MISSION AND OBJECTIVES OF KERALA LEGAL SERVICES
AUTHORITY (KELSA)

The Kerala Legal Services Authority (KELSA) operates as a statutory body established under
the Legal Services Authorities Act of 1987. Its primary mission is to ensure equitable access
to justice for all members of society, particularly those disadvantaged by economic or other
barriers. KELSA is committed to fostering an inclusive legal system where every individual
can exercise their legal rights without discrimination. Here are the detailed objectives of the
Kerala Legal Services Authority:

1. Enhancing Access to Justice: KELSA endeavors to bridge the gap between legal
provisions and marginalized communities by offering comprehensive legal aid
services. This includes representation in courts, legal advice, and assistance in
document preparation, ensuring that even the economically vulnerable can seek and
receive justice.

2. Legal Aid and Assistance: The authority provides free legal services to eligible
groups such as Scheduled Castes, Scheduled Tribes, victims of trafficking, women,
children, mentally ill individuals, and those below a specified income threshold.

Beneficiaries Covered Under the Legal Services Authorities Act, 1987

The Legal Services Authorities Act of 1987 outlines provisions ensuring free legal aid to
various categories of individuals across India. These provisions aim to democratize access to
justice and empower marginalized communities by providing necessary legal support. Here
are the categories of beneficiaries entitled to free legal services under the Act:

1. Scheduled Castes and Scheduled Tribes Members: Individuals from these


communities, often facing socio-economic disadvantages, receive legal assistance to
ensure equitable access to justice.
2. Victims of Trafficking and Forced Labor: This includes individuals trafficked for
various purposes and those subjected to forced labour or servitude, ensuring their
rights are protected.
3. Women and Children: Recognizing their vulnerability, the Act guarantees legal
support to safeguard the rights of women and children, addressing issues such as
domestic violence, child abuse, and discrimination.
4. Persons with Mental Illness or Disabilities : Individuals with mental illnesses or

Today was an insightful start to my internship at KELSA. The orientation session provided a
comprehensive overview of the organization’s objectives and the crucial role it plays in

Session on Court Proceedings : BY ADV. SHAMLATH

Activities
1. Legal Aspect Assessment:
o Conducted an in-depth analysis of the legal aspects relevant to court
proceedings.

o Guided participants on the formulation and presentation of factual statements
crucial to legal arguments.

compliance with legal requirements.

o Identified and discussed the grounds on which a case can be legally pursued in
court.

meticulous preparation and adherence to legal norms. Understanding the role of pleadings
and the procedural steps involved in filing and presenting cases has enhanced my
appreciation for the complexities and requirements of the legal system. This session has
equipped me with practical insights essential for navigating future legal challenges
effectively.

DAY-3

VISITED LEGAL AID DEFENCE COUNCIL

The Legal Aid Defense Counsel Office specializes in handling legal aid cases within its
designated district for criminal matters. It offers free legal services starting from the early
stages of criminal justice proceedings up to the appellate stage, including visits to
correctional facilities. This office is dedicated to providing comprehensive legal aid
throughout all stages of a criminal case, from pre-arrest situations to the appellate process,
across all districts within the State.

Activities:
 Participated in a legal aid clinic.
 Observed client consultations and the provision of legal advice.
 Assisted in preparing case summaries for clients.
 Gained insights into the challenges faced by marginalized communities in accessing
justice.

Reflection:
Participating in the legal aid clinic was a profoundly impactful experience. Observing the
client consultations highlighted the real-world challenges people face in accessing legal
assistance. Preparing case summaries allowed me to contribute directly to the support
provided to clients. This experience has deepened my commitment to promoting legal rights
for all.
DAY 4

VISITED DISTRICT JAIL, ERNAKULAM

Activities:

1. Observation of Inmate Activities:

o Under the guidance of Jail Superintendent Raju Abraham, I visited the prison
and observed various life skill and craftwork activities undertaken by the
inmates.

