B. The Rounds
1. Mock Trial is a simulated criminal trial that pertains to
the Witness Examination. The trial includes the
following three stages:
a. Opening statements
b. Examination of witnesses (only Cross Examination)
c. Closing address

1. Registration for the 13th Intra Mock Trial Competition, 2024 will be
through online form submission via the link given further.
4. Once the payment has been made, participants shall fill up the
Registration Form- https://forms.gle/LgaDkTodv9fL7Awg9.
5. In the link, while filling the details regarding “Course Name” and
“Activity”, type “VSLLS INTRA MOCK TRIAL 2024” in both.
6. Once payment has been made, it will not be refunded in any case.

IV. ORAL ROUNDS
A. General Rules
1. Exhibits of the case are already submitted before the Court and are on record.
2. The participant counsel shall cross-examine the witnesses provided by
the organizers.
3. The participant counsel may examine all or any of the witnesses within
the time allotted to them.
4. The participant counsels shall, before the commencement of a round,
notify the court master as to which witness they would like to call for
cross-examination in the course of the trial since the witnesses would be
admitted one at a time.
B. Oral rounds
1. In the oral rounds, Counsels from both sides i.e., Prosecution & Defence,
shall be given a total of 20 minutes each to make oral submissions. Every
minute of extra time will attract automatic penalties for the speaker
crossing the limit.
2. The round would be divided among the following stages in the sequence
given below:
a) Opening statement by the Prosecution – 5 minutes
b) Opening statement by the Defence. – 5 minutes
c) Cross Examination by the Defence – 10 minutes
d) Cross Examination by the Prosecution – 10 minutes
e) Closing statement by the Defence – 5 minutes
f) Closing Statement by the Prosecution – 5 minutes
The time break up given above is a guideline and not a rule. The individual
is at liberty to use the allotted 20 minutes according to their convenience.
(Judges are requested to consider the time utilized by each speaker while
giving marks)

V. SCORING
A. Oral rounds
Participants will be marked out of 100 individually by both the judges.
B. Oral presentation
1. Marks shall be given on the basis of the following suggestive criteria’s:
a. Knowledge of facts
b. Logic, reasoning and clarity
c. Persuasiveness & deference to court
d. Proper, articulate and systematic analysis of the issues arising out of facts
e. Understanding of the laws involved including laws relating to
evidence and procedure
f. Ability to successfully conduct cross examinations in allotted time
g. Ability to elicit favorable facts from witnesses
h. Ability to deal with unreceptive, argumentative or hostile witnesses
i. Ingenuity (ability to argue by analogy from related aspects of law and facts)
j. Court craft (court manners, court language and body language in the court)

VI. GENERAL RULES
C. Individual Codes
Upon confirmation of participation, each individual will be allotted a
“Code”. The individuals shall refer to themselves during the competition
using this Code only. They shall not disclose their identity otherwise to
anybody except as and when demanded by a member of the Organising
Committee. Any violation of this rule would result in immediate
disqualification.
D. Attire
The dress code for the participants shall be an advocate’s attire. All the
participants MUST appear in a formal dress. Black/Grey Tie is

compulsory for all those who are wearing white shirts and black
trousers. Robes and collar bands are not permitted.
F. Anonymity
The participants must not disclose their identity and names or any
such information during the oral rounds for the entire duration of the
13th Intra Mock Trial Competition 2024. The violation of this rule
will result in disqualification, as determined by the Competition
Administrator.

IX DISCLAIMER
1. All the characters in the Moot problem are fictional. Any resemblance to
any person living or dead is purely coincidental, unintentional and not
intended to hurt anybody’s sentiments.
2. All documents not provided but necessary for trial are deemed to be on the record.
3. Each side must examine the witnesses. However, the Counsels must
complete the cross- examination of the witnesses in the prescribed time
limit and the Counsels shall not be granted an extension of time to complete
the examination of all of their witnesses, though subject to the discretion
of the judges.
4. The jurisdiction of the various police stations, police beats and police
checkpoints are not subject to dispute.
5. Any usurpation of the below-given norms will lead to direct
disqualification from the competition.
6. Extrapolation of the statements of the witnesses is subject to the law of the land.
7. Any change in the statements of the witnesses which require additional
documents to be proved shall not be permitted.

