Today the case is fixed for order on the petition dated 28 2020 filed on behalf of the accused persons

namely e Sudama Pradeep and Pappu for discharge them under section 245 of CRPC order complainant
is absent and there is no Paravai on his behalf learnt counsel of complainant is also not present before
the court all three accused persons filed their Hazri case called out all three accused persons present
before the court along with their Council the copy of the petition has not been served on the
complainant counsel due to his unavailability as mentioned on the petition there is no any resigned are
Rees Winder filed on behalf of the complainants side

The learned counsel for the accused petitioners named above submitted through the effort said petition
That complainant has not produced any before charge evidence in this case against ever named accused
persons even after given sufficient opportunities for the same thus there is no material available on the
record to frame charge against accused persons and consequently made prayer for discharge of all three
named accused persons under section 245 of CR PC

Hold and produce the case record on sincere perusal of record it transpires that it is a complaint case in
which the summoning order is fast past fast under section 323 379 of IPC against three persons namely
wide order dated

thereafter the record was running for before charge evidence but the complainant did not produce any
witness before the court to depose for before charge evidence the complainant was given sufficient
opportunity to produce witnesses but he failed and remained absent continuously since 15 seven 2010
the complainant has been given last chance on dated 25 two 2020 to produce witnesses four before
charge evidence on his failure eventually the way for charge evidence was closed on 28 to 2020 it
appears that the complainant has lossed his interest in this case next Lane

Therefore this cold consider that there is no any before charge evidence available on the record for
framing charges against named accused persons and it is a fit case for order under section 245 of CRPC
hence it would be essential for ends of justice two discharged the accused persons under section 245 off
Sierra PC accordingly the discharge petition dated is allowed and accused persons namely are hereby
discharged under section 245 of CRPC and their bailers are released from their respective liabilities

Office is directed to deposit the record in record room within stipulated time
