Subject: Legal Notice on behalf of Ghulam Rasool Khan R/o


Kakroosa Handwara Kupwara.
This legal notice is being served upon you on the
instruction from our client Ghulam Rasool Khan, who
happens to be a Contractor and is working with your
Company from last many years.
As reported by our client and evident from the
perusal of available official documents, that our client has
been working with your company from last many years and
the relation has been smooth, the last contract was
between your company and our client for the work of
construction of Tower at 16 A/0 Mundji Sopore and it
has come into our notice that you have breached the
contract by stopping and withholding the payment for the
work done by our client.
That our client has successfully completed the
contract at the site but you have stopped the payment of
the work done. Moreover you have also stopped the
payment of security deposits of other 16 projects
completed by our client without any legal authority to do
so. It is pertinent to mention here that the amount withheld
by you company is more than Rs 500000/- and you are not
releasing the funds from last 6 years. Furthermore my
client has dumped material for construction of wall around
the site at Sopore which amounts to Rs 350000/- is also
lying with your company. That our client has an
apprehension that he is being wrapped with some mala
fide intentions resulting in this kind of serious prejudice to
him and he has already made many hand fold requests to
the company but you are not paying any heed to the hand
fold requests of our Client thus it is the responsibility of this
company to clear the amount mentioned above in favour of
our client. That if you fail to rectify the breach of contract
done on your part we will be forced to take appropriate
action against you and will seek all available damages and
remedies under Agreement and applicable laws.
Therefore, you are informed that any illegal action at
this stage sustained by you may entail serious legal
consequences Therefore to protect the vital interests and
rights our clients who have been agitating his grievance
against the arbitrariness shown from your side it is advised
to look into the matter and act accordingly.
Therefore, it is all the more important that you desist
from taking illegal action at this stage and release the
Payment of Rs 850000/- in favour of our client so that any
adverse consequences are avoided.
Therefore, before proceeding ahead, it will be proper
to apprise you about the legal position and the
consequences, and after understanding the position
arising under law, it is expected that appropriate response
from you will reach us within a period of ten days from
the receipt of this notice failing which we are already under
serious peremptory instructions from our client to institute
legal proceedings which includes civil as well as criminal
cases against you in an appropriate forum/court for the
redressal of his grievance.