TRIAL PROPOSITION
1. Arizoa is a peaceful nation. In the State of Zena in Arizoa Mrs. Vijiya was living
happily with her two sons. In the year 2000 she purchased a house in Sigyan Vihar in
Zena. She was living in the house happily with her family. After two years in 2002, her
elder son, Rupesh got married. Vijiya built the first floor of the house and Rupesh
started living there with his wife. In 2004, her younger son, Sahesh got married. Vijiya
built the second floor of the house and Sahesh started living there with his wife. In
2006, both the sons purchased their own separate houses in Kuraj Vihar and started
living there with their separate families. In the year 2008, Mrs. Vijiya rented the second
floor of her house to Mr. Adesh. Mr. Adesh started living there with his wife Suma,
and two children. Mrs. Vijiya kept the first floor vacant. This floor was occasionally
used by her sons when they would come to visit her.
2. In the year 2010 a son was born to Rupesh. Mrs. Vijiya decided to throw a party
on 9th March, 2010 for all her relatives and friends for the naming ceremony of her
grandson. During the naming ceremony she expressed that she wishes to move in with
her sons and sell the ground and first floor of her house. Her sons were also happy with
this and agreed with her. This conversation was overheard by Mr. Adesh.
3. On 10th March, 2010 the very next day of the party, Mr. Adesh approached Mrs.
Vijiya in the morning around 10:00 AM. Mrs. Vijiya had just completed her puja and
was reading the newspaper. Mr. Adesh told her that he and his wife are interested in
buying the ground, first floor and second floors of the house. Mrs. Vijiya told him that
she is interested in selling the second floor of the house only to him. Mrs. Vijiya called
her sons and within three months the second floor was sold to Mr. Adesh.
4. On 10th September, 2010 Mr. Adesh called Sahesh around 10:00 AM and informed
him that he was going to pay his share of the electricity bill and asked if he should pay
the share of ground and first floor as well. Sahesh agreed with him and told him to take
the cash from his mother. He also told Mr. Adesh to take the signatures of his mother
on a blank paper and get the receiving on that for electric bill from the department. Mr.
Adesh immediately went to the house of Mrs. Vijiya and collected the cash for the bill
and signature for getting the receipt. Mr. Adesh left for the department to pay the bill.
Meanwhile Sahesh called Rupesh and told him about the same. Rupesh told Sahesh
that he should not have asked Mr. Adesh for signatures on a blank page as that could

be misused by him. Sahesh immediately called his mother to tell her to not sign on the
page and wait for him to come to her house. However, his mother told him that she has
already signed on the page and given it to Mr. Adesh. Sahesh called Mr. Adesh
however the phone was answered by his wife who told him that he had left his phone
at home and went to pay the bill. Around 4:00 PM, Mr. Adesh went to meet Mrs. Vijiya
and informed her that he had paid the bill. Mrs. Vijiya asked for the blank page on
which she had signed to which Mr. Adesh stated that he has submitted it in the office
as they said that the receipt will be given by tomorrow. On 11th September, 2010 Mrs.
Vijiya asked Mr. Adesh about the blank paper to which Mr. Adesh informed her that
the office had misplaced it and he could not get the receipt.
5. On 10th January, 2012 Mrs. Vijiya’s house-help Ms. Nirupa came to her house in
the morning at 7:00 AM for cleaning the house. She kept ringing the door-bell but
nobody answered. She called Mrs. Vijiya but no one answered. She called Rupesh
about the same. Rupesh told her that she should keep calling Mrs. Vijiya and
simultaneously keep ringing the bell till she answers. Meanwhile, Rupesh tried calling
Mr. Adesh to request him to look into the matter. Mr. Adesh did not pick up his call so
he tried calling the security guard to look into the matter. At the same time, he got into
his car and reached the colony around 8:00 AM. When he reached the house, he was
informed by Ms. Nirupa that somebody had killed Mrs. Vijiya. Rupesh called the police
immediately and when the investigating officer came, he told him that Mr. Adesh has
killed his mother because of his greed for the ground and first floor of the house. The
investigating officer asked Rupesh to report at the police station and at the same time
registered a FIR and arrested Mr. Adesh on the basis of this statement of Rupesh. The
case went up for trial in the Sessions Court of Sarvena in the city of Zena.
Note: The participants are required to frame the issues on their own. Refer to the
following statements and copy of FIR for the purpose of examination of the witnesses.
The laws of Arizoa are pari materia to the laws of India.

Statement of witness’s u/s 161 Cr.PC
PW 1 (Rupesh)
My name is Rupesh and I am the elder son of the deceased Mrs. Vijiya. On 10th
September, 2010 my younger brother Sahesh had called me and informed me that
Adesh was going to pay the electric bill for that month and I need not worry about it.
He told me that Adesh would also get a receiving and my mother has signed on a
blank page for that purpose. I got angry about that matter and told him that Adesh
was a greedy person. He had eyes on our property and was repeatedly asking me to
force my mother to sell the first and ground floor of the house to him. On 10th
January, 2012 I received a call from Nirupa that my mother was not opening the door.
I tried calling Mr. Adesh but he did not answer his phone. I immediately drove to my
mother’s house as I was afraid that she was not well. My mother was not keeping
well for quiet some-time. When I reached the house, I saw that Suma and Adesh were
already inside. Suma was putting a bed sheet on the body of my mother and Adesh
was talking to our neighbor, Dhimu. When I checked the CCTV footage of the
previous night, I saw that a person looking like Mr. Adesh was ringing the bell of my
mother’s house.
PW 2 (Nirupa)
My name is Nirupa and I have been working as a house-help for the past 10 years.
On 10th October, 2011 Adesh bhaiyya came to the house of Vijiya aunty. Rupesh
bhaiyya was already there. An altercation took place between them where Rupesh
bhaiyya had pushed Adesh bhaiyya. I do not know the reason behind their fight. On
10th January 2012 I reached Vijiya aunty’s house at 7:00 AM but nobody answered.
I called Rupesh bhaiyya and kept ringing the bell. After some time, I saw Suma
Bhabhi and Adesh bhaiyya coming downstairs and I told them about the matter. I
saw Bhabhi giving worried looks at bhaiyya. Bhaiyya asked me to ring the bell of
Dhinuji while he started calling Vijiya aunty. When Dhinuji came he and Bhaiyya
pushed the door and broke it. We all entered the house and found that Vijiya aunty
was lying on the floor with blood coming from the back of her head. I started crying
and bhaiyya started talking to Dhinuji in a hush hush manner. After 10 minutes
Rupesh bhaiyya came and called the police.
PW3 (Sahesh)
I am Sahesh and I am the youngest son of Mrs. Vijiya. On 10th September, 2010 Mr. Adesh
called me around 10:00 AM and informed me that he was going to pay his share of the

