FACULTY AND STAFF CLUB

CONSTITUTION and BY LAWS


(Revised January 19, 2016 from the CONSTITUTION and BY LAWS dated October 21, 1997)

PREAMBLE

WE, THE TEACHERS AND THE EMPLOYEES OF DR. VICENTE F. GUSTILO MEMORIAL NATIONAL HIGH
SCHOOL IN THE CITY OF CADIZ, NEGROS OCCIDENTAL, imploring the aid of the Almighty God, in order to
have a closer understanding and mutual maintain the high standard of the teaching profession and
ameliorate our economic condition as well as our social standing in the community, do organize
ourselves into a club and hereby adopt this CONSTITUTION AND BY LAWS.

DECLARATION OF PRINCIPLES

I – The welfare of each member shall be the prime duty of the club.
II – The club shall establish a mutual a mutual aid plan, a hospitalization or medical loan and subsistence
benefit to ensure a decent standard of living among its members.
III – The club shall assure the rights of the members to air grievances and to stand firmly to uphold such
rights.
IV – The club recognizes the principle of harmonious rapport between the club and the administration.
V – The club shall establish a sustainable development program for the common good, protect the rights
and promote the welfare of the DVFGMNHS.
VI – The club after exhausting all venues of compromise shall by a vote of two-thirds of all its members
have the right to declare a strike until such matter is resolved.

Article I
Name of the Organization

The name of the club shall be the DVFGMNHS FACULTY AND STAFF CLUB or FASC with postal address at
DVFGMNHS, Cabahug Street, Cadiz City.

ARTICLE II
MEMBERSHIP

Section I – Permanent, substitute, provisional teachers and office personnel who are actually rendering
service to DVFGMNHS, Cadiz City, shall be the members of the Faculty and Staff Club, one should pay his
dues on time as prescribed.

a. Coverage for the substitute teachers shall be the inclusive dates of his/her service.
b. An employee or a teacher to become a member of the club must at least serve the club for not less
than 10 years in order to avail of the retirement benefit.

b. Each teacher member and employee will be provided with a certificate of membership signed by the
president at the start of membership so that his/her membership to the club be legal and binding.

ARTICLE III
FEES AND DUES

Section I – To become a member of the club, the following fees shall be paid;
a. a P100.00 membership fee for new members
b. a monthly due of one hundred pesos (P 100.00) provided all other requirements for admission are
complied with.
c. a monthly fifty pesos (P 50.00) for special purpose fund
d. P 4,000 lifetime membership.

Article IV
THE OFFICERS

Section I – The governing body of this club shall be the officers of the Faculty and Staff Club duly elected
on its general meeting and as such shall have the general power conferred upon it by the constitution
and by laws.

a. The officers shall be elected from among the members of the club.
b. The officers shall continue to serve a term of 2 years and shall continue to serve until their successors
shall have been duly elected and qualified.
Section II – QUALIFICATIONS
a. Any member who had served the club for two years is eligible to become an officer.
b. A member who has a pending application for retirement is ineligible to be an officer.

Section III – VACANCIES


a. The office of the president shall be filled by the Vice President in case of vacancy.
b. In case of vacancy of any officers, the president shall appoint with the concurrence of other officers
from any member thereof and shall serve until such term expires.

Section IV – REMOVAL AND SUSPENSION OF OFFICERS


a. Any officer of the club shall subject to suspension at any time with a cause provided that no less than
two-thirds (2/3) of the members of the club shall vote in favor thereof.

b. The following are grounds for suspension;


1. Three consecutive absences in the officers meeting without valid reason;
2. Three consecutive absences in the General Assembly Meeting without valid reason;
3. Non-compliance to the task assigned on him/her

Section V – All officers except the president of the club shall be eligible for election for more than two
consecutive terms.

