminated manner as per the guidelines issued from time to time
by the Government.

8.2 Procedures for Issue of Tender Schedule :

Information

The required documents for tendering will be issued then and there by
tender inviting authorities for the work of construction or maintenance of
buildings.

Standards of service

The availability of this service will be intimated to the citizen in the

following mode:-

• By publishing the tender notice in the Daily Newspapers both in

Tamil & English and in designated Government Website in
accordance with the guidelines issued by the Government.
• By publishing the tender notice in the weekly Tender Bulletin
published by the Director of Information and Public Relations,
Secretariat, Chennai or bi-weekly Tender bulletin published by the
Public Relation Officer in Districts in the Local areas according to the
value of works.

• By displaying the tender notices in notice board of the respective

Public Works Department Offices.

• Issuing tender notice by post to the registered contractors, on

request along with stamped self-addressed envelope.

 Choice and Consultation

The details of this service are availed from the Tender Inviting Authority.

Grievance Redressal regarding Tender

Grievances can be solved by contacting the respective Tender Inviting

Authority.

Cost

After knowing of the information of Tender notice, the contractor should

give a written request for the tender schedule of the specified work, for
which he wishes to participate in tender along with the challan / demand
draft for the cost of Tender documents. The tender schedule will be
issued to the contractor on receipt of the requisition with cost.

The mode of payment and cost will be informed in the notice inviting
tenders, depending on the value of the works to be executed.

As per G.O. (Ms.) No.91, Finance (Salaries) Department, dated

23.03.2010, the tender schedule can be downloaded by the contractor
free of cost in website https://tntenders.gov.in for the works costing
above Rs.25.00 lakh.

Invitation of Tenders

As per Rule 20 of the Tamil Nadu Transparency in Tenders Rules 2000,

the Tender Inviting Authority shall ensure that adequate time is provided
for the submission of tenders and a minimum time is allowed between
date of publication of the Notice Inviting Tenders in the relevant Tender
Bulletin or in the newspapers whichever is later and the last date for
submission of tenders. This minimum period shall be as follows:

▪ 15 days for Tenders upto Rs.2.00 Crore in value.

▪ 30 Days for Tenders in excess of Rs.2.00 Crore in value.

8.3 Time limit for finalization of Tenders :

As per G.O. (Ms.) No.873, Public Works Department, dated 04.05.1982

and G.O. (Ms.) No.49, Finance (Salaries) Department, dated 11.09.1998,
the following time-limit should be followed in processing tenders and
submitting to approval authority:-

 ▪ The Superintending Engineer shall scrutinize and submit the tender
proposals to the Chief Engineer within 15 days from the date of
receipt of tenders.

▪ The Chief Engineer shall also scrutinize the tender which requires
Tender Award Committee approval and submit them to the Tender
Award Committee within 7 days from the date of receipt of tenders
from the Superintending Engineer.

▪ The Tender Award Committee shall take a decision on the award of

tender within a period of one month.

8.4 Validity of Tenders:

As per Tamil Nadu Transparency in Tenders Rules 2000, the tender

documents are valid for the initial period of 90 days and the tender
Authority is empowered to extension of the validity of tenders not
exceeding 180 days.

8.5 Time limit for execution of works :

Guidelines have been issued in the Chief Engineer (Buildings), PWD.,

Chennai letter No. HDO (A) / 24179 / 2002-1, dated 22.04.2002
regarding the time limits for period of execution of building works from
the date of handing over of site till the last date of completion of work by
contractor. The details are as below:

The above time limit can be modified due to unforeseen contingencies,

but with the approval of higher authorities only.

For the buildings where the plinth area exceeds 2500 sq.m. (special
type) the time limit can be fixed with the approval of the Chief Engineer.

9.0 Other Services :

9.1 Issue of Structural Soundness certificate for New Cinema

Theatres

As per G.O. (Ms.) No. 972, Public Works Department dated 13.07.1992
and Tamil Nadu Cinemas (Regulation) Rules 1957, the Public Works
Department, Planning and Designs Circle issues Structural Soundness
Certificate to Cinema Theatres.

The request for issue of Structural Soundness Certificate for Cinema

Theatres is received from Commissioner of Police for Chennai and the
District Collectors for other districts who are the licensing authorities.