with him and told him to take cash from my mother. I also told Mr. Adesh to take the signatures

Thereafter, I called my elder brother Rupesh and informed him about the same. Rupesh told me
that I should not have asked Mr. Adesh for signatures on a blank page as that could be misused
by him. I immediately called my mother to tell her to not sign on the page and wait for me to
come to her house. However, my mother told me that she has already signed on the page and
given it to Mr. Adesh. I called Mr. Adesh however the phone was answered by his wife who
told me that he had left his phone at home and went to pay the bill. On 10th January, 2012 my
elder brother informed me that our mother was no more. He told me that he suspected that Mr.
Adesh had killed our mother.

of the past two years. In the CCTV footage of 10th September, 2010, I saw that Mr.
Adesh was leaving the house with folded paper. However, as in the footage of 9h
January, 2012, face of the man was not clear, therefore, the CCTV footage along
with the photographs and sample video footage of Mr. Adesh were sent to the
Forensic Science Laboratory. It was reported that due to low quality of CCTV
footage, conclusive opinions cannot be given. However, it was observed that the
person in the CCTV footage is of similar height and weight as Mr. Adesh.
Subsequently, I collected the post mortem report from the hospital which stated that
the cause of death was blunt force impact on the skull of the deceased causing it to
rupture. Thus, on the basis of investigation conducted and statement of witnesses,
and in view of the disclosure of the accused, the offence of murder was found to be
committed by Mr. Adesh.

Statement of Accused u/s 313 Cr.P.C (Mr. Adesh)
My name is Adesh and I deny all the allegations that were made against me. On 10th January
2012, I along with my wife decided to go for a morning walk around 7:15 AM when we
heard that Ms. Nirupa was shouting Mrs. Vijiya’s name. When we reached the ground
floor, she told us that Mrs. Vijiya wasn’t opening the door. I called Mr. Dhinu and together
we pushed the door open. We entered the house and found Mrs. Vijiya lying in a pool of
blood. I have been falsely implicated by Mr. Rupesh in connivance with the IO due to our
previous fight. I was made to sign on blank papers in the PS and I never gave any statement
to IO about killing Mrs. Vijiya.
DW1 (Dhinu)
My name is Dhinu and I am the neighbor of Mrs. Vijiya. On 10th January 2012 around
7:30 AM I along with Mr. Adesh, Mrs. Suma and Ms. Nirupa entered the house of Mrs.
Vijiya and found her dead. We all were very upset about the matter and Mr. Adesh was
crying so I started consoling him. Meanwhile Mr. Rupesh came and started shouting at
Mr. Adesh that he was a killer and had killed Mrs. Vijiya. I was shocked to hear this as I
have always seen Mr. Adesh taking care of Mrs. Vijiya. In fact Mrs. Vijiya used to tell me
that he is like her third son. She also wanted to sell her properties to Mr. Adesh and live

with her sister in another state. I am not convinced that Mr. Adesh could kill Mrs. Vijiya
as on 9th January 2012 I was walking with my wife in the park of the colony. I saw a man
who looked like Mr. Adesh going out of the colony from the gate around 9:00 PM. I was
walking till 10:00 PM and I did not see him coming back.
DW2 (Suma)
My name is Suma and I am the wife of Mr. Adesh. On 9th march, 2010 my husband told
me that Mrs. Vijiya was willing to sell all the floors. We were overjoyed with this prospect
and immediately agreed on discussing with Mrs. Vijiya. I even told my husband that I can
request my parents to help us financially in buying the floors. To this my husband stated
that he has sufficient savings and does not require any help from his in-laws. Within three
months we bought the second floor. On 10th January 2012, I along with my husband
decided to go for a morning walk around 7:15 AM when we heard that Ms. Nirupa was
shouting Mrs. Vijiya’s name. When we reached the ground floor, she told us that Mrs.
Vijiya wasn’t opening the door. My husband called Mr. Dhinu and together they pushed
the door open. We entered the house and found Mrs. Vijiya lying in a pool of blood.
