ORDER:
In G.0. first read above, orders have been issued for providing relief to
the dependents of the deceased Government servants who died in harness while
in service by providing compassionate appointment to the spouse or the
dependent children of the deceased Government servant to the posts, the pay
of which is equal or less than what of Lower Division Clerk (Junior Assistant),
without the media of Employment Exchange and Andhra Pradesh Public Service
Commission, subject to certain conditions specified therein and also in various
orders issued from time to time on the Scheme as a social security measure.

2. In para 2(1) of the G.0. second read above, among other things, it has
been ordered that the younger brother/sister of the deceased Government
servant who remained unmarried can be considered for appointment under the
scheme, provided there is no other earning member in the family.

3. In Memo 3rd read, above clarification has been issued that the words
"remained unmarried" occurring in para 2(1) of G.0. second read above are
applicable to the deceased Government employee only and therefore only in
cases where the deceased Government employee happens to have remained
unmarried, then only the younger brother/sister of such deceased Government
employee can be considered for compassionate appointment provided there is
no other earning member in the family as per the orders issued at para 2(1) of
the G.O. second read above.

4. In Circular Memo 4th read above, in Para-Il of sub-para (c), instructions


have been issued that in case of un-married government employee is expired
while in service, the younger brother/sister of deceased government employee
is eligible for compassionate appointment.

5. In the reference 5h read above, the Hon'ble Andhra Pradesh High Court in
its order in W.P.No.35294/2014, dt.19.3.2021 filed by Smt. H.Sita
R. Mangatayaru of East Godavari District have
Ratnam and
passed
the following directions:
"(0) The word "younger" mentioned at para No.2(i) of
General Administration G.O.Ms. No.612,
(Services-A) Department, dated
30.10.1991 is quashed;
-2
(i) The proceedings issued by the 3 respondent in RC.No. 145-A3/
2009, dated 28.01.2015 is set aside; and

(in) The respondents shall consider the representation of the 1


petitioner, dated 31.10.2009 (i.e. wife of deceased employee)
and provide appointment to the 2nd petitioner (i.e. daughter of
deceased employee) in any suitable post on compassionate
grounds, within a period of six (06) weeks from the date of
receipt of copy of this order.

There is no order as to costs.

Consequently, miscellaneous applications pending, if any, shall


stand closed".

6. Certain cases have been referred to Government for deleting the word,
younger" from the above said instructions, in respect of providing
appointments under compassionate grounds to the brother/sister of the
deceased employee in compliance with the orders of Hon'ble High Court passed
in W.P.No.35294/2014, Dt.19.03.2021.

7. Government after careful examination of the matter and in compliance with


the orders of Hon'ble High Court, hereby make the following amendment to the
orders issued in G.O.Ms.No.612, General Administration (Services-A)
Department, dated 30.10.1991.

AMENDMENT
In para 2(i) of the said G.0, the word "younger" shall be omitted.
