Show Cause Petition

The humble show cause petition on

behalf of the defendants 1, 2 & 3

above named

Most respectfully Sheweth :-

1. That the defendants 1 to 3 received summons of the suit on or

about November 2020 and subsequent date for appearance was

fixed on 11.01.2021.

2. Due to sudden lockdown for two times, your petitioner could

not appear in the suit during the period from January 2021 to

December 2021 as also local tram service was totally disrupted and

from time to time due to such Covid situations.

3. That your petitioners state that the defendants no. 1 to 3 have

entered appearance by filing the vakalatnama on 1 1 .02.2022 and

prayed for adjournment time to time to file the written statement

and ultimately on 07.12.2022 was fixed for filing written statement

as a last chance and your petitioners filed the Written Statement on

the said date to comply the court order. Ld. Advocate for Plaintiff

has already taken a copy of the written statement without raising

any objection.

4. The petitioner states that due to Covid situation all the normal

functions of the defendants, were jeopardized. Moreover defendants

2 and 3 are residing at Hyderabad, Telengana and office of the

defendant no. 1 is also situated at Telengana. Therefore it took

some time for giving necessary instructions to the Ld. Advocate of

Calcutta as also to send the para wise comments on every

averments stated in the plaint to draw the written statement.

5. Therefore the delay of filing Written Statement was totally

unintentional and may be condoned and the Written Statement may

be accepted as otherwise your petitioner will be highly prejudiced.

6. That this application is made bonafide and in the interest of

justice.

In the circumstances it is prayed,

that the cause shown as stated

above may be accepted and the Ld.

Court may be pleased to accept the

written statement by condoning the

unintentional delay in filing the

Written Statement filed by the

defendants abovenamed in the

above suit and such other order or

orders be passed as to this Ld. Court

may deem fit and proper,

And your petitioner as in duty bound shall ever pray.

Hindu, working for gain with the company, defendant no. 1, at 8-2-

337, Road No. 3 Banjara Hills, Telengana, Hydrabad - 500034, do

hereby solemnly affirm and say as follows :

1. That I am................ ...... and constituted^attorney of the

defendant No. 1 company abovenamed and I am fully conversant

with the facts and circumstances of this case and I am competent to

swear this affidavit on behalf of defendants No. 1,2 and 3

abovenamed.

2. That the statements made in paragraphs 1 to 4 of the forgoing

application are true to my knowledge and the paragraph 5 and 6 are

my humble submissions before the Ld. Court.
