F and t hos as Jocation of ed person: ‘That the above noted case i fixed on 11/03/ 24 for production ‘That One Si Jhoton Prasad In-charge of Lukochuri police camp under English bazar police station lodged a written complaint to the effect that on 08/03/24 at 0235 hours he along with force while performing RT mobile duty vide EBPS GD no-486 dated 07/03/24 at Khirki Janlabi Mango orchard under Mahadipur GP. Police station English Bazar, Dist Malda, found the above noted arrested person along with 2/3 others were going towards Khitki side through mango orchard slong with sacks on their heads, He further alleged that seeing the ight of the police vehicle they started run. After hot Chas they manage to apprehend Mejibor khan and Md Rashid Alam with seized articles and other 2/3 persons to fice away from thelr taking ladvantage of darkness and mango orchard. He found phensedyl bottles in the sacks and he informed the matter to 1/C, English Bazar police station and as per kind direction I tried to search public witness ‘but there was none in the lonely mango orchard. He further alleged that he inform them that they have liberty to be searched in presence ‘of any Magistrate or Gazette officer anc they agreed in writing to searched in presence of Gazette police officer, He informed about 0305 hours to 1/C English Bazar PS and requested him to come downat spot to remain present during search and seizure, Then at 03.45 hours of dated 08/03/2024 he searched the sacks and recovered Contd...P/2: Tow We MUL YOUN YL OLY 2D Ped WOE? al Lf CLM BM Pee? He seized 75 sealed bottles of Phensedyl from the sacks alleged to be carried by this accused person having Batch No-PHD23116 manufactured by Abbot Health Care Pvt. [Ltd Marked as Exhibit-B in the seizure list. Thereafter he arrested the said accused person by maintaining all formalities. (On the basis of the above noted written complaint English Bazar police station started Case No-328/24, dated 08/08/24 U/$-21 (C)/29 of NDPS Act “That the actual fact of the present case is that the present accused person was called by one Humayun Sk of Kaliachak, Baluatola, ‘Chandpur and the accused person on 02/03/24 at 10.00 A.M had been to the house of Humayun Sk and the mobile number of the said Humayun Sk is 8777804240 for work. The said accused person on that day came to the house of Humayun Sk where from the sald accused person was illegally detained by English Bazar police station without any cognizable offence at about 5-6 P.M thereafter said Humayun Sk {informed the wife of accused from the saidi mobile on that day that her husband was arrested by police and he informed that Rs-50,000/- is required for police and thereafter police will release him, The said wife of present accused petitioner on 05/03/24 came at Malda and handed over the said money to Humayun Sk. The said humayun Sk after taking the said money from the wife of the said accused and disclosed that her husband was kept at English Bazar police station and she had been to English Bazar police station and found her husband in the police barrack back side of English Bazar PS. in zoom No. 06, She talked with her husband and her husband stated that be ‘was taken to English Bazar police station on 02/03/24 at about 6 /7 PM. On 07/03/24 she made complaint before the SP Malda which wes received on 07/03/24 and DIG, Malda by post on 07/03/24 which was also received. Thereafter on 08/03/24 at about 1/2 am. the accused petitioner was taken to the alleged place of occurrence and planted the instant case by the police and returned the accused before the English Bazar Police Station at about 5 /6 a.m. on that day and forwarded before the Ld. CJM. Malda in connection with the said Case. Court by the present accused person and as such the LO. of the present case is required to be directed to produced SDR,-CDR, CAF and tower lecation of the said mobile being No. 9065915714 of the accused used at the time of illegal detention for the interest of justice, otherwise Article 1 of the Constitution of India will be violated. 7) That in fact the present accused person was cetained illegally by the Police of English Bazar PS. on 02/03/24 to 08/03/2024 and he was detained at English Bazar PS. on 02/03/2024 at about 6/7 PM. The CCTV footage of English Bazar Police Station on and from 02/03/24 to 08/03/24 since evening to night and on the back side of Police Station of police barrack, 2" floor Room No.06. 8) So the said CCTV footage of English Bazar PS. is very much important piece of evidence which required to be preserved for the interest of justice and production the said CCTV footages of the English Bazar PS. of entrance gate and Lockup and back side of police barrack at PS. on those dates is required to be preserved and produced before this Ld.
