repugnant to the context or meaning thereof shall deemed to include their
heirs, successors, executors, administrators and assignees) of the
SECOND PART.

WHEREAS, by virture of Registered Assignment Deed day Book


No. AGG-3-3855 dated.17/07/2008 the Assignor is the absolute owner
and possessor of Flat No. 1, on Ground Floor, in the building known as
"ROYAL RESIDENCY" built up area of flat adm. 83.64 Sq. Mtrs
(899.99 Sq.ft) Situated at, Plot No.32 Survey No.73, Mukundwadi Town
Center Sector-G, N-5 CIDCO, AURANGABAD. (which is particularly
described in Schedule of Flat written hereunder)

Deed of Assignment 1
WHEREAS, the said property permission for construction of the
building as per commencement certificate No.
CIDCO/ATPO/BP/AUG/2000-8036 dated.05.01.2000 from CIDCO
authorities for above mentioned property as per plans sanctioned by the
CIDCO authorities.

WHEREAS, the said residency is already registered /Declared Under


Sec. 2-A of the Maharashtra Apartment Ownership Act 1976, through
Declaration Deed, registered on dated 07.01.2000 bearing day Book No.
123 and thereby submitted the said building to the provisions of the
Maharashtra Apartment Ownership Act.

AND WHEREAS, as per Deed of Assignment executed by the


assignor, it has been that the Flat No. 1, on Ground Floor, in the building
known as "ROYAL RESIDENCY" built up area of flat adm. 83.64
Sq. Mtrs (899.99 Sq.ft) Situated at, Plot No.32 Survey No.73,
Mukundwadi Town Center Sector-G, N-5 CIDCO, AURANGABAD.
belongs to Assignor, which is under consideration of this Deed of
Assignment.

AND WHEREAS, the Assignor/Party of first Part had executed Sale/


Purchase Agreement for the sale and transfer of Leasehold & proprietor
rights in the said Flat in the name Assignee at consideration of
Rs.38,00,000/- (Rupees Thirty Eight Lakh only)

THE CONSIDERATION AMOUNT PAID AS BELOW:

Full and Final Consideration amount is Rs.38,00,000/- (Rupees


Thirty Eight Lakh only) was paid by Assignee to Assignor as Follows:

AND WHEREAS. the Assignor herein desires to transfer the said


Residential Flat to assignees.

NOW, THIS DEED OF ASSIGNMENT EXECUTED AND


WITNESSETH AS FOLLOWS:

1)The Assignor hereby assigned to Transfer of the leasehold and


proprietary rights to occupy the said Residential Flat and all his rights,
title and interest herein in favour of assignees, for the above said
consideration amount has cleared all taxes cases etc. upto the date of
execution of these presents and its will be entirely the liability of the
Assigneeto pay the same hereafter. If any arrears thereof the Assignor
shall be liable to clear the same as and on pointed out by the Assignees.

2) The Assignor hereby agrees to indemnify and keep indemnified the
Assignee against any loss of or liability claim or demand that may be
sustained if any due to this contract of Assignment for defect in title or
right of Assignment if any, of the Assignor.

3) The Assignor hereby agrees to sign all necessary applications,


affidavit, indemnity bonds plans and other deeds and documents as may
be required to be signeded executed for getting completed required
formalities to complete and give effect to the transaction agreed herein
and to get the names of the Assignee recorded in the office of the
CIDCO.

4) A true certified copy of the instrument of transfer between the


Assignor and the Assignee will be deposited with the Administrators of
CIDCO within seven days from the date of its execution.

4) The Assignee shall get MSEB light connection, and Cidco/


Municipal Corporation water connection relating to the said Flat hereby
conveyed transferred in his name without any further consent in writing
of the assignor.

5) That the common area of the staircase on all the floor and land
staircase and terrace will be commonly shared by all the Flat purchaser of
the building.

6) The Assignee doth hereby further convenient with the Assignor and
undertake that the Assigneeshall not sell, assign mortgage sublet or other
wise transfer wholly or party with the possession of the premises above
and except the previous written permission of the CIDCO which
permission shall not be refused if the Assigneeperform or is willing to
perform the citations that is to say.

a) The Assigneehas already paid amount of premium of transfer fees of


charges prescribed by CIDCO.

b) In the instrument by which the Assigneeshall transfer the said


premises, Assigneeshall bind the transfer not to said Assigneemortgage
under late or other wise wholly or partly the premises or his interest here
in or part wholly or partly with the possession of the premises of the
premises or permit any person to use wholly or partly the premises save
ad except upon the observances and performance of the conditions
therein written.

SCHEDULE
(DESCRIPTION OF THE PLOT)

All that the piece and parcel of the land bearing Plot No. 32
adm.616.875 Sq.Mtrs Survey No.73, Mukundwadi Twon Center Sector-
G, N-5 CIDCO, AURANGABAD. within the Jurisdiction of Sub-
Registrar, Aurangabad and the plot is bounded as under:
