Who is Erkan Mumcu? :

Mumcu was born in Isparta in 1963. He graduated from Istanbul University's Law School.
He became Member of Parliament from Isparta for the 20th and 21st terms. Minister Mumcu
served as the former Minister of Tourism and Vice President of ANAP. He joined AKP in
2002.(1) He served as the Minister of Education. He speaks English. He is married and has
two children. (2) He became the president of ANAP in April, 2005. (3)

Report of the Conferance :

Mumcu started the conferance by explaning the importance of knowledge with the
example of relations of computers and textile; he explained that computer is the first invention
of the humanity because it is the version of the textile sector. Mumcu said that the source of
knowledge is the knowledge of empty-full system which is the base of the textile sector.

Textile is organising the materials in order to make a whole from pieces and materials. That
process developed the organising technology methods. People used this technology to make
shelters and after a long time, this organisation methods turn into the base technology of
computers.
As Mumcu said that the source of law, democracy and all other sciences, which have
humanity and society as a topic, is the concept of right. Right is an universal concept which
has a same meaning from the beginning of the humanity; right of somebody or right of
something. Right of somebody or something cause a distinction between the relations of “me
and others”. As Mumcu mentioned that people who have the concept of “I”, have a life style
which take themselves as the center of their lifes and that is existing consciousness. The
“others” have the existing consciousness and there are different point of views for the same
situation so that cause the problem of conflict. Two different facts occur from the conflict;
power and right. With the growth of human consciousness that conflict finds a solution.
Consciousness of empathy turns into the fact of rights and law. If humanity can not reach the
consciousness of empathy yet, rights and law are not important. In a situation like that, power
is the most important issue. Sovereignty comes out from the power. Law, morality and values
come out from the rights. As Mumcu mentioned that there were time periods which were
govern by power but people, because of a growing knowledge and consciousness, want to
have the concept of law and rights in their life actively. In time, societies try to get rid of the
fear of unreliableness and leaders who have sovereignity try to protect their powers. History
of humanity is a formation of conflict of power and rights.
Empathy creates a point of view which takes everybody equal in social or political life and
that equality turns into a political term as democracy. As Mumcu said that state’s law and
state of law are different terms such as a goverment with constitution and a constitutional
goverment. Superiority of law is a comprehension which is a part of sovereignity of the
universal rigths. Democracy is the most suitable system of goverment for the humans, who
create ethic, laws and act ethical and according to laws, because it is based on an equivalence
system. Democracy define all citizens equal and a part of a sovereignity. Fair elections are the
best examples of that equality and participation to a sovereignity.
Mumcu said that superiority of law and democracy comes from the same base of human
history. He finished conference by repeating the computer example. He said that computer
was invented years ago, with the invention of textile and laws and democracy have the same
relationship.

 Questions & Answers :
One of the spectators asked that the conference is about the superiority of law but
today, in Turkey, the lawsuit can not work efficiently. He gave the example that today,
judges can change the decisions for a suit. He asked what is the ideas and the plan of the
Mumcu about the problems of lawsuit.
Mumcu answered that there is not any society without problems. He said that there are
some cases which is not suitable to the law in Turkey. As Mumcu said that we should not
exaggerate those cases like they symbolize the whole of the system. We should not give
importance to the badness more than it deserve. Our aim is to help to create a civilization.
The freedom and the security of the judges should be protected. The number of judges are
not enough and they have too many jobs to do. The system of prosecutor is not working in
Turkey. Most of the administrative provinces have only one or two prosecutor and that is
not enough. A new group of police should be set up and there should be more province. If
a country gives enough importance to the law system, it should give enough budget to the
system for a better performance. The cost of a law system which is not working efficiently
will be very heavy. Non of the political systems will be maintained if society can not trust
its justice so the only way to protect the union is protecting the justice. As Mumcu
mentioned that the only way to protect the security of state is having justice. The security
of the country depends on the justice and the only way for development is law.
A student asked if Anavatan has a development plan. He also asked the mission of the
opposition.
Mumcu answered that the mission of the opposition is the control of democracy.
Opposition should be the sound of the minorities. Also the society wants opposition to
create an alternative choice for the party in power. The party in power should take the
criticism of the opposition seriously. Mumcu gave the example of the education plan for
the question of the development plans. He said that they made a plan for education which
is starting from the kindergarten to university with all the details. He said that he thinks
todays education plan is wrong.

My comments on the conference :

I think the conference started very good. Mumcu gives very good examples and
definitions at the beginning. Then the language of the conference became more difficult.
Mumcu used lots of long and complicated sentences which are not easy to understand
even they are my own language. He did not speak too much about the topic and he gave

 same examples again and again. Except these points, although the conference is not long it
is good and illuminating. I like the computer-textile example.

Genel Başkanımız, yargı bağımsızlığıyla ilgili soruyu yanıtlarken, hakim bağımsızlığının

mutlaka güvence altına alınması gerektiğini belirtti. Adli polis teşkilatının kurulması
gerektiğini söyleyen Genel Başkanımız Erkan Mumcu, savcıların sayısının da artırılması
gerektiğini ifade etti. Kalkınmanın ve zenginleşmenin anahtarının hukuk olduğunu söyleyen
Genel Başkanımız, ''Demokrasi bizim aşığımız, ekmeğimiz'' dedi.

Öğrencilerin, muhalefet olarak eleştiri dışında getirdikleri çözüm önerilerini sormaları

üzerine Genel Başkanımız Erkan Mumcu, bunları tüm ayrıntılarıyla anlattıklarını kaydetti.
En son eğitim reformuyla ilgili olarak, tüm ögelerini kapsayan çözüm önerisi sunduklarını,
ancak bundan kimsenin haberdar olamadığını belirten Genel Başkanımız, şöyle konuştu:
''Yaygın medya günlük tartışmalar üzerinden haber yaptığı için bu gibi öneriler propaganda
olarak algılanıyor. Şeffaflıktan söz edelim diyorum, (onu git sen Bilkent öğrencilerine anlat)
diyorlar. Ne bekliyorlar Tayyip Erdoğan'ın gücü Kemal Unakıtan'ı bakan tutmaya
yetmeyecektir. Çünkü milletin vicdanı galip gelecektir.''

Genel Başkanımız, milletin Başbakan'a cevabının ''al Kemal abini de git'' olacağını ifade
etti.

Genel Başkanımız Erkan Mumcu, bir öğrenci tarafından, 7. Cumhurbaşkanı Kenan Evren'in
cumhurbaşkanını halkın seçmesi gerektiği yönünde önerisi olduğunun hatırlatılması üzerine,
''Kenan Paşa'ya teşekkür ediyorum. Kendisinin bu ülkeye armağan ettiği yanlışlardan bir
tanesinin düzeltilmesi yönünde bir katkıda bulunmuştur'' dedi.

Cumhurbaşkanının halk tarafından seçilmesi önerisini yineleyen Genel Başkanımız,

''Türkiye'nin gerçek anlamda demokratikleşmesinin tek yolu cumhurbaşkanını halkın
seçmesidir'' diye konuştu.

Genel Başkanımız Erkan Mumcu, AK Parti ile ilgili bir soru üzerine, ''birleştirici
olacağız, yoksulluğa, yolsuzluğa karşı mücadele edeceğiz'' diyerek iktidara geldiklerini,
ancak bu sözlerin yerine getirilmediğini ileri sürdü. (5)

Mumcu, Bilkent Üniversitesi'nde düzenlenen ''Hukukun Üstünlüğü ve Demokrasi''
