The Maternity Benefit Act, 1961
Features and main provisions
• The Act applies to every establishment, factory, mine, etc., having 10 or more
employees. The State Government can extend the scope of the Act.
• The maximum period of maternity leave is - 26 weeks; (w.e.f. 1.7.2017) - eight
weeks (w.e.f. 1.7.2017) before the date of delivery and six weeks following
that date.
• Provided that the maximum period entitled to maternity benefit by a woman
having two or more than two surviving children shall be twelve weeks of which
not more than six weeks shall precede the date of her expected delivery.
Maternity leave of 12 weeks is also allowed to mothers legally adopting a child
below the age of 3 months. This amendment is applicable w.e.f. 1.4.2017.

• To be entitled for maternity leave a woman must have worked for not less
than 80 days in the 12 months immediately preceding the day of expected
delivery.
• In case of miscarriage, a woman is entitled to six weeks of leave from the day
of miscarriage.

take extra leave
• up to a maximum period of one month.
• A woman employee can ask for light work for one month preceding the six
weeks prior to delivery.
