 Notice for commencement of mining operations under sec. 16 of the Mines


Act to be sent to Chief Inspector, Controller IBM and District Magistrate one
month before commencement of mining operations shall be given in FORM
1A.
 Documents to be submitted along with the notice
o Mine boundary

o Shafts/mine openings
o Tri-junction or revenue pillars, and other prominent & permanent
surface features
 In case of change in the boundary of a mine under regulations 121 and 122 a
plan showing the new boundary shall be submitted within 7 days of the
change.
 A copy shall be sent to Regional Inspector also
 Notice to CIM & RIM shall be accompanied by
o A copy of surface plan
o A copy of Safety Management Plan
 When mine has been opened the actual date of opening shall be
communicated to CIM, RIM and DM forthwith.

 To be sent in Form 3 to CIM, RIM and DM


o On or before 1st Feb. every year
o Within 30 days of change of ownership
o Within 30 days of abandonment or closure
o Within 90 days of discontinuance of mining operations for more than
60 days

 When it is intended to abandon a mine or close a mine or seam or


discontinue workings for more than 60 days, a notice is to be sent not less
than 30 days before abandonment, closure or discontinuance
 Notice of closure or abandonment shall be submitted in Form 1C and notice
of discontinuance in Form 1D

Chapter - 2
 If mine working are below a property government, local authority or railway
or below a building/permanent structure not belonging to the owner of the
mine, such notice of intention shall be given 30 days before
 After abandonment, closure or discontinuance has occurred the O, A or M
shall give notice within 7 days of such thing to RIM, CIM and DM

 When it is intended to reopen a mine or seam after abandonment, closure or


discontinuance for a period exceeding 60 days the O, A or M shall not be less
than 30 days before resumption of mining operations, give to CIM, RIM and
DM notice in Form 1B.
 When mine has been reopened, actual date of re-opening shall be
communicated forthwith to CIM, RIM and DM

 Within 7 days, notice shall be sent to CIM and RIM as follows


o Change in name of mine in Form 2A
o Change in ownership of mine in Form 2B
o Change in address of O, A or M in Form 2C
o Appointment of agent, manager, engineer, surveyor, ventilation
officer, safety officer or assistant manager in Form 2D
o Termination of agent, manager surveyor, ventilation officer, safety
officer or assistant manager in Form 2E
 When ownership of a mine is transferred, the previous owner or his agent
shall make over to the new owner or his agent, within 7 days of the transfer
all plans/reports/registers/other records maintained.

Chapter - 2
 Every such person shall be an agent for the mine or group of mines in respect
of responsibilities specified in the statement
 Any change in the names or other particulars of the statement shall be
reported to CIM and RIM within 7 days

 When there occurs in or about a mine:-


o An accident causing loss of life or serious bodily injury in connection
with any mining operation
o A dangerous occurrence of the type given below the O, A, or M shall
inform the RIM forthwith by telephone, fax, e-mail or by special
messenger
o Within 24 hours of the occurrence give notice thereof in Form 4A to
DM/CIM/RIM and in case of fatal or serious accident also to the
competent Authority for payment of compensation
 Types of dangerous occurrences
o An explosion or ignition
o A spontaneous heating or outbreak of fire
o Fire in any part of workings or in any machinery
o Fall from height of any excavation, loading or transport machinery
o Bursting of equipment under pressure
o An influx of inflammable or noxious gases
o An irruption or inrush of water or other liquid matter,
o An instantaneous failure of a pillar, part of a pillar or several pillars of
coal (i.e. a 'bump') in working below ground;
o A premature collapse of any part of the working
o Any accident due to explosives,
o A breakage or fracture of rope, chain, headgear, pulley or axle

o An over winding of cages
o A breakage or fracture of an essential part of winding engine,
crankshaft, coupling, bearing, gearing, clutch, drum or drum shaft, or
failure of emergency brake:
o A bursting of any equipment containing steam, compressed air or
other substance at high pressure;
o A breakage, fracture or failure of an essential part of any machine or
apparatus whereby the safety of persons may be endangered:
o A slide causing injury to any person, damage to any machinery, or
interruption of normal mining operations;
o Failure of dump or side in opencast working
o A failure of any structure or installation whereby the safety of
persons may be endangered; or
o Spark generated due to electrical flash-over causing burn injury to
any person, the owner, agent or manager shall forthwith inform the
Regional Inspector about the occurrence by telephone, fax, e mail or
by special messenger; and shall also, within 24 hours of every such
occurrence, give notice thereof in the Form and method as may be
specified by the Chief Inspector for the purpose, to the District
Magistrate, the Chief Inspector and the Regional Inspector and
Compensation authority
 A copy of the notice shall be posted on a special notice board at the office of
the mine. Its shall remain legible for at least 14 days
 If death occurs the O, A or M shall send notice within 24 hours to CIM, RIM
DM and the Compensation Authority
 Particulars of every person killed or injured shall be sent in Form 4B within 7
days of occurrence
 A notice shall be sent in Form 4C within 15 days of the injured person
returned to duty

Chapter - 2

 When any person employed in a mine contacts notified disease the O, A or M


shall send notice in Form 5 within 3 days of being informed of the disease to
CIM, RIM, Inspector of mines (Medical), DM, and to the Competent
Authority for payment of compensation.
