Sufficiently demonstrated professional competence of the highest degree and conducted

with integrity in the exercise of the profession.

In the exercise of his duties and function in his position as Regional Technical Director
of Lands, DENR Region V, Criminal and Administrative charges filed in the Ombudsman and
Civil Service Commission were dismissed. Complaints were mere harassment. He conducted
himself with integrity in the exercise of the profession and acted in accordance to policy
standards of his official function of his position. (Annex “5”)
As former member in the academe, shared his knowledge and experiences through
seminars to his Technical Personnel on field and office work for an effective and efficient
delivery of service and,

Institutionalized the use of Projection Maps in the Surveys Division, which is not
practiced in Region V, thus eliminating the double approval of a subdivision plan of a parcel of
land which is one of the sources in the issuance of spurious title.

Introduced Fast Verification and Approval of land survey plan, one (1) day instead of
fifteen (15) to thirty (30) days for subdivision plan with resultant lots of not more than ten (10)
Lots, and that housing subdivision projects a maximum of twenty (20) days, instead of forty-five
(45) days provided with complete survey returns as provided in the Manual for Land Surveys of
the Philippines, thus hasten the Verification and Approval of submitted Survey Returns and zero
backlogs.

Resource Speaker on the Seminar Conducted by the DENR on Cadastral Survey


Management and Cadastral Survey Execution in coordination with Geodetic Engineers of
Region V.(typhoon damage/destroyed)

Recommended to the Regional Executive Director the retention of the Geodetic


Engineers of the Philippines, Region V office building inside the DENR-LMS compound, based
on the principle that Geodetic Engineers are inseparable partners in the implementation of Lands
Administration and Management. Further, the sanctity of records is preserve because in the blue
printing of approved plans will no longer be brought outside the DENR compound.

Demonstrated his excellent leadership as mediator in resolving the years long


misunderstanding between the Geodetic Engineers in the DENR and Geodetic Engineers Private
Practitioner in Region V, and parties were reunited and harmonious relationship among Geodetic
Engineers were restored.

In 1983, he spearheaded in organizing the First GEP Chapter in Region 02 Division, and
was elected President , Isabela Chapter.

President,, Northeastern College Alumni Association, Inc. (NCAAI) High School and
College, Fiscal Year 2018 to date.

Coordinated with NEDA and entered into a Mamorandum of Agreement with the
Governors in Region V to resolve their problem in their Tax Mapping and Land Use Planning for
the reconstruction of lost or destroyed Cadastral Map. They provided financial for the needed
materials and personnel and we give training and supervision for the implementation of the
project,

COMPETENCE AND EFFECTIVENESS

The Nominee was appointed as Director III of the Department of Environment and Natural
Resources in 2003, and was designated as Regional Technical Director for Lands , DENR
Region V. (Annex “7”)

Concurrent to his position as Director III of the DENR, he was appointed by the President of the
Republic of the Philippines as Member, Board of Geodetic Engineering, Professional Regulation
Commission, Manila, in 2006. (Annex “8”)

In 2010, and in 2012, he was appointed by the Commission on Higher Education as Member of
the Technical Panel for Geodetic Engineering and serve up to 2018. (Annex “9, 10, & 11”) As
Chairman, he was tasked to assist the Commission in the following:

1. Conceptualizing and proposing new policies and guidelines for academic programs and
COEs and CODs;
2. Developing and proposing assessment instruments for purposes of permit and recognition
and conversion of HEIs to university status;
3. Developing and proposing project ideas related to policies and standard;
4. Drafting of comments relative to House and Senate Bills affecting higher education;
5. Proposing criteria- based evaluation assessment instrument for use by the Regional
Quality Assessment Teams (RQATS);
6. Represent the CHED in International and National meetings/workshop/conference, as the
need arises;
7. Identifying and monitoring of COEs/CODs