2. Discussion with Superintendent:

o Engaged in a discussion with Jail Superintendent Raju Abraham regarding the


living conditions and facilities available within the prison.

3. Understanding the Prisons Act, 1894:

o Learnt about the Prisons Act, 1894, which governs the administration and
management of prisons in India, focusing primarily on custody, discipline, and
order maintenance.

Reflection:

The visit to the prison and interaction with Jail Superintendent Raju Abraham provided
valuable insights into the daily lives of inmates and the rehabilitative efforts within the
correctional system. Observing the inmates' engagement in life skills and crafts highlighted
the importance of productive activities in fostering rehabilitation and personal development.

Discussions with the Superintendent shed light on the challenges faced in maintaining
adequate living conditions and facilities within the prison environment. The presence of a
dedicated rehabilitation center for women and children underscored efforts towards
specialized care and support for vulnerable populations within the prison system.
DAY-5

ATTENDED HIGH COURT MEDIATION PROCEEDINGS

Activities:

1. Observation of Mediation Sessions:

o On the fifth day of the internship, I had the opportunity to observe the
mediation process at the High Court. Under the guidance of Senior Mediator
Adv. Sohara, I witnessed mediation sessions on diverse cases including a
divorce case, fraud in job opportunities, and a land dispute.

2. Learning from Senior Mediator:

o Engaged in a learning experience guided by Senior Mediator Adv. Sohara


Mam, gaining insights into the techniques and procedures employed in
mediation.

3. Understanding Legal Framework:

o Explored the legal framework governing mediation in India, which includes


statutes such as the Code of Civil Procedure (CPC), the Arbitration and
Conciliation Act (ACA), the Commercial Courts Act (CCA), and the
Consumer Protection Act (CPA). Additionally, learned about the newly
introduced Mediation Act of 2023 aimed at establishing India as a mediation
hub.

Reflection:

Observing the mediation process at the High Court was a significant learning experience that
provided practical insights into alternative dispute resolution mechanisms. The opportunity to
witness mediation sessions on various cases broadened my understanding of how mediation
can effectively resolve complex disputes, including sensitive issues like divorce, fraud, and
property disputes.

Under the mentorship of Senior Mediator Adv. Sohara Mam, I gained valuable knowledge
about the nuanced approach required in mediation, emphasizing communication, negotiation,
and conflict resolution skills. Witnessing firsthand how mediators facilitate constructive
dialogue and guide parties towards mutually acceptable solutions highlighted the importance
of impartiality and empathy in mediation practice.

Exploring the legal framework governing mediation underscored the importance of


regulatory frameworks in ensuring fairness and transparency in alternative dispute resolution
processes. The discussion on the Mediation Act of 2023 sparked reflection on the balance
between regulation and the autonomy inherent in mediation practices within a society
governed by the rule of law.

Overall, this experience deepened my interest in alternative dispute resolution methods and
equipped me with practical insights that will be invaluable in my future legal career.

DAY-6

RESEARCH PAPER PREPARATION

Today was research day at KELSA, and topics were allotted. I got the topic: Need for
government control over religious and charitable endowments in India.

oversight from governmental authorities. These endowments, which include vast properties,
funds, and assets donated by devotees and philanthropists over generations, play a crucial

ATTENDED MEDIATION PROCEEDINGS AT TRIAL COURT

Activities:

1. Observation of Family and Divorce Mediation:

o Attended trial court mediation sessions focused primarily on family and


divorce disputes.

2. Focus on Asset Distribution Issues:

o Observed discussions centered around disputes over the distribution of assets


among children following divorce proceedings.

3. Insight into Persistent Family Issues:

o Gained an overview of ongoing family conflicts and their complexities


through mediation sessions.

4. Role of Mediator as Facilitator:

o Noted that mediators primarily act as facilitators rather than legal advisors,
encouraging parties to discuss personal matters and viewpoints during the

DAY - 8

VISITED JUVENILE JUSTICE BOARD, KAKKANAD, ERNAKULAM

Activities:

1. Visit to Juvenile Justice Board, Kakkanad, Ernakulam:

o On day 8 of the internship, visited the Juvenile Justice Board, a specialized


judicial body established under the Juvenile Justice (Care & Protection of
Children) Act.

