AN ORDINANCE CREATING A MUNICIPAL SCHOLARSHIP PROGRAM TO


ASSIST FINANCIALLY STRUGGLING BUT DESERVING COLLEGE-ENTRANTS
AND /OR COLLEGE STUDENTS FROM INDIGENOUS COMMUNITIES, FAMILY OF
REBEL SURRENDEREES, LGBTQIA+ COMMUNITY AND POOREST AMONG THE
POOR OR INDIGENT FAMILY TO STUDY AND FINISH COLLEGE

WHEREAS, Articles 14, Section 1 of the 1987 Philippine Constitution, provides for
protection and promotion of the right of all citizens to quality education at all levels and shall
take appropriate steps to make such education accessible to all;

WHEREAS¸ further, Paragraph (3) of Section 2, Article 14, of the aforesaid Philippine
Constitution also provides for the establishment and maintenance of a system of scholarship
grant, student loan programs, subsidies, and other incentive which shall be available to deserving
students in both public and private schools, specially to the under-privileged;

WHEREAS, Section 16, of Republic Act No. 7160, otherwise known as the New Local
Government Code of 1991, provides that, every local government unit shall exercise the power
expressly granted, those necessarily implied there from, as well as powers necessary,
appropriate, or incidental for its efficient and effective governance, and those which are essential
to the promotion of the general welfare xxx;

WHEREAS, Paragraph (a) of Section 447 of the same Code, also provides that, the
Sangguniang Bayan, as the legislative body of the municipality, shall enact ordinances, approve
resolutions and appropriate funds for the general welfare of the municipality and its habitants;

WHEREAS, pursuant to the Rules and Regulations Implementing the New Local
Government Code of 1991, particularly Article 100 (5) (xi), provides, “Establish a scholarship
fund for poor but deserving students residing within the municipality in schools located within its
jurisdiction;

WHEREAS, Section 6 (II), of Republic Act No. 10648 or also known as the Iskolar ng
Bayan Act of 2014, provides that, LGUs are encouraged to create their own scholarship program;

WHEREAS, a quality education is one of the most important means of ensuring a child's
future, and the municipality of Vintar put the maximum efforts to make sure that public
education is important to the youth of Vintar, specifically among college-entrant students in
indigenous communities, family of rebel surrenderees, and poorest among the poor or indigent
clusters;

WHEREAS, due to the rising costs of school supplies, transportation, food, and other
incidental expenses associated in college education, family budgets and resources becomes tight
and costs are perpetually rising;

WHEREAS, the granting of cash incentives or scholarship to college-entrants and/or


college students that are financially challenged but deserving can be positively reinforced with
their desire to continue their studies and finish college;
WHEREAS, a cash incentive or scholarship they will receive will be a source inspiration
to pursue their studies and look ahead of being able to help their family financially through the
fruits of their hard work in school;

NOW THEREFORE, BE IT ORDAINED AS IT IS HEREBY ORDAINED BY


THE SANGGUNIANG BAYAN OF VINTAR, ILOCOS NORTE THAT:

CHAPTER I
TITLE

Section 1. TITLE. This ordinance shall be known as the “MUNICIPAL COLLEGE


SCHOLARSHIP PROGRAM ORDINANCE”

CHAPTER II
OBJECTIVE

Section 2. OBJECTIVE. With the ultimate goal of producing qualified college graduates
who will uphold the honor and reputation of the Municipality, this Ordinance
aims to help financially struggling but deserving and dedicated students of the
municipality access to colleges and state universities within the Province of Ilocos
Norte.

In order for the scholars to be able to support their families and the community,
this ordinance also aims to help them find employment in a field that is
appropriate for their chosen career, as soon as they graduate from their studies.

CHAPTER III
DEFINITION OF TERMS

Section 3. DEFINITION OF TERMS. The following terms and phrases when used under
the Ordinance shall mean as follows:

1. Benefits – These are the rights or privileges a qualified scholar may receive
from the program.
2. Colleges/State Universities – Any State Universities or Colleges in the
Province of Ilocos Norte where the scholar is enrolled or plans to enroll are
referred to as Colleges or State Universities.
3. Committee – The Scholarship Committee that will be established in relation to
this program is referred to here.
4. General Average – This grade is what remains after adding up each student's
grades and dividing the total by the variety of subjects taken.
5. Indigenous Communities – They are distinct social and cultural groups that
share collective ancestral ties to the lands and natural resources where they
live, occupy or from which they have been displaced
6. Indigent Cluster – A family/persons who have no visible means of income, or
whose income is insufficient for family subsistence, as identified by the
Department of Social Welfare and Development (DSWD), based on specific
criteria.
7. Resident – Any person who has lived in the municipality for at least six (6)
months prior to the date of the scholarship application is considered a resident.
8. Scholar – refers to a student who met the requirements set forth in this
ordinance and is qualified to receive the program's benefits.
CHAPTER IV
QUALIFICATIONS AND REQUIREMENTS

Section 4. QUALIFICATIONS AND REQUIREMENTS.