In spite of the three concurrent Key Positions task to him, he was able to manage and
obtain:

a. Annually, a Very Satisfactory and Outstanding Rating in his Career Executive


Service Performance Evaluation System from the Career Executive Service Board; (Annex
“12 & 13”)

b. Awarded Plaque of Appreciation for performing his duties with utmost commitment
and excellence for ten years of the Professional Regulatory Board for Geodetic Engineering,

The Land Management Sector ushered in greater stability to the Region by its rational
disposition of land resources through various instruments of tenure that strictly observed
equitable access to and benefit from this capital. It paved the way for critical conflict resolution,
and brought pride and honor to the Region in securing the land of rightful owners pursuant to the

1n 2013 -2015, he is one of the government delegates in the Association of South East Asian
Nation (ASEAN) Quarterly Meeting of Competent Authorities, and he is the Representative in
the Framework Arrangement in the Mutual Recognition Agreement for Geodetic Engineering /
Surveying borderless practice. ( Annex “15 & 16”)

Promoted the Art and Science of his professsion, and serves as Resource Person in the
Sanguniang Bayan and Sanguniang Panlalawigan for the resolution of Political Boundary
Disputes between / among barangays and municipalities and Provinces in Region V, Bicol
Region.

= GE/Contractor of DAR/DENR land survey projects. Conducted Housing Subdivision
projects, Community Mortgage Program (CMP)subdivision projects, Isolated survey (Original
and Subdivision) for the issuance of titles by the DENR and Register of Deeds, respectively,
Topographic survey, Engineering Survey for the construction of roads and canals, profile and
cross section of creeks and rivers for design in the construction of bridges.
= Deputized Mineral Land Surveyor by the Mines and Geo-science Bureau. Conducted
survey and prepared plans for Sand and Gravel Quarry Permit, and other mineral land survey for
verification and approval by the Mines and Geo-science Bureau.

= Chairman of the Board, Professional Environment Developer of Region O2 (PEDRO2),


contractor of Survey Mapping Project for the reforestation project of Provincial Environment
and Natural Resources Office (PENRO) Batangas. The area was surveyed by blocks of 200 by
500 and marked by wooden post. Soil sampling/ test to determine the kind of fertilizer and
species of tree to be planted in that area. Prepared and submitted feasibility study on the project
for reforestation.

GOVERNMENT PRACTICE

1976- 1980 = National Irrigation Administration - Magat River Multi-Purpose Project


(Appointed as Survey Aide II, Instrument man, and Engineer Trainee) Conducted the Final
Survey ( Horizontal and Vertical ) Pre-construction of Main Canal Irrigation Project, National
Irrigation Administration - Magat River Multi-Purpose Project ((NIA- MRMP), Horizontal and
Vertical (Profile and Cross-section) of proposed Lateral Canals, Main Farm Ditches, Small Farm
Ditches, and Drainage Ditches, establishment of vertical reference for construction of bridges,
Horizontal and Vertical ( profile and cross-section ) of access and serviceroads. Checking of line
and grade for final payment of contracts. As Engineer Trainee, of the Operation and
Maintenance, monitored/supervised the different survey teams field works ((profile and cross
section of existing canals ) and also the office survey personnel in the computation of gather field
data and evaluate the prepared plan acceptable
and ready for design by the Engineeng Division for irrigation rehabilitation projects
1980 - 1983 = Bureau of Lands, Department of Environment and Natura Resources.
1. Appointed as JR. Geodetic Engineer and designated as Assistant Chief Survey Party
stationed at Santiago, Isabela. Supervised/Monitored field work in the establishment of Project
Control and Lots Survey to the actual occupants/claimants, gathering of field data, and persuade
parties for settlement of claims and conflict to lessen the burden for an effective and efficient
issuance of land titles to occupants/ claimants. Supervised/Monitored the office work in the
computation of field data, preparation of maps, and list of survey claimant and survey card.
Presentation by barangay to the occupants/claimants the result of the land survey, the map and
the list of claimants, in a meeting called for correction, prior to final printing and submission for
verification and approval of the survey returns for the subsequent issuance of their respective
titles.
2. Appointed as Geodetic Engineer and designated as Asst. Project Engineer, Metro
Tuguegarao, Land Use Inventory and Mapping, Tuguegarao, Cagayan. Supervised/Monitored
the gathering of field data of the different survey teams. Supervised the interpretation and
preparation of the different maps with land use color code, which is the basis of the Local
Government Units in the preparation of their Comprehensive Land Use Plan.