2. Understanding the Role and Structure:

o Explored the unique function of the Juvenile Justice Board, which is dedicated
to handling cases involving children in conflict with the law.

3. Composition of the Board:

o Learned that the board comprises one judicial magistrate and two social
worker members, reflecting a multidisciplinary approach to juvenile justice.
Reflection:

Visiting the Juvenile Justice Board provided profound insights into the specialized judicial
processes and protections afforded to children in conflict with the law. The board's structure,
with its mix of legal and social work expertise, underscores the importance of holistic and
child-centric approaches in handling juvenile cases.

Witnessing the board's proceedings highlighted the sensitive nature of juvenile justice,
focusing not only on legal accountability but also on rehabilitation and welfare. It
underscored the significance of tailored interventions that prioritize the well-being and future
prospects of young individuals involved in legal conflicts.

This experience deepened my understanding of the Juvenile Justice Act's principles and
implementation, reinforcing the critical role of specialized institutions in safeguarding the
rights and rehabilitation of children within the justice system. It also sparked an appreciation
for the interdisciplinary collaboration needed to ensure fair and effective outcomes for
juvenile offenders, aligning legal proceedings with principles of child protection and welfare.

Overall, the visit to the Juvenile Justice Board was instrumental in shaping my perspective on
juvenile justice and instilled a commitment to advocating for the rights and best interests of
children within the legal framework.

DAY 9

VISIT TO WELFARE ASSOCIATION TRUST

Activities:

Today, I had the privilege of visiting the Welfare Association Trust, a Non-Governmental
Organization founded and run by Dr. Mansoor. This NGO is dedicated to supporting
individuals experiencing psychological, physical, or other forms of distress. During the visit,
we observed firsthand the commendable efforts made by Dr. Mansoor and his team in
providing essential care and support to those in need.

We participated in various activities and interactions throughout the day:


1. Observation and Learning: We observed the daily operations of the NGO, including
how they provide care and support to their beneficiaries. This included understanding
the organizational structure and the various services offered.

2. Interactive Session with Beneficiaries: We engaged in an interactive session with the


beneficiaries of the NGO. This allowed us to hear directly from individuals who have
benefited from Dr. Mansoor's initiatives. We listened to their stories, challenges, and
how the NGO has positively impacted their lives.

3. Discussion with Dr. Mansoor: We had the opportunity to discuss with Dr. Mansoor
himself, gaining insights into his motivations, challenges faced, and future plans for
the NGO. His dedication and passion were truly inspiring.

4. Reflection and Discussion: After the visit, we reflected on our experiences and
discussed the broader implications of such NGOs in society. We considered the
importance of community support, the role of NGOs in addressing social issues, and
the need for more individuals like Dr. Mansoor who are committed to making a
difference.

Reflections:

Visiting the Welfare Association Trust was a profound experience that deepened my
understanding of the challenges faced by vulnerable populations and the critical role played
by NGOs in providing support and care. Dr. Mansoor's dedication and the impact of his work
highlighted the importance of compassion, empathy, and proactive community engagement in
addressing societal issues.

illustrated the transformative power of dedicated support systems. It reinforced the belief that
every individual, regardless of their circumstances, deserves dignity, respect, and access to
essential services.

This visit has motivated me to explore further how governmental policies and community
initiatives can better support organizations like the Welfare Association Trust. It has also

societies.

DAY - 10

VISIT TO REGIONAL FORENSIC SCIENCE

Activities:

Today, I had the opportunity to visit the Regional Forensic Science Lab located in
Thrippunithura, Ernakulam. This lab is one of the four regional forensic science labs in
Kerala and plays a crucial role in the judicial process by providing unbiased scientific
opinions on various types of evidential material referred to them by investigating agencies.