ARTICLE V
DUTIES AND POWER OF THE OFFICERS

Section I – The president shall have the general powers and functions pertaining to such office and
particularly the ff:

1. To execute all lawful orders and resolution of the Faculty Club and the mutual aid plan.
2. To execute bond, mortgage and other contract authorized by the Faculty Club.
3. To submit to the Faculty Club through the secretary an annual report of the activities of the club.
4. To call an emergency meeting as the needs arise.
5. To render financial report on the status of the Faculty Club and of the mutual aid plan through the
treasurer.
6. To sign all disbursement and withdrawal from bank deposits of the Faculty Club.

Secton II – The vice president shall succeed the president in case of the office of the latter is vacant. He
shall perform all other duties that maybe designated by the President of the Faculty Club. He shall be
the presiding officer of all meetings of the Faculty Club.

Section III – The secretary shall perform the duties pertinent to his/her office and especially the ff:

1. To keep the records in the journal of the Faculty Club and the mutual aid plan.
2. To give or cause to be given notice of all meetings of the Faculty Club and the mutual aid plan.
3. To turn over all records to his successors.
Section IV – The treasurer shall perform all duties which are as follows:
1. To collect all necessary fees and dues and issue receipts there and to deposit all collections in the
depository bank.
2. To pay all authorized expenses.
3. To keep all records of the income and expenditures with the supporting receipts of the club and the
mutual aid plan.
4. To sign all checks drawn against the faculty club and the mutual aid plan in conjunction with the
president and the auditor.
5. To assist the president in the preparation of the annual financial report.
6. To render on account of all his transactions and of the financial standing.
7. To submit financial statement to the officers for the approval and to render the same to the Faculty
Club assembly during the regular meeting.
8. To be the custodian of all properties belonging to the Faculty Club and the mutual aid plan and make
an inventory of the same for the submission to the Faculty Club every end of the school year.

Section V – The Auditor


1. He shall audit books and accounts of the Faculty Club and of the mutual aid plan which are under the
custody of the treasurer.
2. He shall countersign all financial reports of the treasurer of the president.
3. He shall pre-audit all payments involving more than one thousand pesos (P 1,000.00) provide that
expenditures shall not be for the same item or purpose.

Section VI – The Business Manager


1. He shall perform all the duties and be responsible for all the social transaction of the Faculty Club and
of the mutual aid plan.
2. He shall with the authority from the president do the business transactions of the Faculty Club.

Section VII – The Public Information Officer


He shall perform all duties pertinent to his office particularly the ff:
1. He shall act as the liaison officer of the Faculty Club.
2. He shall cause the publication in the school official organ of other media of such information, or
literature as approved by the president.

Section VIII – Sgt-At-Arms


1. The Sgt.-At-Arms shall be the peace keeper of the club. His primary function is to maintain order
during club meetings and other club sponsored activities.

Section IX – The Muse


1. She shall represent the Faculty Club in all social activities.

Section X – The Escort


1. He shall assist the muse in representing the Faculty Club in all social activities.

ARTICLE VI
THE FACULTY GENERAL ASSEMBLY

Section I – The assembly shall be composed of all active member of the Faculty Club.

Section II – The Duties of the Assembly
1. To elect all the officers of the club.
2. To defend, improve and amend the constitution and by laws.
3. To formulate and define the policies of the club.
4. To defend its members from coercion and unfair practices in the teaching profession.

ARTICLE VII
MEETINGS

Section I – The meeting of the Faculty Club shall be two kinds:


SPECIAL AND REGULAR

Section II – There shall be one (1) regular meeting of the Faculty Club every month to be held on the last
Friday of the month.

Section III – As the need arises, a Special Meeting of the Faculty maybe called by the president or by the
officers or by at least 2/3 of the faculty assembly.

ARTICLE VIII
ELECTION

Section I – Officers of the Faculty Club shall be elected by secret balloting by the members of the Faculty
Club one week before the tenure of office of the incumbent officers shall expire.
a. The elections of the officers of the Faculty Club shall be on the first regular meeting of the club which
false on the third week of August.