2003 - 2017 = Director III, Department of Environment and Natural Resources,

1. Designated at the office of the Undersecretary for Lands and Staff Bureaus, serves as
Technical Assistant on Land Administration and Management, Represents the office in
Congressional Committee Hearings on Land concerns, Meetings in the Presidential Agrarian
Reform Council (PARC) Department of Agrarian Reform, Land Administration and
Management Project - Australian Funded Project, Land Registration Authority, NAPC, HUDC,
NHA, and other offices concern;

2. Designated as Regional Technical Director for Lands in Region V.


= Recommended the retention of the Geodetic Engineers office building inside the DENR-LMS
compound due to the principle that DENR-LMS and GEPI are inseparable partners in the
implementation of Land Administration and Management particularly in the issuance of owners
title under the Agricultural and Residential Free patent. ONLY GEP REG'L OFFICE
BUILDING INSIDE DENR COMPOUND.

= Institutionalized the use of Projection Maps in the Surveys Division which is not practiced in
Region 5. This procedure eliminates the double approval of subdivision plan of a parcel of land
which is the source in the issuance of spurious or double title, since approved plan is a basic
requirement in the issuance of Land Title.

with the provisions of RA 9480, Procurement Act. He strictly enforced that only natural person
is eligible to participate in the bidding. Review and approves the prepared Terms of Reference
for publication in the DENR Lands Management Services Website.

= Serve as Resource Person in the Sanguniang Bayan and Sanguniang Panlalawigan for the
resolution of Political Boundary Disputes between/among barangays and municipalities in the
Bicol Region.

3. Designated as Asst. Regional Director for Management Service, DENR Region 1, City of
San Fernando, La Union.
= Supervises the four (4) Divisions in the regional office, namely, Planning, Legal,
Administrative, and Finance.
= Review and recommends actions on legal, administrative, and technical issues and concern of
the four Divisions for approval of the Regional Director.

Demonstrated his excellent leadership as mediator in resolving the years long misunderstanding
between the Government Geodetic Engineers in the DENR and Geodetic Engineers Private
Practitioner in Region V, and parties were reunited and harmonious relationship among geodetic

of their stay for research, submission of their survey plan for verification
and approval in the DENR, thus ASSOCIATIONS DREAM TO HAVE ITS

12. As member of the Board of Directors, voted for the purchase of a blue
printing/sepia machine and xerox copier by the Association to provide
service for a discounted or lesser cost to members and also to provide
service to the public. Such income serves as the fund source for the
continuous construction of now three (3) story building.

III. Contributed significantly to the advancement of the profession.

A. Publication
Contributor of an Article published in 2004 in the " FIELDNOTES ", an official newsletter
of the Geodetic Engineers of the Philippines, " The Effect of a Geodetic Engineer as Regional
Technical Director for Lands in the DENR ". Geodetic Engineering is a five (5) year course. We
can't deny the fact that Non Geodetic Engineer Regional Technical Director for Lands has a very
limited technical knowledge, hence, needs Consultation prior approval of plans that causes great
delay.
B. Research Project.

Research Work No. 1

The research was conducted and presented to the Presidential Agrarian Reform Council
meeting and now adopted and implemented by the DAR and DENR.

FACTS:
Subdivided untitled properties were approved bearing Csd as the Survey System and
subsequently DAR issued each lot an Original Certificate of Titles to farmer beneficiaries.
Owner of the parcel of land surfaced claiming payment of his property covered by his Original
Certificate of Title on same parcel of land mentioned above. Survey system Csd is a subdivision
for Untitled Lands and Psd is a subdivision for Titled Lands. Practice of Regional Technical
Directors for Lands of the DENR to issue Order of Correction on approved plan to change the
survey system from CSD to Psd and the correction shall be annotated on the registered title.
ISSUE:
a. Whether or Not Correction Order on a registered lands issued by the
Regional Technical Director for Lands is valid.
b. Whether or Not the Original Certificate of Title issued by the DAR is valid.
c. Whether or Not Change of Survey System and number collaterally affect
the registered title.

