RESOLUTION NO. 2012 - 013

RESOLUTION OVERRIDING THE VETO OF THE CHIEF EXECUTIVE, HON. FRANCISCO


P. TENENAN, SR., MUNICIPAL MAYOR, THIS MUNICIPALITY, ON ITEM NOS. 2, 4
AND 5 IN HIS VETO MESSAGE

WHEREAS, after a careful and thorough review of the proposed Executive Budget for
Calendar Year 2012, the Sangguniang Bayan, this municipality, has finally approved the
Annual Appropriation Ordinance in the amount of FIFTY SEVEN MILLION FOUR
HUNDRED SEVENTY TWO THOUSAND FIVE HUNDRED PESOS & 00/100
(PhP57,472,500.00) and authorizing the implementation of various expenditures for
the operation of the Municipal Government;

WHEREAS, the approved Appropriation Ordinance was transmitted to the Office of the
Municipal Mayor on the 6th day of February 2012 for appropriate action. The
Appropriation Ordinance was returned to the Sangguniang Bayan on February 16, 2012
specifically stating therein the five (5) items vetoed, such as: (1) MOOE-Insurance
Premium, (2) Statutory & Contractual Obligation (Go Lamut Education Assistance), (3)
Non-Office – PNP MOOE-Internet Expenses, (4) Budgetary Reserve (Production of
Planting Materials) and (5) Budgetary Reserve (Veterinary Drug Supplies);

WHEREAS, item 2 which is the Go-Lamut Educational Assistance was vetoed for reason
as quoted: “that it is contrary to Art. 415, IRR of RA No. 7160 and besides, the object
of expenditures is treated as Continuing Appropriations for 2012. The increase in the
appropriation for the program amounting to PhP108,000.00 is not ultra-vires but
proper and legal pursuant to Municipal Ordinance No. 2010-04, Section 12 as quoted:
“Program Funding Source – The Municipal Government shall regularly appropriate
funds in the Annual Budget sufficient to sustain the program and the objectives of the
Ordinance. For the first year of implementation – PhP54,000.00 for the second year –
PhP108,000 for the third year PhP162,000.00 and for the fourth year – PhP216,000.00.
This justifies the increase of appropriation and inclusion of the program in the Annual
Investment Plan of the Municipality because it falls under the Statutory Obligation of
the Local Government Code as provided under Article 415 of the Implementing Rules
and Regulations of RA 7160;

WHEREAS, item nos. 4 and 5, Budgetary Reserve for Production of Planting Materials
and Veterinary Drugs Supplies were vetoed as ultra vires on the ground that it does
not partake of Livelihood and Development Programs. Production of Planting
Materials and Veterinary Drugs Supplies are priority programs in line with the ten-
point agenda of the Municipal Government, however, were not accommodated in the
80% of the 2012 Annual Budget of which when consulted, the Local Finance Committee
informed this august Body to be charged under the lump sum appropriation for the
Share from the National Wealth, thus the details/breakdown was provided by the
august Body;

WHEREFORE, on motion, duly seconded and upon unanimous vote of the members
present, be it:

RESOLVED, to override the veto of the Chief Executive, Hon. Francisco P. Tenenan, Sr.,
Municipal Mayor, this Municipality, particularly item nos. 2, 4 and 5 in his veto
message;
RESOLVED FINALLY, to forward this Resolution to the Sangguniang Panlalawigan for
their information and basis of appropriate action;

APPROVED AND ADOPTED this 20TH day of February 2012 by the Sangguniang Bayan
of Lamut, Ifugao.
