INTRODUCTION...

Right To Information act was enacted by


Parliament Of India on 15th june,2005 and
was commenced on 13th october,2005.
The most important principle of
democratic government is popular
sovereignty. The Right To Information (RTI)
is an act of the Parliament of India which
sets out the rules and regulations
regarding the citizens. It replaced the
former Freedom of Information Act, 2002.
Under the provisions of RTI act, any
citizens of India may request information
from a "Public Authority" which is required
to reply within 30 days.

administration and people.
• It makes people aware
of administrative decision-making.
• It facilitates better delivery of goods
and services to people by civil
servants.
• It facilitates intelligent and
constructive criticism of
administration.
• It increases people's participation in
administration.
• It reduces the scope of corruption in
government.
• It makes administration more
responsive to the requirements of
people.

HISTORICAL The RTI bill was passed by
Parliament Of India on 15th
BACKGROUND OF RTI june,2005 and came into force with
effect from 12th october,2005.
ACT... Every day on an average, 4800
applications are filed. In the first
ten years of the commencement of
RTI act, over 17500000
applications had been filed.
Freedom of information laws
have existed since 1766,granting
public access to government
documents. The US passed the
freedom of information reform act
in 1966. Today RTI is operating in
more than 85 countries in the
world.

accountability in the working of
every public authority.
• To increase citizens awareness
and ability to exercise their
other rights.
• To take responsibility of all
sections such as citizenry, NGOs,
media, etc.
• To make our democracy work for
the people in real sense.

ISSUES IN IMPLEMENTATION OF RTI
1. Low Public Awareness.
A large proportion of people are still unaware of the RTI.
Awareness level is lower among the disadvantaged communities
such as women, disabled persons, OBCs, SCs, and STs.
2. Restrictions faced in Filing Applications.
People face many difficulties in filing applications due to non-
availability of user guides for RTI fulfilment for information seekers.
However, inadequate efforts have been made to receive RTI
applications through electronic means i.e., on email/ website, etc.
3. Poor quality of Information provided.
In a survey conducted on RTI applications, poor quality of
information was reported to be the biggest cause of filling first level
appeals.

4. Failure to provide Information within 30 days.
PIOs are challenged to provide the information within the
stipulated time due to an inadequate record management
procedures with the public authorities. This situation further
aggravated due to non-availability of trained PIOs and the
enabling infrastructure.
5. Inadequate trained PIOs and First Appellate Authorities.
Very large number of PIOs have not received trained
regarding RTI provisions their obligations under the Act. There
is lack of training as well.
6. Poor Record Management.
Often, poor record management results in poor quality of
information provided, additional and unnecessary burden on
the PIO, delay in providing information, and times wrong
information being given.

7. Non-availability of Basic Infrastructure.
Implementation of RTI requires the PIOs to provide
information to the applicant through photocopies, soft
copies, etc. While these facilities are considered to be easily
available at a district level, it is a challenge to get
information from Block/ Panchayat level.
8. Lack of motivations among PIOs.
This is because, among other things, lack of incentivies
for taking on the responsibility of a PIO; however
penalities were imposed in case of non compliance.
CONCLUSION...
RTI can provide a strong support to
democracy and promote good
governance, by empowering the citizens
ability to participate effectively and hold
government officials accountable rather
than just providing information. RTI needs
to be filed in a specific format for seeking
some information and not discussing
consumer dispute in it. RTI can be filed
against government run bodies and
private bodies owned partially or
considerably by government bodies. After
30 days from filling of RTI if applicant
don't get adequate reply from PIO, then
he can approach the consumer forum.