LAWS AND POLICIES:


The issuance of Title to a parcel of land is based on the approved Survey Plan. In Land
Registration Law, as amended, Original Certificate of Title is the first title to be issued to a
parcel of Land. Subsequent issuance is Transfer Certificate of Title either as a whole or portion
thereof. Cancellation or correction of the title shall be covered by Court Order. The PARAD and
DARAB has primary jurisdiction on cases involving issued titles by the DAR. Different kinds of
land surveys has corresponding survey system according to status and use, and serve also as
check and balance on issued titles. The survey number in sequence must jibe with the date of
submittal and approval of plans.

RECOMMENDATIONS:
PARAD or DARAB shall issue Order for the Cancelation on the issued titles and the
approved plan. DAR prepare a new plan for verification and approval by the DENR-LMS for the
issuance of Transfer Certificate of Titles derived from the Original Certificate of Title.

Research Work No. 2


The Regional Development Committee tasked the Regional Technical Director for Lands
Services of the DENR to conduct research and submit findings/result and recommendations to
concerned authorities for evaluation and further action.

FACTS:
On October 8, 1977, the late President Ferdinand E. Marcos, proclaimed an
area adjoining the Albay Gulf situated at Rawis , Legazpi City, Albay for Government Regional
Center Site of Region V, with an area of Thirty Five Thousand Four Hundred square meters,
more or less, portion thereof the Professional Regulation Commission building was constructed.
All private properties were already paid during the Martial Law era. Sometime in 2012 Mr. Allan
Frederick Mendoza Shaffer, surfaced and now claiming TWELVE MILLION PESOS, payment
of their titled property with an area of Three hectares, more or less, issued under Judicial Land
Registration. The land is adjacent to their property previously paid within the Proclaimed area.
The requested payment was presented in a meeting of the Regional Development Council by
it's Chairman. Doubts and different opinions came to the minds of the members as to the
LEGITIMACY OF THE TITLE, why such claim of payment was not made at same time with
their paid property. The principle of accession, the owner of the adjoining lot is the owner of the
gradually added sediments thereof by ACCRETION. Adjacent lands were covered by foreshore
leases and instrument issued should be FORESHORE LEASE. No title to a land shall be issued
WITHOUT SURVEY AND APPROVED PLAN by the Director of Lands ( now the Regional
Technical Director for Lands Management Services ) The Regional Technical Director for
Lands Management was tasked to do the research and submit result for evaluation by concerned
authorities.
Owner approached me to facilitate my recommendation. I answered him that it is one of
my priority task. Another person came to my office with an offer for a favorable
recommendation. I told him, I am sorry, my recommendation shall be based on gathered
documents.
ISSUE: Whether or Not the issued title is valid for payment.

FINDINGS/CONCLUSION:

