Application for Listing

The humble Appellant begs to submit as under:-

1. That the instant writ petition has been preferred by the


petitioner with the following prayers:-
“i. issue a writ order or direction or declaration to the
effect that the opposite parties can not dispossess the
petitioners from Khasra no 88,89,90,91,92 and 93 of Khata
no 120 the total area of which is 1beegha, 15 biswa, 15
biswans situate in village Haivatmau Maqdueya, Pargana-
Bijnor, Tehsil and District Lucknow.
ii. To issue Writ, Order or Direction or declaration to the
effect that the scheme of acquisition so far as the Khasra plot
no 88,89,90,91,92 and 93 of Khata No. 120 the total area of
the said plots is beegha, biswa 5 viswansi situated in village-
haivatma muqdueya, pargana-bijnor, tehsil and district-
lucknow has laps and in thealternative the opposite parties
may be directed accommodate the aforesaid land of the
petitioner within the scheme on payment of development
charges
iii. Issue a writ order or direction to the effect that the
notifications contained in annexure no 2,3 and 4 are illegal
and inoperative and same bestruck down/quashed.
Iv. Issue an appropriate writ order or direction in the nature
of Mandamus restraining opposite parties from
dispossessing the petitioner from the land mentioned in
annexure no 1 and they be commanded not to interfere with
the possession of the petitioners over the land in question in
any manner.
v. issue an appropriate writ, order or direction as the hon ble
court may deem fit and proper in the circumstances of the
case and in the interest of justice
vi allow the petition with cost in favor of the petitioner

2. That the urgency powers were being invoked by the


government.

3. That the pleading is procedure opposite and counter filed on


4/1/2019 and he was filled rejoinder on 8/2/2019.
4. That the present writ petition was lastly listed on 21/2/2019
and could not be taken up due
to paucity of time.

5. That the urgency in the matter is such that even after the
petitioner was declared successful, it was only during the
time of document verification whereby, even after all the
documents were presented by the petitioner, her candidature
was not selected. The petitioner should be given fair
opportunity to join her job from the first date and no delay
should be caused.

6. That the copy of the present application has been served upon
the counsel for the opposite party.

7. That the matter is urgent in nature and in view of the


aforesaid facts and reasons, the present writ petition may
kindly be listed for hearing in the interest of justice.

PRAYER
It, is therefore, most respectfully prayed that this
Hon’ble Court may be pleased to direct the registry of this
Hon’ble Court for listing of the present writ petition at some
early date.
Such other order as may be deemed just and proper in
the circumstances of the case may also be passed in the
interest of justice.
