CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF LEASE is made and executed this ________________ at


Hinundayan, Southern Leyte, Philippines, by and between:

JOSEPH E. ALMARIO, of legal age, Filipino, married to FELIPA ADLAO ALMARIO,


and a resident of District , Southern Leyte, hereinafter referred to as the “LESSOR”;

-AND-

RAYMOND O. TOGONON, of legal age, Filipino, married to LIZA S. TOGONON,


and a resident of Brgy. Navalita, Hinundayan, Southern Leyte, hereinafter referred to as
the “LESSEE”;

WITNESSETH:

WHEREAS, the LESSOR, is the owner of a PORTION consisting of TWO


HUNDRED (200) SQUARE METERS of a certain parcel of land situated at District II,
Hinundayan, Southern Leyte, designated as Lot No. 306;

WHEREAS, the LESSOR is willing to lease to the LESSEE a PORTION of the


above-described property owned by the LESSOR;

WHEREAS, the LESSEE are desirous of renting the said PORTION of lot;

WHEREAS, the sketch plan showing the particular location of the said PORTION
consisting of 75.25 square meters, which is the subject of this CONTRACT OF
LEASE, is hereto attached and made an integral part of this agreement and such sketch
plan is acknowledged by the parties by affixing their signatures therein;

WHEREAS, the LESSOR hereby guarantees, represents and warrants that he


has a good, valid, and subsisting right, interest, and title to the above-described
property herein leased to the LESSEE and guarantees and warrants in favor of the
LESSEE the peaceful possession and ownership thereof;

NOW THEREFORE, for and in consideration of the foregoing mutually agreed upon
covenants stated herein, the LESSOR hereby lease unto the LESSEE subject to the
following terms and conditions:

1. PERIOD - The CONTRACT OF LEASE shall be for a period of TEN (10) YEARS,
commencing on June 1, 2024 and RENEWABLE at the discretion of the LESSOR;

2. PURPOSE- During the period of the lease, the LESSEE shall use the leased
premises for business;

3. RENTAL - The amount of rental is FIVE THOUSAND PESOS (Php 5,000.00) per
month;

4. IMPROVEMENTS - Only the portion of the leased premises labeled in the Sketch
Plan as “Subject for Development” consisting an area of 55 SQUARE METERS
may be constructed upon and made improvements thereon; as for the remaining
portion of the leased premises comprising of 20.5 SQUARE METERS and labeled
on the Sketch Plan as “Existing Building for rental purposes”, the LESSEE shall
not make any renovations, improvements, or changes in the structures thereon;

5. Any structure built and improvements made on the leased premises shall pertain
solely to the LESSOR after the expiration or termination of this Contract of Lease;

6. TAXES - All taxes, assessment and other burdens validly levied or asserted by
any legally constituted authority against the leased premises shall be paid and due
solely by the LESSOR;

7. PROHIBITION - The LESSOR shall not encumber, sell or dispose of the


PORTION of lot hereby leased during the effectivity of this CONTRACT or its
renewal, if any, without notice to the LESSEE;

8. CHARGES AND UTILITIES - The LESSEE shall pay for the consumption of
water, electricity and other utilities in the leased premises;

9. Should the leased property be alienated, the LESEE shall be given preference to
purchase the same at a reasonable price and may be sold to the other parties
should the LESEE decide not to purchase the same; and

10. The parties agreed that any action arising from this contract shall be filed
exclusively in the proper court of Southern Leyte, Philippines.
