be please to issue paper publication in Kannada daily newspaper

‘HOSADIGANTHA’ to the of Proposed LRs of Defendant No.3, (a)

& (b) in the interest of Justice and equity.

AFFIDAVIT

I, Rajanna S/o Bylappa , Aged about 69 Years, Residing at


No. Dabaspete Police station, Sompura Hobli, Nelamangala
Taluk, Bangalore Rural District, do hereby solemnly affirm and
state on oath as follows:
1. I state that I am the plaintiff in the above case, and well
conversant with the facts of the case. Hence I am swearing to
this affidavit.

2. I state that, I am filed a suit for Declaration and


Permanent Injunction against Defendants.

3. I state that, Proposed LRs of Defendant No.3 (a) & (b). is


the Mortgage of the suit schedule property, I am furnishing
fresh steps taken to the Proposed LRs of Defendant No.3 (a) &
(b) to the address in the cause title of Proposed LRs of
Defendant No.3(a) & (b) but that address is wrongly mentioned
in cause title the RPAD returned as ‘not residing in the
address’. Once again fresh steps taken to the fresh address
through RPAD where Proposed LRs of Defendant No.3(a) & (b)
is residing. The RPAD issued to the Proposed LRs of Defendant
No.3(a) & (b) returned unserved with postal shara ‘insuffient
addresses’. This is the last known address & Proposed LRs of
Defendant No.3(a) & (b) to the Plaintiff Hence the notice cannot
be served on the Proposed LRs of Defendant No.3(a) & (b) in
ordinary way. Hence it has become necessary to serve the
notice to the Proposed LRs of Defendant No.3(a) & (b) by way of
substituted service i.e. By way of paper publication. Hence this
accompanying application.

5. I further submit that, if the application is allowed no


prejudice would be caused to the other side on contrary if the
application is not allowed, I will be put to great hardship and
loss.

WHEREFORE, I pray that this Hon'ble Court may kindly be


pleased to allow the accompanying application as prayed for,
in the interest of justice and equity.