Upon receiving the request, the Superintending Engineer, Planning and

Design Circle, based on his site inspection scrutinize initial proposals
before the construction and completion plans after the construction of
new Cinema Theatres / Multiplex Cinema Theatres with shopping malls
and send the plan recommendation, with Structural Soundness
Certificate of the Public Works Department to the License Issuing
Authority for approval. The certificate is issued within 30 days from the
date of application.

Issue of Structural Stability Certificate for Old Cinema Theatres

Structural Stability Certificate to the cinema theatres which are more

than 50 years old are issued by the Superintending Engineer, Public
Works Department, Planning and Design Circle, Chennai-5 after site
inspection. The certificate is issued within 30 days from the date of
application.

For Cinema Theatres which are less than 50 years old, after site
inspection Structural Stability Certificate are issued by the respective
territorial Divisional Officers after authorization of the Superintending
Engineer, Public Works Department, Planning and Design Circle, Chennai.

The fees collected for issuance of Structural Stability Certificate for the
Cinema Theatres shall be collected as per G.O.(Ms).No.1283, Home
(Cinemas-II) Department, dated 23.08.1993 and G.O.(Ms).No.181,
Public Works (G2) Department, dated 16.05.2003 and based on Tamil
Nadu Civil and Criminal Court Manual.

9.2 Recommendation of Board of Engineers for the inclusion of Private
Engineers in the District Panel of Private Practicing Engineers:

As per the Tamil Nadu Public Building (Licensing) Act 1965 & Tamil Nadu
Public Building (Licensing) Rules 1966, panel of District level Private
Practicing Engineers are approved by the Board of Engineers of Public
Works Department.

The application for inclusion in the panel of private practicing Engineers to

be sent to the District Collector concerned. The Collector in consultation
with the Superintending Engineer of the territorial jurisdiction concerned,
forward the application to the Engineer-in-Chief and Chief Engineer
(General), Public Works Department for obtaining approval from the Board
of Engineers.

The interview is conducted within 30 days by the Superintending

Engineer, Public Works Department, Planning and Designs Circle, Chennai
on receipt of application from the Engineer-in-Chief and Chief Engineer
(General), Public Works Department, if the applicant has requested for the
1st District as a Private Practicing Engineer.

If the applicant requested for the subsequent 2nd District and so on, the
Application will be forwarded to the Board of Engineers for approval. After
approval it will be communicated to the District Collector concerned to
publish in the District Gazette.

9.3 (i) Approval of Construction Materials / Construction

Techniques

The Assessment Committee

In G.O.(Ms) No.106, Housing Department, dated 06.03.1975 orders have

been issued for the constitution of an Assessment Committee to evaluate
the innovations in the use of materials and construction techniques, with
representatives from various institutions.

At present, the Committee functions with the Engineer in Chief, Public

Works Department as Chairman and Superintending Engineer, Public
Works Department, Planning and Designs circle as Member Secretary with
members from Anna University, Indian Institute of Technology, Bureau of
Indian Standards, Structural Engineering Research Centre, Tamil Nadu
Housing Board, Tamil Nadu Urban Habitat Development Board, Tamil Nadu
Police Housing Corporation, Tamil Nadu Electricity Board, Directorate of
Technical Education, Military Engineering Service, Chief Architect-Public
Works Department, Institution of Engineers and Builders Association.

The meeting of the Assessment Committee meetings are convened atleast
4 times annually by Planning and Designs Circle and Tamizhaga Arasu
Building Research Station, Chennai.

Details required for approval of the Construction Materials:

The Manufacturer of the product should submit documents along with the
following details:-

• General Profile of the Company, Manufacturing and Distribution

Facilities
• Bureau of Indian Standards (BIS) License / ISO Certifications
• Test Reports for products from two different Government / BIS
approved Private Laboratories.
• Technical specifications of the products
• Product Approvals already available / Performance Certificates /
Purchase Orders
• Method of Applications of the product in the construction
• Price List
• Any other details required by the Department

Along with above details, the assessment fee of Rs.10,000/- per product
should be remitted in the form of Demand Draft in favour of the
Executive Engineer, Tamizhaga Arasu Building Research Station, Public
Works Department, Chennai.

