Agreement of Sale Ii
This agreement of sale is made and executed on this the ------- day of
------------, 2013 at Hyderabad by and between:

SRI ANCHALA NAGESWARA RAO, S/O, ANCHALA CHENCHAIAH,
aged about 33 years, Occ: Pravate Employ, R/o plot No. 379,
vishwakarma Colony, Suraram Village, Quthbullapur Mandal,
Ranagareddy District,Hyderabad.
[Hereinafter referred as Vendee the term which shall mean and include
for all the purposes all his legal heirs, successors in interest, agents,
representatives and assignees, etc. of the second part]
Whereas the Vendor is the absolute owner and possessor of the residential open
plot No. 379, admeasuring 80 sq.yds. equivalent to 67.3 sq.mtrs. (27 X 26.7
sq.fts.) in Sy.No. 190, situated at Viswakarma Colony, Suraram Village,
Qutbullahpur Mandal, Ranga Reddy District, within the limits of Greater
Hyderabad Municipal Corporation and more fully described in the Schedule
hereunder (hereinafter called as Schedule Property). The vendor herein
purchased the Schedule Property from Smt. Nirmala W/o Chandraiah,
As such the vendor is the absolute owner and possessor of the schedule
property since the date of its purchase the vendor is in continuous peaceful
possession and enjoyment of the same without any legal impediments and
without any let or hindrance. Therefore, the vendor is an absolute owner and
possessor of the above said schedule property.
Now, the vendor herein offered to sell the Schedule Property to the vendee
herein for a total sale consideration of Rs.2,40,000/- (Rupees two lakhs and forty
thousands Only) and the vendee agreed to purchase the same.
In pursuance of the above said offer and acceptance, both the parties have
mutually decided with free will and consent to reduce the terms and conditions as
agreed between them and reduce into writing by way of these presents:
2. The vendor herein do hereby sell, convey, transfer and assign to the
vendee the property described in the schedule below and delineated in the
plan hereto with all such rights and improvement as were secured by them
and said schedule property is free hold and free from all sorts of
encumbrances, etc. unto and in favour of the vendee by way of this
absolute sale and delivered the physical peaceful and vacant possession
to the vendee.
3. The vendor hereby covenants that the schedule property hereby conveyed
to the vendee and the vendee hereinafter shall hold and enjoy the
schedule property as an absolute owner as likes without any let or
hindrance either from the vendor or from any person or persons
whomsoever from his legal heirs and successors in interest.
4. The vendor covenant that no person or persons having any kind of right,
share or any kind whatsoever in the schedule property and which is totally
free from all sorts and encumbranbces, claims, charges disputes and
litigations, etc. further free from legal impediments and minors claims, etc.,
and there are no disputes pending on the schedule property and land
acquisitions proceedings, etc.
5. The vendee herein is entitled to claim damages for any lose or damage
caused and sustained by her out of the defective title and possession of
the vendor herein and vendor is also liable for breach of trust for wrongful
disclosure and suppression of any material facts, which negativate the
rights and possession of the vendor and cause loss to vendee in any
manner whatsoever or by virtue of the acts and deeds of any of the vendor
herein.
6. The vendor hereby covenants that he cleared all the dues and pending
bills whatever payable on the said schedule property to the Government
till this date.
9. The vendor hereby indemnify to the vendee and keeps indemnified the
vendee by all means and to make good loss against any loss, damages or
any of its kind which the vendee may suffer or caused by virtue of any kind
of dispute/s arises or due or defective title of the vendor on schedule
property and found subsequently or by virtue of any third party or minor,
government claims whatsoever may be made by any persons or
institutions of Government or persons claiming under the vendor herein.
SCHEDULE PROPERTY
In witnesseth thereof the vendor herein signed on this sale of property with
possession with free will and consent in the presence of the following witnesses
on the date and place mentioned supra.
