1. I, Mr. B.J.Dinesh, (a/29) S/o Mr. Babu, Hindu Residing at

Santhaipetai, 2nd Street, Pallipattu Thiruvallur Dist. is
Do here by states as follows:-

2.I am the 1ST petitioner herein and as such I am well

acquainted with the facts of case.

3. I humbly submit that That marriage of the 1ST Petitioner

and the 1st Petitioner Wife P.VIJIYA was solemnized on 29 th
June 2023 at Karimbedu Village, Pallipattu Taluk,
Thiruvallur Dist, according to Hindu rites and ceremonies.
before the elders of the 1ST petitioner family along with
their blessings. I submit that their marriage was 1 ST
petitioner and P Vijaya arranged marriage.

4. I humbly that an immediately after the marriage, I set

up separate matrimonial house in first floor in my house, I
submit that the married life was happy for some time and
some after the marriage she started ill-treating me . She
used to pickup quarrel with me and 2 nd petitioner even for
silly things and used to abuse us in filthy language. Used
to pester us and used to stay with her mother home, he
has been tolerating all the harassment of the us so as to
keep up the dignity of the family. he has been suffering
very much cue to the ill-treatment of her.

5. I submit that she never cooked food at home ,she was

forced him to do all house maid work, she used to insisting
him to give more money in which she used to fight with
him without any reason, she used to nag him as impotent
and she abused him filthy language in public stating that
No use of living(impotent) with him which causing mental
agony and, she was in the habit of going away from home
without informed to him and she does not cook , whenever
he comes house after work , she used to ask him to have
biscuit, several time he sleep with empty smock , he used
to come home late in which she talked to some one over
phone in mid night, he enquired her she refused to answer
after rummaging her,
6. I submit that they were living separate room in my
house first floor without interference of us, we are 1 st &
2nd petitioner herein, we were living separately in second
floor without involved day to day activities of his
matrimonial life

7. I submit that After that, the wife of the first petitioner

and the daughter-in-law of the second petitioner called
their mother, father and brothers to the house of the first
petitioner and the second petitioner on the 15-09-2023 of
last year and immediately after they entered the
matrimonial house, they started attacking the first
petitioner without asking anything. 1st Petitioner wife is
other half is not mentally ready to enter into married life
with the 1st Petitioner, and keeps pestering the 1st
Petitioner every day like a small child to go to the house of
the 1st petitioner wife, all his practices are childish.

8. I submit that After that, the first petitioner and the

second petitioner filed a complaint against the petitioner
wife brother and father at the Pallipat police station on
16-09-2023. In that name, the petitioner's wife called the
petitioner's police station and called them for questioning.
The petitioner's wife said that she would not live with the
petitioner. Besides, the petitioner's wife took back all the
jewelry given by the petitioner on behalf of the house on
20-09-2023 and petitioner wife's father have also signed
on 20rs Non Judicial Paper.
9. I submit that the petitioner's wife has lodged a
complaint with the respondent containing a false
allegation against the petitioners, on the basis of which
the respondent has registered a false case against us
without even investigating our justification. The petitioner
submits that above case has been filed against Petitioner /
accused 1 and 2 and they was not arrested by the
respondent police herein on 30.11.2023 for alleged
offences U/s. 498(A) r/w 34 IPC and Sec 3&4 of D.P Act,
and later he was released on Police Station bail of Two
Sureties.

10. The petitioner submits that the main allegation as

against the Petitioner that the respondent and Viz P
Vijaya. The Petitioner further state that on completion of
investigation, the respondent had filed a Complaint before
the Hon’ble First Class Judicial Magistrate Court, IPC and
DP Act, and assigned in C.C.No. 785 of 2024. The
respondent had filed a Complaint for alleged offences U/s.
498(A) r/w 34 IPC and Sec 3&4 of D.P Act, and to
substantiate their case, cited 8 Witnesses, Documents
and Nill Material Objects to prove the allegations against
the petitioners viz., Shri BJ.DINESH AND JGADESHWARI
the same was made over to this Hon’ble Court.

3. The petitioner submits that the case of the respondent

is that, on 13-11-2023, they had received a Complaint,
that the description was found in each of the carton Viz.
P.Vijaya,
Therefore , I prayed that this hon’ble court may be
pleased to delete the name of the
petitioners/Respondents herein in the above said C.C.No.
785 of 2023 and pass such further or other orders as
this Hon’ble court may deem fit and proper in the
circumstances of the case and thus render justice.

1. I, Baskaran S/o Devendiran , Hindu, aged about 54 years, residing at

No. 54/90, Chozhan Street,Rajajipuram, Tiruvallur District. Do here by
states as follows:-

2.I am the 1ST petitioner herein and as such I am well acquainted with the
facts of case.
3. I humbly submit that my brother in law and respondent fell in love
with each other, due to love affair, since she afraid of her family members

she had eloped with him without appraised to her family member in the
year of November 2020 then our family members were nod for marriage
and the same was registered in Sub registered office in Arakonam On
27.11.2020. due to love marriage, her family members were against the
love marriage, marriage was not informed to her family members, her
family members did not take part in marriage, her family members not to
move with her , since she eloped from her parent home so that she did not
bring sridhana article, the entire marriage expenses were meted out by
him, nothing was also given as dowry to him. Due to worldwide lock
down , during pandemic period of 2020, there was no congregation was
allowed by government. Out of wed lock no children were born to them.

4. I humbly submit that an immediately after the marriage, his parents set
up separate matrimonial house in first floor of house in arrakonam , I
came to learn that she had lived with him just one month in which she
picked up unnecessary quarrel with him and left matrimonial home on
20.12.2020 with all her belonging , she just one month alone lived with
me, after marriage we never visited their matrimonial house , we have
been living separately in Rajajipuram at Tiruvallur District, other district.
We never known their day to day their matrimonial affaire.

5. I submit that they were living separate room in first floor without
interference of others in ranipet district , we were living separately in
tiruvallur district without involved day to day activities of their
matrimonial life ,I further submit that we were sister and brother in law of
vinoth kumar since we were implicated in this case, we have nothing do
with their matrimonial house. In order to avenge us, the respondent
indicted our name falsely and there was no substantial evidence for the

same, we were wrongly implicated in the DVC case and the respondent
does not attribute any specific overt act as against us and vague charge
levelled against us, respondent only just only one month alone lived in
matrimonial home during pandemic period, after three years, she filed
this DVC compliant in order to extract money from him, she is working
in IT company in Bangalore, after marriage we did not visit her
matrimonial home.

Therefore , I prayed that this hon’ble court may be pleased to delete the
name of the petitioners/respondent herein in the above said D.V.C.No.2
of 2024 and pass such further or other orders as this Hon’ble court may
deem fit and proper in the circumstances of the case and thus render
justice.