During the visit, I engaged in several activities aimed at understanding the operations and
functions of the forensic science lab:

1. Departmental Overview: I received an overview of the lab's structure and


departments. The lab is organized into four main departments: physics, biology,
chemistry, and cyber forensics. Each department specializes in analyzing specific
types of evidence using scientific methods and techniques.

2. Guided Tour: I participated in a guided tour of the lab facilities, where I observed
firsthand the equipment and technology used for forensic analysis. This included
seeing the various instruments used for chemical analysis, DNA profiling, digital
forensics, and more.

3. Demonstrations and Case Studies: The lab staff conducted demonstrations to


showcase how different types of evidential material are processed and analysed. I
learned about the procedures involved in examining physical evidence such as
fingerprints, blood samples, chemical substances, and digital devices for forensic
purposes.

4. Interaction with Experts: I had the opportunity to interact with forensic experts and
scientists working at the lab. This provided insights into their work processes,
challenges faced in forensic investigations, and the importance of maintaining
impartiality and accuracy in their findings.

Reflections:

Visiting the Regional Forensic Science Lab was a highly informative and enlightening
experience. It highlighted the critical role that forensic science plays in the criminal justice
system by providing objective scientific analysis to support investigations and court
proceedings.

The structured approach of the lab in handling different types of evidence underscored the
meticulousness required in forensic investigations. It was impressive to witness the
integration of advanced technology and specialized knowledge to uncover crucial details that
contribute to solving criminal cases.

Moreover, the visit emphasized the interdisciplinary nature of forensic science, combining
principles from physics, biology, chemistry, and cyber forensics to analyze diverse forms of
evidence. This interdisciplinary approach ensures comprehensive and reliable forensic
analysis, enhancing the credibility of findings presented in court.

Overall, the visit to the Regional Forensic Science Lab deepened my appreciation for the
precision, dedication, and expertise involved in forensic investigations. It also sparked my
interest in exploring further how advancements in forensic science contribute to justice and
societal well-being.

DAY - 11
ATTENDING THE HIGH COURT UNDER JUS P.J AJITH KUMAR SIR

Entered service as a Magistrate in 1991 and became District Judge in 2011. Functioned as
Deputy Director and Additional Director in the Kerala Judicial Academy and as Registrar
(District Judiciary) in the High Court of Kerala. Sworn-in as Additional Judge of the High
Court of Kerala on 20.10. 2021. Cases under POCSO jurisdiction were heard and we were
able to sit in the court well and hear court proceedings.

DAY - 12

ATTENDING THE DISTRICT COURT PROCEEDINGS UNDER DJ


HONEY M VARGHESE

On this day no opportunity to attend the district trial court proceedings under the guidance of
District Judge Honey M Varghese was provided. Clear idea on the proceedings of the trial
court was inherited. through the observation of processing an idea on the jurisdiction, issue of
bail, rash and negligent driving and the limitation act was also observed.

DAY - 13

ATTENDING THE HIGH COURT UNDER JUS P.J AJITH KUMAR SIR

Entered service as a Magistrate in 1991 and became District Judge in 2011. Functioned as
Deputy Director and Additional Director in the Kerala Judicial Academy and as Registrar
(District Judiciary) in the High Court of Kerala. Sworn-in as Additional Judge of the High
Court of Kerala on 20.10. 2021. Cases under POCSO jurisdiction were heard and we were
able to sit in the court well and hear court proceedings.
DAY - 14

WORK SHADOWING UNDER ADV. JOHN RALPH IN DISTRICT


COURT.