1. All lawful residents of the Municipality and members/sons/daughters of the


Indigenous group, rebel surrenderees and poorest among the poor or indigent
cluster who have completed Grade 12 or graduated from any Senior High
School in the Province of Ilocos Norte are eligible to participate in the
program. The applicant shall present any of the following:
a) For Member of Indigent Clusters - Certificate of Indigency from the
Barangay and MSWD Office.
b) For Member of a Family of Rebel Surrenderees - Certificate of Rebel
Surrenderees of the Member of the family who surrendered which attested
and issued by the PNP.
c) For Member of Indigenous Communities - Certificate of IPs
Membership issued by the Community Chieftain.
2. To be eligible, the applicant must have a general average of at least 85% or its
equivalent, with no grade in any subject area in any grading period falling
below 80%. The applicant shall provide a copy of Form 137/138 or Transcript
of Record from the last school year attended.
3. No family's net annual income should be higher than PHP 65,000.
4. The applicant must pass the qualifying examination, both oral and written, to
be given by the Scholarship Committee.
5. The applicant must also meet the admission requirements of the school where
she/he plans to enroll and pass the qualifying exams offered by that
institution. The applicant shall provide a copy of the result of the admission
test from the school s/he plans to enroll.
6. In the event that the student withdraws from the course without a valid reason
as determined by the committee, the applicant's parents must be willing to
sign a contract committing to reimburse the municipal government for its
expenses.
7. A scholar must maintain an overall grade point average of 85 percent (or its
equivalent) in all subjects, with no grade below 80 percent or its equivalent,
and no dropped, incomplete, or failing grades. The scholar is required to carry
full load per semester as required by the curriculum.
8. Without the Committee's consent, the scholar is not permitted to switch from
the first course they have taken to another course.
9. The applicant who meets the requirements for this program's designation as an
Scholar is not permitted to receive another scholarship grant, as doing so will
result in the cancellation of the first.
10. A qualified college applicant may only enroll in colleges or state universities
located in Ilocos Norte Province.

Section 5. NUMBER OF SCHOLARS. The Municipal shall maintain as many scholars as


the funds for the program allow.

CHAPTER V
BENEFITS/PRIVILEGES

Section 6. BENEFITS/PRIVILEGES:

1. Everyone who meets the requirements is eligible for free tuition,


matriculation, and other school costs.
2. After graduation, the Municipal Government will help scholars find
employment.
CHAPTER VI
SOURCE OF FUND

Section 7. FUNDING SOURCE. The Municipal Government shall set aside an amount of
Php.1,000,000.00 from the General Fund for this purpose. The Municipal College
Scholarship Committee may recommend that the municipality increase the
appropriated fund when it is thought necessary.

CHAPTER VII
THE CREATION OF MUNICIPAL COLLEGE SCHOLARSHIP COMMITTEE

Section 8. THE MUNICIPAL COLLEGE SCHOLARSHIP COMMITTEE. The


Executive Officer shall form a Municipal College Scholarship Committee,
composed of the following;

Chairman: Chairman Committee on Cultural Minorities and Indigenous


People
Co-Chairman: Chairman Committee on Education, Manpower, Development and
Public Information
Members: Chairman Committee on Youth and Sport Development
Municipal Social Welfare and Development Officer
Municipal Indigenous People Mandatory Representative
DEPED Representative/School Head/Principal

Section 9. DUTIES AND FUNCTION. The Municipal College Scholarship Committee


shall be as follow:

1. Responsible in the screening of the applicants;


2. Recommend qualifiers to the Municipal Mayor for approval and;
3. Monitor the progress of scholars.

Based on the provisions of this Ordinance, it will be tasked with developing the
general policies of the Municipal Indigenous People Scholarship Program.

Section 10. PROVISIONS FOR IMPLEMENTATION:

1. A Memorandum of Understanding (MOU) with colleges or state universities


in the province of Ilocos Norte regarding this Ordinance must be signed by the
municipal government, which is represented by the municipal mayor.
2. Following submission of a statement of account based on the registration
form, the MOU shall permit the municipal government to pay tuition,
matriculation, and other school fees directly to the school where the scholar is
enrolled.
3. For the scholar to be eligible and enrolled in the program for the upcoming
semester, the scholar must submit to the committee a copy of his or her grades
that has been duly certified by the school authority.
4. The scholar will not be permitted to resign without a valid reason that the
committee has approved.
5. Until the student has graduated or completed all of his or her strands/tracks,
only one (1) scholar per family is permitted.
6. An association of Vintar Municipal College Scholars will be established with
the goal of monitoring, placing graduates in jobs, and planning programs and
projects.
7. Every student is required to perform community service for at least 160 hours
per academic year, under the direction of the Municipal Mayor's Office, and in
accordance with a mutually agreed-upon schedule.
CHAPTER VIII
Miscellaneous Provisions

Section 11. REPEALING CLAUSE. This Municipal Ordinance is hereby repealed,


amended, or modified to the extent that it conflicts with any other ordinances,
executive orders, or local policies.

Section 12. SEPARABILITY CLAUSE. The other provisions of this municipal ordinance
shall remain in full force and effect even if one or more of its provisions are found
to be unconstitutional or in conflict with any law.

Section 13. EFFECTIVITY. Following Sangguniang Panglalawigan approval and posting in


at least three (3) visible locations throughout the Various Barangays, this Ordinance shall go into
effect fifteen days