Cadastral Survey is the survey for the entire municipality to determine it's Political
Boundary and area, the Forest Boundary and area, the Alienable and Disposable area and
individual lot occupied/claimed for the issuance of tenurial instrument. The subject parcel of land
is outside the Cadastral Survey of Albay, now Legazpi City. On the foot note of the approved
survey plan used in their title, it was a portion of Albay Gulf, hence, it is an ACCRETION. By
the principle of accession, lands formed by accretion belong to the riparian owner, Article 457 of
the Civil Code of the Philippines.One of the Essential Elements of Accretion is that "the cause is
a current of the River, if a Lake the Spanish Law of Waters on August 3, 1866 must apply, if the
Sea the deposit belongs to the Estate" ( Gov't. of the Philippines v. Cabangis, 53 Phil.112 ),
(Pascual v. Angeles, 13 Phil. 441).
Prior to the passage of Public Land Act (Com. Act 141), as amended, Regular Courts may
classify lands of the public domain as Alienable and Disposable and order the Land Registration
Authority the issuance of a Decree for subsequent issuance of title to qualified applicant.
Sec. 4 of the Public Land Act, the Director of Lands shall have direct executive control of
the survey, classification, lease, sale or any other form of concession or disposition and
management of lands of the public domain, and his decisions as to questions of fact shall be
conclusive when approved by the Secretary of Agriculture and Natural Resources.
Only classified Alienable and Disposable lands shall be issued title to qualified applicant.
Inland waters like creek, rivers, and lakes were inside the area classified as A & D, hence,
accretion within this area were deem classified as A & D. Accretion on sea bank formed by
current of waters in the sea belongs to the estate and is still subject to land classification before it
can be disposed.
The subject land is an Accretion on Sea Bank and not included in Sec. 59 a, b, and c,
therefore classified under Secs. 59(d), and shall be disposed as provided in Secs. 60 and 61 of
Public Land Act, that upon the declaration of the President that the land is not necessary for
public service and open for disposition shall be disposed only by LEASE OR SALE, hence,
disposition of the subject land is within the DENR and neither authority nor jurisdiction of the
Courts.
Further, the lot claimed for payment is an Accretion on the bank of Albay Gulf, and gulf
is a part of the sea, being a mere indentation of the sea. Therefore the land is an accretion on sea
bank, hence, issued title is VOIDABLE.
The researched was forwarded to the Office of the Secretary of the DENR for review and
recommendation to the office of the Solicitor General for consideration in filing the case of land
reversion to the estate.

C. Positive impact of contribution to the profession.


On the contributed article published in the Fieldnotes, created awareness to Geodetic
Engineers the proximate cause of very slow verification and approval on their submitted land
survey plans in the Lands Management Sector, DENR, in which affects the issuance of Land
Titles by DENR and DAR projects. DENR Secretary addressed the issue and in same vein, thus
open the gate for greater chance to Geodetic Engineers for the position.
In the academe, Saint Louis College ( Now University ) of Tuguegarao submitted my
name and license to CHED for their permit/recognition to operate Bachelor of Science in
Geodetic Engineering, that pave better opportunity of their graduates in Associate in Geodetic
Engineering. Great number of graduates in Northeastern College and Saint Louis University of
Tuguegarao successfully passed the Licensure Examination and some were in the top ten. Some
of these successful graduates landed to a job in the Academe, employed in the Government, and
private firm, employment Abroad, the most were in Private Practice of profession as contractor
or employees of DAR and DENR Cadastral Projects. Those not able to pass the examination
were also hired by Geodetic Engineers/Contractors as survey instrument man,
equipment/computer operator.

Significantly, increased of Geodetic Engineers in region 2, increases the Geodetic Engineers


of the Philippines, Inc. membership that makes more strong and progressive association.
Sufficient number of Geodetic Engineers will eventually contribute to the economic growth of
the nation.

On the researched work, It will serve as reference and guide for Geodetic Engineers in the
practice of their profession. The government will be saving 12 million pesos.

Contributed much in the implementation of early completion of Cadastral


Survey Projects in the Philippines for the issuance of tenurial instruments to landowners, that can
be used to increase their capital and production and subsequently enhanced revenue collection of
Local Government Units for economic recovery and better delivery of service to the people, and
will serve also as reference for the Local Government Units in the preparation of their
Comprehensive Land Use Plan.

Significantly contributed the poverty alleviation in the country, particularly in Region V, in


the issuance of security of tenure to landowners of 46,435 agricultural patents and 35,464
residential patents within his stay as Regional Technical Director for Lands in Region V.

assistance during weekly meetings of the club.

and heavily affected area in Region 02, by the Rotary Club of Santiago City.

- Gift giving to selected poor families during Christmas season within the
different barangays of Santiago City, by the Rotary Club of Santiago City.

Geodetic Engineering in Region 2, sponsored by Geodetic Engineers of the
Phils., Inc, Regional Division 02.