Section II – The duly elected officers shall assume office after they have taken their oaths of office which
shall be one week after the election.

ARTICLE IX
COMMITTEES

Section I – The following officers shall be standing committees of the Faculty and Staff Club.
1. Safety and Welfare Committee
2. Committee on Professional Advancement
3. Civic and Social Committee
4. Committee on Award
5. Publication Committee
6. Accommodation Committee
7. Business Affair Committee
8. Administrative Committee

Section II – The Safety and Welfare Committee


1. The safety and welfare committee shall screen all application for relief or aid coming from teachers
and shall make recommendation to the president for proper actions on deserving cases.
2. It shall be the forum for all grievances and shall make recommendation to the faculty assembly for
appropriate action.
3. It shall keep official records of all cases investigated and acted upon by the body.

Section III – The Committee on Professional Advancement


1. The committee shall formulate plans and devices tending to bring about professional growth for
teachers. It shall coordinate with the office of the principal.
2. It may recommend to the assembly a monthly professional meeting and should this professional
meeting organized the committee shall manage and direct.

Section IV – The Publication Committee
Shall draw up and carry out plans for the publication of the constitution and any amendment that shall
be made thereafter.

Section V – The Civic and Social Committee


Shall recommend measures designed to foster and promote wholesome, social relationship among the
members of the club and should there be any special activity, the committee shall manage and direct
the same.

Section VI – The Committee on Awards

Shall have the power to recommend person or persons who have done meritorious service for the cause
of education and for all the Faculty Club. The president shall have the sole power to approve such
recommendation of this committee. Two aspects where in awards may be granted:
a. Financial
b. Merit Awards

Section VII – Unless otherwise provided therein, the composition and membership of standing
committee shall be determined by the Faculty Club Officers.

Section VIII – Special Committee may be created by the assembly should the needs arise.

ARTICLE X
FUNDS
Section I – The Funds of the Faculty and Staff Club shall be classified intro GENERAL FUND and SPECIAL
FUND.

Section II – The general fund should consists of the following:


1. Monthly Dues
2. Other sources
3. Money derived from any business transactions by the Faculty and Staff Club

ARTICLE X – FUNDS (January 2016)


Section III – The special fund shall be derived from the following:
1. Monthly Retirement Plan
2. Collections from the Mutual Aid Plan
3. Dinagsa Festival
4. Special Purpose Fund - Each member will be deducted P 50.00 from his monthly salary. This amount is
intended for the yearly educational trip of FASC Members. This amount cannot be withdrawn by the
member.

Section IV – Disposal of Funds


1. All payments, collections for the club shall be deposited to the depositary bank and amount for
disbursement, advances and petty cash needed shall come from subsequent withdrawal from the bank
deposits.
2. No disbursement can be made without written authority from the president.
3. Special fund shall not be appropriated except for their specific purposes.

Section V – Any proceed derived from any fund raising activity of the club, ¼ of which will be
appropriated to the general fund and whatever excess amount from any allocated fund is automatically
reverted to the general fund.

ARTICLE XI
THE MUTUAL AID PLAN

Section I – The club shall establish a Mutual Aid Plan for its members which has the following scope;
a. SALARY LOAN (SL)
b. Hospitalization and Medical Aid (HMA)
c. Death Aid (DA)
d. Retirement Benefit (RB)

Section II – The Salary Loan


a. Any member can avail the Salary Loan amounting to P30,000.00 with an interest of 5% for the whole
period and shall be paid on salary deduction basis starting on the first salary after release of such loan.

Section III – Hospitalization and Medical Aid


a. Any distressed member who needs immediate hospitalization or medical attention can avail the
hospitalization benefit in the amount of P 5,000 for Major Surgical Operation with a minimum of five (5)
days hospitalization and P 3,000.00 for all other illnesses with a minimum of three (3) days
hospitalization. The amount should be taken from the general fund upon representation of the doctor’s
certification and ocular report of the Committee on Safety and Welfare of FASC.

