In this insightful Interview, we had the privilege of speaking with an Experienced Lawyer, Mr.
V. Vargees Amal Raja, BSc. Chemistry, BL, ML, who shared his journey from Law degree
to becoming a successful practicing lawyer and various valuable Advices and Teachings.

INTERVIEWER: Can you share your journey from a Law degree to becoming a practicing
Lawyer?

LAWYER: My journey in the field of Law was both Challenging and Fulfilling. After
graduating with a Bachelor's and Master’s Degree in Law, I completed my mandatory
internship at a respected Law firm. This experience was crucial as it provided me a practical
exposure to real-world cases. My journey included passing the exams, securing my first job at
a law firm, and later establishing my own firm. Each of these steps was important in Creating
my career and Professional development.

INTERVIEWER: How do you manage your workload?

LAWYER: Managing workload is essential in the legal profession. I use a mixture of time
management practices and digital tools to keep track of my cases and deadlines. Additionally,
giving tasks to my team members, when required ensures that we can handle multiple cases
simultaneously without compromising on excellence.

INTERVIEWER: What skills and qualities do you believe are essential for a successful
Lawyer?

LAWYER: A successful Lawyer needs a balance of various Skills and Qualities. Strong
Analytical and Research skills are crucial for understanding laws and Cases. Communication
skills, both written and verbal, are necessary for presenting arguments, Physically Intensive,
Clear thinking, Body Language, and Negotiating skills are also vital. Moreover, being
Empathetic and Understanding clients' needs helps in building trust.

INTERVIEWER: What advice would you give to students who are considering a career in
law?

LAWYER: For students considering a career in law, my advice would be “Initial Tension is
always Necessary for a Successful Job” and also to stay Curious, be Bold, work hard, be
Agile and committed. Gaining practical experience through Internships and Networking with
professionals in the field can provide valuable Perceptions and Opportunities. Also, choosing
a Specialization in Law that aligns with your Interests and Strengths will help you build a
Fulfilling career.

INTERVIEWER: How did you feel when you won your First Case?

LAWYER: My first case was Against a well-known Political Party and their Legal team was
quite Experienced but I was Strong in my Prosecution and Won the case against the Political
Party. But the best part of it was Both the Court members and the opposite legal team
appreciated my Boldness and Clarity in the case and at that time I felt “I was in a Cloud”. So,
I was Ecstatic and Happy, when I won my First case.

INTERVIEWER: What emerging technologies do you think will have the most significant
impact on the legal profession?

LAWYER: Emerging technologies such as artificial intelligence (AI), and legal tech software
are set to transform the legal profession. AI can assist in legal research and document review,
making these processes Easier and more Efficient. Also, legal tech software can modernize
case management and client communication, improving overall productivity and service
delivery.

INTERVIEWER: How do you maintain a healthy work-life balance in a profession like law?

LAWYER: Maintaining a healthy work-life balance is challenging but achievable. Setting

clear boundaries between work and personal time is essential. I make it a point to schedule time
for relaxation and Spending time with my Family, and I prioritize self-care. Giving tasks and
seeking support from colleagues also helps in managing workload. Also, I believe in the Saying
which is “Eat Half, Walk Double, and Laugh Triple” and Practicing these mindfulness
habits like Walking and Laughing can contribute to overall well-being.

INTERVIEWER: How do you stay updated with changes in law Field?

LAWYER: Staying updated with changes in the law field is crucial for any practicing Lawyer.
I regularly attend Legal Seminars, Workshops, and Conferences to stay informed about the
latest developments. Subscribing to Newsletters, and Social Media which provide updates on
case laws and legislative changes is also helpful. Also, being part of Professional networks
allows for the exchange of Knowledge and Understanding with Colleagues.

INTERVIEWER: Where do you see opportunities for growth in the legal field?

LAWYER: Opportunities for growth in the legal field are abundant. The integration of
technology into legal practice offers numerous possibilities for improving efficiency and client
service. Also, being close to Judges and Officials can make you Famous and help you to Grow
Fast and Quickly with more Clients.

INTERVIEWER: Have you faced any threats or truce calls in your career as a Lawyer?

LAWYER: As a Lawyer, facing threats or truce calls is common, especially when dealing
with Political or Government cases. As it is Confidential, I cannot disclose it. However, it is
important to handle such situations with professionalism by Maintaining a strong Support
Network and having a clear strategy for dealing with threats is essential. Also, always be Ready
to make Counter Threats if they go out of hand and I have made many in my career.

 ANALYSIS OF A CIVIL CASE

INTRODUCTION

This Report was created from a Court Judgment document provided by an

Advocate, Mr. V. Vargees Amal Raja, BSc. Chemistry, BL, ML. This Report Analyses a
Court Case regarding a Loan Agreement. The case involves a Plaintiff (Lender), who lent a
sum of money (Rs. 8,15,000) to a Defendant (Borrower) in August 2013. While the initial
agreement included an interest rate considered Excessive by the Court, a subsequent document
signed by the defendant in December 2022 showed a repayment plan within three months.
Despite Partial Payments made by the Defendant, the full loan amount remained Unpaid. The
Situation is further complicated by the Defendant's absence from the Court Hearing, leaving
the Judge to rely solely on the Evidence presented by the Plaintiff.

