hereinafter called the Mortgagor which term shall wherever the context mean and
include his heirs, executors, administrators, legal representative and assigns of
the one part;

In favour of The Karur Vysya Bank Limited, a Banking Company incorporated


under the provisions of the Indian Companies Act, 1913 having its Registered
Office at Erode Road, Karur - 639002 and a Branch at Udumalpet hereinafter
called the Mortgagee which term shall wherever the context admits, mean and
include its executors, administrators, legal representative and assigns of the
other part;

Whereas the mortgagee has sanctioned additional loan of Rs.450.00 lakhs


(Rupees Four crores and fifty lakhs only) (Enhancement in OCC Limit Rs.300.00
lakhs and fresh Corporate Term Loan of Rs.150.00 lakhs) to the borrower M/s
Pavathal Spinning Mills Private Limited and mortgagor hereby confirms having
visited the bank’s branch at Udumalpet on 10/06/2024 by expressing the
mortgagor’s intention to create the mortgage under properties described in
Schedule - B hereunder by way of constructive deposit of the title deeds enlisted
in the schedule A hereunder with the intent under section 58(f) of Transfer of
property Act, 1882 to secure the above secured credit limits to clear the entire
dues under the said credit limits, including the principal interest thereon at the
rate stipulated by the bank, cost of realization of the security and all other
expenses incidental thereto to the satisfaction of the bank.

Except the mortgage already created in favour of the Bank, the Mortgagor,
hereby covenants that the said property is not subject to any lien, charge, or any
other kind of encumbrance whatsoever and that the Mortgagor is the absolute
owner of the same and is well and truly seized of the property. The Mortgagor

further agrees to keep the Mortgagee indemnified against all claims and demand
whatsoever by any person lawfully or equitably claiming under him and by any
other person whatsoever.