Basis for approval of the product and issue of the approval

certificate:

The Committee examines the product details based on the License from
Bureau of Indian standards and Test reports from the Central / State
Government Laboratories and (or) Bureau of Indian Standards approved
Private Laboratories to approve the product.

(ii) Approval of Crushed Stone Sand for Concreting / Plastering

The process followed in Public Works Department for the grant of product
approval certificate for crushed stone sand involves (a) Submission of
Application by the manufacturing unit with all statutory documents
pertaining to the manufacturing unit and the quarry from where the raw
materials are procured. (b) Inspection of the manufacturing unit and
freezing of samples by the PWD Officials for Testing purpose. (c)
Submission of Test reports and payment of assessment fee of
Rs.10,000/- per product (d) Conducting Assessment Committee Meeting
(e) Approval and Certification.

 The Product Approval Certificate is issued by the Chairman of the
Committee within 30 days from the date of approval of the Minutes of
the Assessment Committee meeting. The Product Approval Certificate is
valid for three years. The Manufacturer should apply for renewal of
certificate with assessment fee of Rs.5,000/- per product after expiry of
validity of the certificate.

9.4 Laboratory Tests on Construction Materials by Tamizhaga Arasu

Building Research Station :

The quality tests on Cement, Steel, Aggregates, Bricks and Concrete are
conducted in the Laboratory as per the Bureau of Indian Standard codal
provisions by Tamizhaga Arasu Building Research Station, Taramani,
Chennai at the nominal charges as prescribed vide G.O.(Ms)No.97, Public
Works (G1) Department, dated 03.06.2011 and G.O.(Ms)No.181, Public
Works (G2) Department, dated 16.05.2003. The materials shall be tested
within 7 days from the date of receipt of samples. The test reports shall
be issued within 3 days from the date of completion of tests.

9.5 Issue of Reasonableness of Rent Certificate for private buildings:

Public Works Department issues Reasonableness of Rent Certificate to

the private buildings occupied by various Government offices. The
Executive Engineers concerned are empowered to issue Reasonableness
of Rent Certificate upto the plinth area of 1000 Sq.ft and above that the
Superintending Engineer shall issue the Reasonableness of Rent
Certificate in corporation limits. The certificate is issued within 15 days
from the date of application.

9.6 Issue of Stability Certificate to Stages for public meetings:

The organizers, conducting the public meeting attended by V.V.I.Ps, can

request for the stability certificate for the stages from the Executive
Engineers concerned. The stability certificate shall be issued before the
commencement of meetings.

9.7 Issue of Structural Stability Certificate to the Public buildings:

The owner of the buildings like private school buildings, college buildings,
and any other buildings being used or intended to be used as a Public
buildings etc., seek the service from Superintending Engineers of Public
Works Department, so as to obtain License from the authorities
concerned. In general, this certificate is issued on payment of centage
charges. The certificate is issued within 30 days from the date of
application.

9.8 Deposit Works :

The Department undertakes Deposit works for the Quasi-Governmental

Organizations, Private Sector and Societies, based on their request. For
this, centage charges will be collected at a fixed percentage of the value
of the works as per G.O.(Ms) No.181, Public Works (G2) Department,
dated 16.05.2003. Exemption of Centage Charges for the Member of
Legislative Assembly Constituency Development Scheme and Member of
Parliament Constituency Development Scheme and Ex-Servicemen
Welfare Department.

9.9 Technical Assistance:

Public Works Department imparts technical guidance and training to the

students from various Engineering Colleges to enrich their technical
knowledge and career growth.
National Apprenticeship Training Scheme:

Students who have studied Diploma / Graduates in Civil / Electrical /

Electronics Engineering can apply for 1 Year Apprenticeship Training in
Tamil Nadu Public Works Department under the National Apprenticeship
Training Scheme in https://portal.mhrdnats.gov.in.
9.10 Providing Information under Right to Information Act, 2005

Those who are seeking information under the Right to Information Act,
2005 can approach the Public Works Department authorities of respective
jurisdiction. The list of Public Information Officers and the Appellate
Authorities are furnished in Annexure-II.
