High Court Bar Assn. v. Union of India”, M.P. Reorganisa- tion Act, 2000 empowered the State Government to abolish State Administrative Tribunal. The validity of the provision was challenged on the ground that the delegation of power conferred on the State to abolish the tribunal was in the nature of “excessive delegation” as it was “essen- tial legislative function” or “legislative policy”. Negativing the contention and holding the provision as conditional leg- islation and referring to earlier decisions, the Supreme Court stated: 173.
