AND
Mr. Vijay Ram Lama son of Mr. Ram Jange Lama, age 46, Pan No. ACPPL6442A, AND Adhar
No. 947309986395, residing at Room No 32, Saibaba Adivasi Rahivasi Sangh, Road No. 16,
Andhri east Mumbai 400093.
THIS AGREEMENT made and entered into at Mira Road Thane this…….th day of October,
2021 BETWEEN Mr. Pankaj Jha hereinafter called "the Lender" AND Mr. Vijay Ram Lama
hereinafter called "the Borrower" and reference to the parties hereto shall mean and
include their respective heirs, executors, administrators and assigns;
WHEREAS both parties are known to each other. The Borrower is in need of funds and
hence has approached the Lender to grant her an interest-free loan of Rs.2,00,000/-
(Rupees Two Lac only) for a period of Two Month;
AND WHEREAS the Lender has agreed to grant a loan to the Borrower, free of interest, as
the Lender and the Borrower have known each other since several years;
AND WHEREAS the parties hereto are desirous of recording the terms and conditions of
this loan in writing;
NOW THIS AGREEMENT WITNESSETH and it is hereby agreed by and between the
parties hereto as under:-
1. The Borrower hereto, being in need of money, has requested the Lender to give her an
interest-free loan of Rs.2,00,000/- (Rupees Two Lac only) to enable for financial need.
2. The said loan is required by the Borrower for a period of Two Month, commencing
from 18/10/2021 and terminating on 18/12/2021.
3. The Borrower hereby agrees and undertakes to return the loan of Rs. 2,00,000/-
(Rupees Two Lac only), in instalments, within the aforesaid period of Two Month and gives
her personal guarantee for the same.
4. The terms and conditions of this Agreement are arrived at by the mutual consent of the
parties hereto.
5. As security against the amount provided as per abovementioned details the borrower
without any pressure and out of his own will has provided following:
6. Borrower has given post dated cheque vide Cheque no.000026, 000027 and 000028,
Of HDFC Bank which is presently dated respectively as 16 December 2021. These are to be
used after Two Months for repayment. The borrower undertakes along with this that he
will never complain to bank, police or other authority that these cheques were lost or
fraudulent. Borrower shall maintain sufficient balance to honour these cheques. Also that
the borrower legally undertakes that the signature done is correct and he will not change
the bank signature and if he does so then he will provide us valid replacement cheques
immediately.
7. In addition to cheques above-mentioned, borrower and his brother Mr Raju Lama
willfully offering custody of following deeds for sake of surety. Borrower and his brother
Mr. Raju Lama are ready to pledge these deeds/documents.
1. Sale Agreement made and entered into at Mumbai on this 11 day August 2009. Original.
2. Irrevocable Power of Attorney Original
3. Affidavit Original
4. Indemnity Bond Original
5. Electric Bill Original
8. Lender shall return these documents, once loan is repaid to him. In any case if cheque
gets dishonoured to insufficiency of funds, closing of account or any other reason,
Borrower shall be responsible for legal consequences. Cost of legal proceedings shall be
borne by Borrower.
IN WITNESS WHEREOF the parties hereto have hereunto set and subscribed their
respective hands the day and year first hereinabove written.