Work shadowing under Adv. Apoorva Ramkumar Nambiar under the guidance of Adv. John
Ralph. Visited the judicial first-class magistrate Court, principal session court and also chief
judicial magistrate Court. I had a learning experience into admission of cases, how the trial

SAMVADA SESSION

Activities:

Today, I participated in a SAMVADA session organized by KELSA (Kerala State Legal


Services Authority), a weekly legal awareness program conducted for school children. The
session took place at the Adalat Hall, Ram Mohan Palace, and the Central Police Station in
Ernakulam. The activities included:

1. Interactive Session with Legal Authorities: We had the privilege of interacting with
the new Member Secretary of KELSA and a serving judge of the Kerala High Court.
This provided a valuable opportunity to gain insights into the legal system, judicial
processes, and the role of legal institutions in society.

2. Legal Awareness Sessions: Special sessions were conducted on important legal topics,
including:

o POCSO (Protection of Children from Sexual Offences) Act: Education and


awareness about child protection laws under POCSO were provided,
emphasizing the rights of children and legal measures against sexual offenses.

o NDPS (Narcotic Drugs and Psychotropic Substances) Act: Understanding


of the legal provisions related to drug offenses and their implications.

children's welfare and address issues related to child rights and safety.

4. Session with JUS P N BABU Sir ; We were able to interact with him and interns and
the students who attended Samvada session asked questions.

Reflections:

Participating in the SAMVADA session was a highly enriching experience that deepened my
understanding of legal awareness and child protection initiatives in Kerala. The interactive
sessions with esteemed legal professionals provided valuable insights into the complexities of
legal frameworks and the challenges faced in ensuring justice and protection for vulnerable
groups, particularly children.

Learning about the POCSO and NDPS Acts underscored the importance of legal education in
safeguarding children's rights and combating crimes against minors. The sessions not only
highlighted the legal provisions aimed at protecting children but also emphasized the role of
community awareness and proactive measures in preventing and addressing such offenses.

Furthermore, the sessions by Kerala Child Care offered a comprehensive perspective on the
collaborative efforts between legal authorities and law enforcement agencies in promoting
child welfare and safety. Understanding the initiatives undertaken by Kerala Police Services
reinforced the significance of coordinated responses and holistic approaches to addressing

COURT VISIT KALOOR CBI SPECIAL COURT


A visit to the Special Court of the Central Bureau of Investigation gives immense
opportunities mainly in cases related to crimes and murders. Attending the court Proceeding
gave an idea to interpret different sections under the Indian Penal Code. I understood that the
bear reading of the act is not sufficient to encrypt the cases as the section itself has different
implied concepts.

DAY-17

FAMILY COURT PROCEEDINGS

An overview into proceedings in family court under the guidance of judge, Adv. Baiju. A
crisp idea on the marriage laws in India like the Hindu Marriage Act, the Sharia law Christian
Marriage Act and special Marriage Act was acquired. A petition for seeking the custody of
child distribution of assets and also granting divorce was also served. It was a great learning
experience in the family court knowing the issues different families face.

DAY-18

VICTIM RIGHTS CENTRE.

A session by Adv. Vidya, one of the panellists on the Victim Rights Centre, took a session on
the VRC and CLAP of KELSA. The session discussed a lot of victim right centre, child legal
assistance program and other initiatives by KELSA to protect both the accused and victim
who need Free Legal Aid.
DAY 19

WORK SHADOWING UNDER ADV. MITHA IN HIGH COURT.

On the 19th day of internship ,we worked under the Adv Mitha regarding the cases coming
under POCSO jurisdiction. We were allowed to sit in the court well and see the proceedings.

The internships offer valuable opportunities to apply legal knowledge in real world situations.
During my internship I was able to work in a Real-world legal environment gaining exposure
to various legal tasks such as legal research, attending client meetings, participating in court
proceedings and even an interactive session with the serving judges of Kerala High Court. By
working alongside experienced lawyers, I was able to gain insights into how the law is
practised in real world scenarios. I was able to observe how legal professionals analyse things
and apply legal concepts, navigating the complexities of the legal system and communication
with clients and other stakeholders. This internship hands on experience help me to develop
essential skills for a legal career such as legal research, writing communication and time
management. By networking during internship, I was able to expand my professional
network, which can be valuable for future career prospect.