This case serves as an opportunity to learn the importance of clear and documented loan
agreements. We will examine the Arguments presented, the Court's decision, and the valuable
Lessons learned from both lenders and borrowers when making financial arrangements.

FACTS OF THE CASE,

• Loan: Rs. 8,15,000 given by lender to borrower in August 2013.

• Interest Rate: Originally claimed as very high, rejected by the court.
• Loan Assurance Document: Signed by the borrower in late 2022, promising repayment
within 3 months.

ARGUMENTS IN THE COURT,

• Plaintiff claims they gave the defendants a hand loan on 01.08.2013 with an agreed interest
rate of 24% per month.
• Defendants signed a loan assurance document on 13.12.2022 agreeing to repay within 3
months.
• Defendants made partial payments of Rs. 2,00,000 each in December 2022 and January
2023.
• Defendants defaulted on full repayment by June 2023.
• Plaintiff issued a legal notice on 12.02.2024, receiving an "Unclear reply" on 22.02.2024.

PROVISIONS OF THIS CASE,

The exact provisions of the Negotiable Instruments Act of 1881 are directly applicable to this
case which is,

• Section 13: This section states a negotiable instrument, which includes promissory notes.
Since the "Loan Assurance Document" is seen as a promissory note, this section is
Important.
• Sections 61 & 64: These sections deal with the demonstration of promissory notes for
Acceptance and Payment. these sections are relevant since the "Loan Assurance
Document" had specific terms regarding the document for repayment.
• Section 118: This section establishes assumptions regarding negotiable instruments. Since
the instrument is made for consideration and was transferred for a valid exchange between
parties. This assumption could benefit the Lender (Plaintiff) in proving the loan's validity.
• Breach of Contract: Since the "Loan Assurance Document" showed a Repayment plan,
the Defendant's failure to repay could be considered a Breach of Contract.
• Civil Procedure Code (Order XXXVII Rule 1 & 2 of CPC): The case indicates that the
Plaintiff filed a basic Lawsuit procedure for Recovery of Debts based on a "Loan Assurance
Document".

JUDGEMENT,

• The Court ruled in favor of the Plaintiff as the Defendants did not appear in Court on the
date of the Hearing.
• The Judge found the Plaintiff's evidence sufficient to prove the loan and the Defendant's
non-payment.
• The Court considered the claimed 24% interest as "Excessive" and reduced it.
• Defendants are ordered to pay the Principle amount of Rs. 8,15,000/.
• 12% p.a. from the date of the loan (01.08.2013) till the date of the judgment (08.07.2024).
• 6% p.a. from the date of judgment onwards until full payment.
• Defendants are also liable for court costs.

LESSONS LEARNED,

• This Case strongly highlights the importance of having a Written Loan Agreement. A
clear and documented agreement avoids confusion in Interest rates and Repayment
schedules. It also provides Legal Protection if things go wrong.
• As a Student, I understand the importance of Budgeting and Managing Finances. This
Case demonstrates how easily loan agreements can turn Friends and Families into Enemies.
• Clear Communication is the key when Lending or Borrowing money. Discussing
Expectations and Repayment plans openly before finalizing a loan increases Trust and
minimizes Misunderstandings.

 MOVIE ABOUT LAW

victims and their families. Despite his lack of experience and resources, Sakthi is determined
to challenge the corrupt system and take on Adhiseshan's powerful legal team. He faces
numerous obstacles, including threats and bribery attempts, but his determination only
strengthens.

Sakthi's investigation reveals new evidence and witnesses that were previously unnoticed or
suppressed. He gains the support of his mentor and a dedicated judge who believes in the
integrity of the law. The film delves into the ethical dilemmas faced by those within the legal

system and portrays the struggle of an honest lawyer fighting against a corrupt and influential
adversary.

The courtroom drama intensifies as Sakthi presents his case against Adhiseshan. He
meticulously exposes the flaws in the initial investigation, highlighting the manipulation of
evidence and witnesses. Sakthi's arguments and evidence are compelling, making it
increasingly difficult for Adhiseshan's legal team to refute his claims.

Throughout the film, Sakthi's character undergoes significant development. He evolves from a
timid, small-time lawyer into a determined and fearless advocate for justice. His journey is
marked by personal and professional growth, as he learns the true essence of being a lawyer
and the importance of standing up for what is right, regardless of the consequences.

The judge, recognizing the truth and the integrity of Sakthi's efforts, delivers a powerful and
just verdict. Adhiseshan is found guilty of the hit-and-run accident and is held accountable for
his actions. The judge's decision is based on the newly presented evidence and the clear
demonstration of Adhiseshan's guilt. This judgment not only convicts Adhiseshan but also
serves as a significant victory for the victims and their families, bringing them the justice they
deserve.

"Manithan" concludes with the message that truth and justice can prevail even in the face of
corruption and power. The direction, screenplay, and music complement the overall theme,
making "Manithan" a thought-provoking and engaging legal drama that resonates with the