Section IV – Death Aid (DA)


a. The death aid plan should be categorized as follow;
1. First Category (member) …………………………………………………..…………….. P 200.00
2. Second Category (spouse & children)…………………………………............... P 100.00
3. Third Category (parents). ……………………………………………………….…………. P 50.00

b. Only those beneficiaries listed on the list of beneficiaries of any member shall have the right to death
aid claim. Only legal spouses and children are qualified to avail this benefit.
c. Single members may designate their parents into second category, in the third category-anybody,
provided, it should be their dependents as per records.
d. Members who have already availed the categorized benefits in the previous mutual aid system are no
longer qualified.
e. Married couple should pay separately in the second and third category.
f. Any member who fails to pay the 3 consecutive death aid dues is delinquent and shall be deprived of
all privileges due him/her unless he/she pays the whole amount.
g. In cases where the death aid has two member claimants, each one may claim such in their respective
category, provided, however they are paying separately and the beneficiary should be registered legally.
h. Married children of any member are automatically disqualified to be their second category
beneficiary, however, he/she can assign one of his married children as the 3rd category beneficiary in
case the said benefit was not availed since the start of service at DVFGMNHS.

Section V – Retirement Benefits


a. Any member who rendered at least 10 years of service to the club is entitled to a retirement benefit
of P 100.00 to be collected from each member upon his retirement.
b. Any member upon his/her retirement who pays an amount of P 4,000 as a lifetime membership fee is
entitled to a death aid benefit provided however he/she was issued certificate of membership signed by
the incumbent offices and duly notarized by the legal officer.
c. The Retiree needs to pay in full all of his/her unpaid balance within (1) one month after retirement
date before the Lifetime Membership Certificate will be issued. Failure to do so will automatically
disqualify him/her from being a Lifetime Member of FASC.
d. Schedule of Releasing of Retirement Benefit will be two (2) weeks after the following documents were
received by FASC:
1. Service Record
2. Confirmation of Retirement signed by the Principal

ARTICLE XII
AMENDMENTS/REVISION

Section I – Any section of article or part of the constitution and by Laws be amended by no less than 2/3
of all active members of the club in the regular meeting called for the purpose.

ARTICLE XIII
GENERAL PROVISIONS

ARTICLE XIII - GENERAL PROVISIONS


Section I – Any member who fails to pay his monthly dues for 3 consecutive months will be declared
delinquent and will be disqualified from all benefits such as medical and death aid and other privileges.
On the second month of non-payment, a written warning will be sent to the member.
On the third month of non-payment, a demand letter will be sent to the member and
reinforcement of sanction mentioned above.

Section II – The membership of any member who concurs 5 consecutives absences without valid reasons
in the General Assembly Meeting ceases and made him/her ineligible to all benefits/privileges for
him/her.

Section III – No action of the club shall be considered binding unless it has the 2/3 votes of all its
members.

Section IV – Only the president and the treasurer shall sign all bank withdrawals.

Section V – All loans shall have the approval of the president and the treasurer.

Section VI – No amendment can be made in favor of the incumbent officers.

Section VII – After 2 instances of suspension, a suspended officer is automatically impeach from his/her
position.

Section VIII – Appropriation of General Fund shall be;


a. Reserved Fund ¼
b. Operation Fund ¼
c. Economic Relief ¼
d. Medical/Hospitalization ¼

ARTICLE XIV
EFFECTIVITY

Section I – This Constitution and By-Laws shall take effect immediately upon ratification by a 2/3 votes
cast by all members in a General Assembly hold for the purpose.

Section II – This Constitution and By-Laws was ratified in a General Assembly held on the 19 th day of
January 2016 at DVFGMNHS, Cadiz City.
